A Public Hearing Has called on the appeal from the den:1.al by the Board of Adjustment
and Appeal on Zoning of a request from Hr. F. I. Gates for R_l~ (multiple d\'lellings) use
of acreage in the north half of the N\'l} of S\-r~., Section 22-29-15, presently zoned R-l.
Nr. H. H. BaSkin, Jr., requested Mr. Allbritton. to act as City Attorney during the
hearing as a member of fiIr. Baslcin IS fam:1.1y had had an interest in the subject property.
I-lr. John Bonner represented the applicant. The Clerk read letters of objection from
r-1:ssrs. Emerson Perr>y, Hm. f.l. Felmly, George T. Marsh, J. T. Finn. r.lr. J. C. Young,
attorney, stated he represented sixteen ovmers of lots immediately adjacent to the
proposed project and presented a petition signed by 175 persons living on adjacent
land 1'r1 thin an area of' two blocks. He also presented a letter of objection f'rom the
Brookhill Property 0\1nerS Associat:1.on. Objections 1-'lere made by j.Iessrs. Emerson Perry,
Geo. T. Marsh, H. Ka1lunld, Don Delvlay, Hm. H01'lling that the proposal \'lould depreciate
value of property, c~eate a traffic hazard and drainage problems. Commissioner Smith
suggested the possibility of attempting to settle the problem by the applicant meeting
with the property O\mers in the area and Attorney Bonner requested a continuance to
allow' time .for such a meeting. After f'urther' dj,scussion, Comm.tssioner Fields moved to
uphold the Board of' Adjustment and Appeal on Zonj.ng and deny the request to change the
zoning. Motion wa s seconded by COIlUlU ssioner 1'Jatkins and carried unanimously.
Nr. H. H. Baskin, Jr., resumed his cha:i.I' as City Attorney.
The ~1ayor asked if the Conuni ssion i'lishcd to talce up an item not on the agenda,
a petj.tion to control stray dogs. COllmn ssioner via tldns moved to deviate from the
agenda for a period of' f'i ve minutes. I.lotion \'las seconded by Conunissioner Fields and
carried unanimously.
Nr. Frank Nufrio, goG Greem-lood, pr(~sentcd a petition sj.gned by t\1enty-four
persons aslcing for be'eteI' control of' stpay clogs. Commi ssioner ;:la tldns moved the
ma tter be referred to the City Attorney to sce \"Illa t can be i'lor1ced out. f.1otion wa s
seconded by Conunissioner Fields and carried una~imously.
Regarding the bids for four sections, 110 seats each, portable steel bleachers
for the Parks and Recreation Department, the f.lnnager recommended accepting the 101'1
bid of' $1,430.00 from Reeves Steel Company, Tumpa. Commissioner \'/atkins moved the
contract for portable steel bleachers be avroI'ded to the Reeves Steel Company of Tampa
in the amount of $1, lf30 .00, this beinG the lowost and best responsible bid, and the
proper officials be authorized to execute the contract in accopdance i'lith the plans and
specif'ications of the bid. Notion was seconded by Conunissioner Insco and carried
unanimously.
The Attorney outlined the provisions of the Briley, vlild and Associates contract
for engineering services. He reconunended that lITr. Harold Briley or his attorney be
notified to come over and discuss sOlne of' the provisions which are not clear.
Commissioner vlatlcins moved upon recorrllnendation of the City Attorn.ey that 1'le invite
representa tives of Briley, vJild and Associates to meet \'li th the City Commission to
clarify the present agreements. Motion was seconded by Cow~rlssioner Fields and
carried unanimously.
Resolution 59-56 \AlaS presented which l'lould require thirty-tvlO pl"operty 0\'111erS to
clean their lots of \'leeds and underbrush. Commi ssioner \'latlcins moved Resolution 59-56
be passed and adopted and the proper officials be authorized to execute it. Motion
\'las seconded by Commissioner Fields and carried unanimously.
The Manager submitted an application from \'lhitney & Hutchins to operate a second
hand store. Commissioner Fields moved that the Commission deviate from the agenda to
pass on the application for a license for \~1itney & Hutchins. Motion was seconded by
Commissioner Watkins and carried unanimously.

The Manae;er reported that the application from Joseph \'/hitney and Sanborn
Hutchins for a second hand store Ij,cen13o ut 135G South Fort Harrison had been appl.~oved
by Police Chief VI. D. Dooth and the Finance Director. Conun:tsD1.oner Fields moved upon
recollunendation of the Finance Department and the Police Department that the application
of vnlitney &; Hutchins at 1356 South Fort Harr:t13on be approved. Motion was seconded
by COllun.:tssioner Vlatlc1ns and carried unanimously.
An invitation was read from r.w. Avery R. Harris, President of Parents AS60ciation,
Clearwater Little League, for the Conuuission to attend the dedication of the new
Little League Ball Parle on June 6th at 7:30 p.r.I.
Resolution 59-57 i'laS presented "lhich \'lould assess the construction of storm
sewers in an area on Clearwater Beach bounded on the south by Acacia, on the east by
Clearwa ter Bay, on the north by Bay Esplanade and on the ''lest by the Gulf. COllunisa1oner
Watkins moved Resolution 59-57 be approved and the proper officials be authorized to
execute it, this assessment being in accordance vr.l.th the method approved at the public
hearing. Motion \'las seconded by COllunissioner Fields. Conun1ssioner Smith requested
perm:!. ssion to refrain from votinG as he "TaS an affected property owner. Upon the vote
being taken, Commissioners Watkins, Fields, Finch and Insco voted lIAyell. Conunissioner
Smith did not vote. Motion carried.
The Attorney presented for its first reading Ordinance 322 which would declare
the City's intention to annex Lot 1, Bloclc 23, 4th Add1 tion to Highland Pines;
Lots 15 and 16, Blocle D, ?ine Ridge Subdivision; and acreage in Sections 1-29-15 and
2-29-15 (including area to be known as r-Iontclaj.r Lake Estates). The l\1ayor stated he
\'las not prepared to vote on this ordinance until he had more information on the
acreage proposed to be annexed. Conunissioner Vlatlcins moved to postpone the matter
to the next regular meeting. Motion \'las seconded by Conullissioner Insco and carried
unanimously.
Item 8, "Request Approval of Ivlontclair 1.ake Estates" \';as announced. Commissioner
vlatlcins moved Item G be postponed to the next meeting. r-lotion was seconded by
COlTunissioner Insco and carried unanimously.
Mr. Martin Kovachich, o\"mer of' El Rey Motel on Clearwater Beach, aslced the
Conmdssion to consider planning for a second causeway to the Beach because o~ the
cro\'lded conditions on Memorial Cause'-lay. C0111111i ssioner Insco commented the fea s1 bili ty
report made several years ago stated a second causeway ViaS not feasible at that time
but because of the rapid grovrth of the City he proposed that the Conunission oonsider
the situation again at budget time.
Nr. George Boschen, 675 f/Iandalay, aSlcecl that some worle be done on the ne\v groins
on clearwater Beach. The Engineer stated he had made a budget request to cover
maintenance of the groins.
r'.1l". Floyd Hopper complaj.ned of' inequities in the occupational license ordinance
as it applies to owners of' apartments claiming it .favored the mmers of large apartment
houses. Commissioner \'latldns stated n. study i'TaS being made of the ordinance at this
time to correct any discrepancies. ConU'ilissi.oner Hatkins moved to accept this complaint
and make it a matter of' record. t10tiol1 \'las seconded by COlrun1ssioner Fields and carried
unanimously.
Conunissioner Insco turned over to the Cj.ty Attorney for :tnvestigation a complaint
that the duckS in Crest Lake parle Nere being molested and r:illed and that dogs "1ere
running in the parle "rl thout being leashed.
Corrunissioner Insco recommended that a telegram be sent to the Pinellas legislative
delegation urging the passage of' the bill reconunended by the Florlda Shore and Beach
Preservation Association concerning the creating of an Internal Improvement Fund
Committee. Conunissioner Fields moved that the Conunissiol1 endorse House Bill 1117 and
Senate Bill 1151 by telegram. Motion ,'las seconded by Conmdssioncr Smith and carried
unanimously.
The Commission, now adjourned as the City Conuuission and acting as Trustees of
the Pension Fund, heard letters read from tho l\dvj.sory Conuni ttee reconunending tllat
Margaret Hutchison, Parkette, Police Department; and Lowell .J. T,::>tten, Docle Attendant,
Marina, be admitted to the Pension Plan. ConuniBs:toner Hatkins moved these employees
be approved as members of the Pension Plan. Motion Nas seconded by Conunissioner
Insco and carried unanimously.

\iHEREAS: it has been determined by the City Commission of the City o~ Clearwater,
Florida, that the property described below should be cleaned of weeds, grass and/or
underbrush, and that after ten (10) days notice and failure of the owner thereof to do
so, the City should clean such property and charge the costs thereof against the
respective property.
NOW THEREFORE BE IT RESOLVED by the City Comnussion of the City of Clearwater,

TO WHOM IT MAY CONCERN: The follo~dng names form a committee to get action from
the city to control stray dogs. There should be a City Ordinance or law to fine anY'
dog owner Who leaves their dogs astray. There is such a law for litter bugs but none
to stop dog owners from coming on one's property and dirtying up.

No. 59-57
MIEREAR, after public hearing on the 19th day of AugustJ 1957, the City Conwission
o~ the City o~ Clea~V1ater, Florida, determined that certain work and improvements
hereinafter described should be done and made; andJ
MiEREASJ pursuant thereto said improvements have been made as follows:
Constructed drainage on Clearwater Beach in the area bounded on the
South by Acacia ~treetj bounded on the North by that portion of Bay
Esplanade that proceeds Northwesterly ~rom Carlouel Drive to Eldorado;
bounded on the ~vest by the Gulf o~ Nexico; bounded 011 the East by
Clearwater BaYJ Pinellas County, Florida.
Th.e properties facing and abutting these improvements are deemed to derive special
benefits therefrom.
WHEREASJ under the provisions of Section 123 and other pertinent provisions of
the City Charter, a~ter said improvements shall have been cOlupleted, the City
COmrrUssion shall assess the cost thereof against the properties facing and abutting
and receiving benef~ts ~rom said improvements so made; andJ
WHEREAR, certa~n parcels of real estate facing and abutting and in the vicinity
o~ said improvements have been benefitted thereby and the pro-rata cost thereof
shall be assessed against such property;
NOW" THEREFORE~ BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEA.RW~TER-, FLORIDl\.J IN SESSION DULY AND REGULARLY ASSEMBLEDJ AS FOLLOWS:
1. That the above descr:ibed improvements in the area of Clearwater Beach~
Clearwater Beach, C~earwater, Florida} be and the same are hereby accepted and approved
aB having been comp~eted.
2. That the following described properties facing and abutting and in the
vicin:ity of the aforesaid improvements are hereby deemed to have been benefitted by
said :improvements in the ~ollowing proportions o~ the cost thereof, and the same are
hereby assessed in accordance with the following schedule:
3. That if assessments herein made are not paid within thirty (30) days from
the date hereof, the City Treasurer is hereby directed to issue and sell certificates
of indebtedness under Section 124 o~ the City Charter, which certificates shall bear
interest at the rate of eight (8%) per annum against the foregoing properties for the
assessments hereinrnade immediately upon the expiration'o~ the foregoing thirty-day
period.

ati;orney, stated he represented sixteen owners o.f lots immediately adjacent �o the
�^oposed project and nresented a petition signed by 17� persons living �n adjacent
land vrithin an area of two blocks. He also presented a letter of objection from the
Broolchill Property Owners Association. Qbjections were made by P1�ssrs. F�'nerson Perry,

value of property, create a traffic nazard and dsaina�e problams. Commis3ioner 8mith
su�gested the possibility of attempting to settle the problem by the applicant meeting

Mr. Martin Kovachich, otivner of �;1 Rey Motel on Clearwater Beach, asked the
Gom�ission to consider planning for a second ca,usetivay to the I3each because of t12e
crot•Tded condi.tions on n�emorial Causeway. Commissioner Ir_sco commented the feasibility
repor� made several years a�o stiated a second causetivay was not feasiUle at that tiime
but because of the rapid �rot�ath oz the City he proposed that the Commission consider
the situation again at budgf:t f,ime.
i�ic. George Boschen, G75 Mandalay, asked that some work be done on the new groins
on Clear�vater Beach. The EYzgineer sta�ed he had made a budget request to cover
maintenance of the groins,
r7r. Floyd Hopper complained of ineq_uities in the occupational lic�nse ordinance
as it anplies to ojRmers of apartments clairnirk; it iavored the owners of large apartment
houses. Commissioner T•dati�ir_s sta�ecl a study was being made of the ordinanc� at this
time to correct any discre�ancies., Commissioner Vlatkins moved to accept this complaint
