The Mayor called the Ineeting to order. In observance of Elks National Youth Day,
the Nayor introduced the students from Clearvlater High School who were acting as City
officials f'or the day. The meeting was turned over to the student officials who
conducted a short meeting. At the close of the student meeting, the Commissioners
asswmed their chairs.

The Mayor aslced if there were any corrections to the minutes of the meetings of
April 20th.7 28th and May 1st. The Clerk reported the Engineer had asked that the
f'irst paragraph or the minutes of April 28th be corrected by add~ng the f'ollowing
sentence: "The City Engineer recorrunended installation be made by City forces. 11
Commissioner Insco moved that the minutes of April 6th.7 20th, 28th as corrected.7
and May 1st be approved in accordance with copies submitted to each Commissioner in
writing. Notion was seconded by Commissioner Fields and carried unanimously.

A Public Hearing was announced on construction of sanitary se~er in Devon Drive
to serve Lots 7-52, inclusive.7 Bayside Replat. Tl~e Engineer estimated the total
project at $8,390.00 or $3.03 per assessable foot. The Engineer recommended averaging
the number of' feet in the front and rear lot lines on the irregula~ shaped lots and
basing the assessment on that average. The f'.1ayor aslced if there lfTere any objections
and there were none. Having held this Public Hearing, Commissioner vlatkins moved
that since no valid objections have been filed that the construction of an eight
inch sanitary sewer, manholes and appurtenances in Devon Drive from the existing
manhole at Harnden Drive easterly to the terminus of Devon Drive, the lots deemed to
be benefited by said improvements are Lots 7-52, inclusive, Baysidc Replat, be
approved and that the City Manager and City Engineer be directed to forthwith
proceed with such improvement and that it be assessed on a basis as recommended by
the City Engineer. Motion \'la s seconded by ComIni ssioner Fields and. carried
unanimously.
The Manager reported that the revolvinG futld used to finance construction of
various improvements has been depleted by being used for the many assessment projects
now in process. He suggested if the people involved in the assessment progranl for
the Devon Drive sani tal'Y sewer '.'lould be \'filling to put up the est:Lmated assessment in
advance the City could proceed immediatel;/,; other'\'lise, it may be several months
before enough money is returned to the revolving fund to finance net'1 projects.
Commissioner Hatldns moved that the City Engineer be instructed to work out the
estimated assessme~t for each lot and to notify each 011ner o~ said lot by letter of'
the suggested procedure. r,10tion ',laS seconded by Conuni ssioner Fields and carried
unanimously.
Commissioner Insco moved to instruct the City Manager and the City Engineer to
notify any group that has come in for a project of this type that they \'lould have
the same opportunity to do t'lhat the group on Devon Drive is doing; other\'lise they
would have to \'Tait their turn until the revolving rund increases, Motion was
seconded by COlrunissioner Smith and carried unan:I.mously.
The Manager reported bids had been received for traffic control equipment for
trai'fic light installations at Lakevie\'1 and I\lissouri, La!ce and Gulf to Bay, and
Douglas and Sunset Point and that the County had agreed to pay one-half of' the total
cost of' installations at Lal{eview and r.1issouri, and Douglas and Sunset Point. He
recommended accepting Items 1,2,7,8 and 9 of tIle bid in the amount of' $1,673.25 from
Automatic Signal Company, Norwalk, Connecticut, and Items 3,4,5 and 6, in the amount
of $1,045.00 from Hestin~house Electric, Tampa. Corrunissioner ~'lat1{ins moved that the
contract f'or the traff'ic control equipment Items 1.72,7,8 and 9, be al'larded to the
Automatic Signal Company in the amount of ~1,673.25 which is the oest responsible bid.7

be authorized to execute both contracts. Motion was seconded by Comrrdssioner Fields
and carried unanimously.
It was reported by the Manager that only one bid \~as received for radio equip-
Inent to set up a separate radio station for the Fire De~artment3 that bid being
f'rom General Electric Company, Tampa, in the amount of :jil,779.00 for one base
station, two transmitter-receiver sets.7 and one mobile transmitter-receiver set for
the Police Department. He explained that no bids were received on Item 4.7 three
motorcycle transmitter-receiver sets. He recoITmlended accepting the General Electric
Company bid. Commissioner Insco moved that this item be set over to the next
meeting 60 that the Fire Chief' could be present. Motion was seconded by Comrrdssioner
Fields and carried unanimously.

for drainage work and that he reconunended accepting the bid of' $5~'0 .00 from the
American Merpitt Company, St. petersburg, because of' iwnediatc delivery. Commissioner
Fields moved on the reconmendation of the City Engineer, Public Works Superintendent
and Ass1 stant Purchasing Agent tha t the bid of' Amel'l can Merritt Company, St. Petersburg,
in the amount of *>540.00 (less 2% 10 dayo) for 200 feet 1[3" pipe, 100 feet 12" pipe,
100 feet of lOll pipe be accepted und the }ll"Opcr authorities be authorized to execute
it, this being the 10\'/est and best rcspol1uibJ.e bid. Motion \'/aS seconded by

A Resolution was read from the Seventh District of the American Legion
thanking the I:4ayor and Commissioners for cooperation shown during its recent
conference in Clearwater on April 25th and 26th. Commissioner Insco moved the
Resolution be received and made a part of the record. Motion was seconded by
Commissioner VJatldns and carried unanimously.
It \'la s recommended by the Nanager that the application of Mr. Gerald A.
Lindenrneyer to operate a store at 11~21 South Missouri Avenue selling second hand
household fur11ishings be granted as the Chief of Police after investigation reported
no reason why a license should not be issued. Commissioner Fields moved upon the
recommendation of the Chicf' of Police that the license of' Gerald A. Lindenmeyer be
approved and the proper authorities authorized to issue the license. Motion was
seconded by Commissioner Insco and carried unanimously.
1\n application from Mr. George I'-l. Vollcer \'las presented to sell used merchandise
at 42 North Garden Avenue. Tile Manager reported the Chief of Police after investiga-
tion reconunended that the application be approved. Conunissioner Fields moved upon
reconm~ndation of the Chief' of Police and the City Treasurer that the second hand
merchandise license for George H. Volker be approved and the proper officials
authorized to issue the license. f'.1otion VIas seconded by COllunissioner Watkins and
carried unanimously.
The Engineer reported in November:1 1950", the City of' Dunedin had requested
Clearv/a ter to share t11. the pro ject of' paving Union Street from B1"'oadway to Douglas.
He explained he had held a preliminary hoc:tring on ~1arch L~ J 1959, that the City of
Dunedin was notified but no one from Dunedin \'las present at the hearing. He
stated another prelillLi..nary hearing had been held on April 30th but still no one
f'1"'om Dunedin i\TaS present. He said the affected Cleari'later property owners presented
a petition saying they did not want the improvement. COJ1U1ussioner Hatkins moved the
matter be tab~ed. Motion was seconded by Commissioner Fields and carried unanimously.
It i'laS reported by the En8ineer that the City docl-c in front of the Municipal
Auditorium needed extensive repair and that ~w. Roger Bouchard as agent for the
City's liability policy had recon~ended that repairs be made. The Engineer
estimated the cost of the repair at $5:1500.00 i1ith some of the work to be done by
City forces. Conmlissioner Hatlcins moved 'chat the matter be tabled until the meeting
of ~.1ay 18th at which time the Engineer can come bacle with a little more detailed
report as to what it mdght cost to renovate or build a new dock. Motion was seconded
by Commissioner Fields Clnd carried unanimously.
Resolution 59-51 was presented \'>1hic11 i'/ould require ten property ol'mers to clean
their lots of weeds and undergrowth. Conunissioner Vlatkins moved Resolution 59-51 be
passed and adopted and the proper officials be authorized to execute it. Motion was
seconded by Commdssioner Fields and carried unanimously.
The Attopney presented an agreement with the Seaboard Air Line Railroad which
vTould permit the City to lay gas lines under the tracks at Hercules, Coachman Road
and near State Road 590 in Savety Ha1"'bor adjacent to the City's storage tanks.
CorMussioner Watkins moved the agreement \~ith the Seaboard Air Line Railroad for the
gas line cross.1ngs be approved and the proper off'icials be authorized to execute them.
Motion l,'/US seconded by Commissioner Fields and carried unanimously.
Resolution 59-50 was read which would request the County Commission to approve
a site on Nursery Road i'fest of U.S. Highvlay 19 as a location f'or installation of a
gate station b~ Houston Texas Gas and Oil Corporation to serve the City of' Clearwater
with natural gas. CommiSSioner Watkins moved Resolution 59-50 be approved and the
proper officia~s be authorized to execute it. Motion was seconded by Commissioner
Fields and car~ied unanimously.
The Manager reported in regard to Glem'lood Park that the Parks Department and
the Public Works Department are cleaning the area. He said the City Attorney is
checking on the legal means for disposing o~ the abandoned house on Lot 77, Glenwood
Subdivision. The Attorney stated the property 1s involved in litigation and that
nothing can be done until it is determined who claims title arter the suit is settled.

regarding abandoned iceboKes and requested the Manager instruct the Police Chief
to make an immediate ourvey of thia situation and see that it is correoted as soon

Conun1aaioner Smith Buggested that the City Manager and the pol1.ce Department
\'1ork out extra protection on the beach due to the inoreased crowds of people and
also suggested that the Manager endeavor to find a site for the model plane group,
The Commiasion, nOVi adjourned as the Oi ty Commi ssion and acting a B Trustees of
the Pension Fund, heard letters read from the Advisory Conmrlttee recommending that
Joseph E, Mulholland, Engineer~ng Aid, Engineering Department, and ~rtha E. McClung~
Parl(ette, Police Department, be admitted to the Pension Plan. Comm1ssionerWatkins
moved these employees be approved as members of the Pension Plan. Motion was seconded
by Commissioner Insco and carried unanimously,

RESOLUTION
No. 59-50
WHEREAS, the City of Clearwater desires and intends to operate, install and
maintain a natural gas facility for the benefit of its citizens and customers residing
in Pinellas County, Florida, within the allocated area heretofore approved by the
Federal Power Comndssion, and pursuant to all agreements relating thereto between the
City of Clearwater and Houston Texas Gas & Oil Corporation; and,
WHEREAS, the City of Clearwater and the Houston Texas Gas & Oil Corporation desire
and intend to install a meter station on certain property located outside of the
corporate limits of said City and within Pinellas County, Florida" approximately
Eleven Hundred (1100) feet West of U.S. IKghway 19 and fronting upon Nursery Road; and~
WHEREAS, a hearing relating to the use of said property as a meter station site
was held May 4, 1959 before Honorable William MacKenzie, Examiner~ for the Pinel1as
County Cornrrdssion~ sitting as a zoning authority relative to said use; and,
HHEREAS" C. Robert Stuler, Director of zoning for Pinellas County, Florida,
recommended the use of said site by Houston and/or City for said purposes, and the sa1d
Examiner made certain tentative findings of fact consistent with said zoning directorl,s
recommendation, as well as the applicant's testimony; and,
WHEREAS, the said Examiner further found that the County Conunission :1.s \'1ithout
jurisdiction to impose zoning regulations against a public utility in accordance with
a written opinion of said Examiner, which ,,'Ias made a part of his f'indings, subject only
to building regulations imposed by said County for the health and welfare of its
ci ti zens;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~TI~SSION OF THE CITY OF CLEARWATER,
FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS:
1. The City of Clearwater does hereby request the Board of County Commissioners,
sitting as a zoning authorj.ty, to confirm the findings of its said Examiner, \1illiam
MacKenzie.
2. The said City of Clearwater does hereby agree to abide by all valid and
reasonable building requirements presently in force and imposed by the County Commission
of Pinellas County, Florida.
3. That the City Manager is instructed to deliver a certified copy o~ this
Resolution to the Board of County Commissioners of Pinellas County, Florida~ for
consideration at their meeting to be held on May 5, 1959.

WHEREAS: it has been determined by the City Commission of the City of Clearwater,
Florida, that the property described below should be cleaned of weeds, grass and/or
underbrush, and that after ten (10) days notice and failure of the owner thereof to do
so, the City should clean such property and charge t11e costs thereof against the
respective property.
NOW THEREFORE BE IT RESOLVED by the City Commission of the City of Clearwater,
Florida~ that the following described property, situate in said City, shall be cleaned
of weeds, grass and/or underbrush within ten (10) days after notice in writing to the
owners thereof to do so and that upon railure to comply with said notice, the City shall
perform such cleaning and charge the costs thereof against the respective properties
in accordance with Section 128 of the Charter of the City of ClearwaterJ as amended.

The Mayor called the meetin� to order, In obaerva�ce of �lks National Youth Day,
the 1�Iayor introduced the students from Clearwater High School who were acting as City
offic3al.s f'or the day. The meeting trTas turned over to the student officlals who
conducted a short me�ting, At the close o�' tY�e student meeting, the Commissioner,s
assumed `�heir chairs.
The Mayor asked if there were any corrections to the minutes`of the meetings of
April 20th, 28th and May 1st. The Clerk reported the Engineer ha,d asked that the
, f:irst paragraph of the minute9 of Agril 2$th he correctad by adding the follovring
sentence: "The City F'ngineer recommended installation be made by City forces."
Commissioner Zn�co moved that the minutes of Apri1 6th, 20th, 28th as correc�.Ad,
and May lst be approved in accordance i•rlth copiea submitted to each Commissioner in
wz'itiizg. Motion was seconded by Commissioner Fields and car-ried unanimously.
A Public Hearing was announced on construction oi sanitary sewer in DEvon Drive
to serve �'.,ots 7-52, inclusive, Bayside Replat. The En�ineer es�ima:�ed ;,he total
projec� at $8,390.00 or $3,03 per assessable foot. The Engineer r�commended averaging
t12e numlaer of fee'c in the front and rear lot lines on the irregular shaped lots and
basi�g the a�sessment on that average, mhe Mayor asked i£ there were any objections
and there were none, Havi_ng held this Publie Hearing, Comnu.ssioner Watkins moved
tnat since no valid objeetions have been filed that the construct�on of an eight
inch sanitary sewer, manholes and ap�ur�Eenances in Devon Drive from ihe ex.is�ing
manhole at Hamden Drive easterly to the tsrminus of Devon Drive, the lot� deerned to
be benefi�ed by said improvements are rots 7_52� inclusive, Bayside Replat, be
approved and that the City Manager and Cicy Engineer be directed to forthtivith
proceed tvith such improvement and that it be assessed on a basis as recommended by
the City Engineer, i�Iotion was seconded by Commissioner Fields and carried
_ unanimously.
The Manager reported that the revolving fund used to finance construction of
varioUs improvements has been depleted b,y being used for th9 many assessment projects
now in proceas, He suggested if the people involved in the assessment program for
the Davon Drive sanitary sewer would be willing to put up the estimated assessment in
advance �he City could proceed immediately; othexwise, it may be several manths '
�e�'ore enough money is returned to the revolvino fund to finance new projects,
Conun3.ssioner Watkins moved tnat the City Engineer be instruc�ted to work out the
estimated assessment for each 1ot and to notify each owne� of said Iot by letter of
, the suggested procedure. Motion was seconded �y Gommissioner rields and carried
unanimou�ly.
Comrni.ssianer iizseo moved to instruct the City t+Iana��r and �he City .Fngineer zo
notifjr aizy group that h�,s come in for a project of this type �hat the3r would have
th� same opportunity to do what the group on 1ie~�on Drive is doing, otherwise thesT
�vould have to wait �heir turn until the revolving fund increases. Motion was
seconded by Commissioner Smi�h and carried unanimously,
_ Th� Manager reported bids had been received for traffic control equipment for
tra�'fic light installations at Lakeview and Missouri, Lake and Gulf to Bay, and
Douglas and Sunset Point and tha4 the County had agreed to'pay one-half of the tofial
cost p�' insta11at3ons at Lakeview and Missouri, and Douglas and Sun�et Point. He
recommen.ded acceptin� Itsms 1,2,7,$ and 9 of the bid in �he amount of �"1,67'3.25 from
Auiomatic Sign�,1 Company, Norwalk, Connecticut, and Items 3,�,5 and ri, in thE amount
of �1,0�5.00 fram Westinghouse Elec�ric, Tampa. Commissioner Watkins moved that the
AutomaticfSignaY Company 3nnthelamountmofy�lt673.252whiahais 9' be ativar�ed to the
the best responsible bid,
and tnat Items 3,1E,5 and 6 be awarde� ta the Westinghouse Electric Company in the
amount of $1,045.00, that being the bes� responsible bid, an�. the proper offic�als
be authorized to execute both contracts, Notion was seconded by Commissioner Fields
and carried unanimously.
Zt was reported by the Manager tha� only one bid was received for radio equip-
ment to set up a separa�e radio station for the Fire De ar�ment, i�hat bid being
- �rom General Electric Company, Tampa, in the amount of �1,77g,00 for one base
station, two transmitter-receiver sets, �nc( one mobile transmitter-receiver set for •
the Police Department. He explaine� that no bids were received on Item 4, three
motorcycle transm3tter-receiver sets. He recommended accepting the General Elec�rie
Company bid. Commi:Ssioner Insco moved that this item be set over to the next
me�tin� so that the F'ire Chief could be present, Motion was seconded,by Commissioner

a pe�ition saying they did not want the improvenient. Commissioner Watkins moved the
