The City Commission or the City or Clearwater met in regular session at the City
Halll Monday, December 8, 1958, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. The Clerk administered the oath of office
to Mr. James Stewart, City Manager. The Mayor explained that Commissioner Insco was
in Washington, D.C., on City business. Commissioner Watkins moved Co~ssioner Insco
be excused from this meeting. Motion was seconded by Commissioner Fields and carried
unanimously.
Commissioner Fields moved that the minutes of the special meeting of November 24th
be approved in accordance with copies subndtted to each Commissioner in writing.
Motion was seconded by Commissioner Strang and carried unanimously.
The Mayor suggested that Patrolman Dean Sigler who was recognized as the man of
the year by the Chamber of: Corrunerce and given the title, "Mr. Clearwater", be given a
citation from the City in sincere appreciation for his public service as a police
of:ficer. Commissioner Watkins moved that the citation be awarded. Motlon was seconded
by Commissioner Fields and carried unanimously.
The Manager recommended that the low bid of $5,444.04 from U.S. Pipe and Foundry
Company, Birmingham, Alabama, be accepted for 2,800 feet of: six inch cast iron pipe
and fittings for the Utilities Department. Commissioner Strang moved on the recom-
mendation of the proper officials that U.S. Pipe & Foundry Com~any be awarded the bid
for six inch cast iron pipe and fittings in the amount of $5~444.04, this being the
lowest and best bid, and the proper officials be authorized to execute the contract.
Motion was seconded by Corrmdssioner Fields and carried unanimoUSly.
It was recommended by the Manager that the low bids of $11614.23 for Item 1
(one ~ ton truck for the Public Works De~artment), $2,904.04 for Item 2 (two l~ ton
t~uck for the Public Works Department), ~9.690.34 for Item 3 (seven fordor sedans for
Police Department) be awarded to Larry Dimmitt, Inc., Clearwater; and that the next
16west bid of $2,386.38 for Item 4 (one station wagon for Fire Department) be awarded
to Kennedy & Strickland, Clearwater, since the tailgate of the Ford perm1ts greater
ease in loading in emergencies. Commissioner \'latkins moved upon the recommendation
of the proper authorities that the bid of Larry Dimmitt in the amount of $14,208.61
for Items 1, 2 and 3 be awarded and that the next lowest bid submitted by Kennedy &
Strickland ~or Item 4, in the amount o~ $2,386.38 be accepted and that the proper
transfers of funds within the departments be authorized and that the proper officials
be authorized to execute the contracts. Motion was seconded by Commissioner Fields
and carried unanimously.
The City Engineer presented a survey of a proposed parking area at the west end
of Seminole Street by the launching ramp and doclc with an estimated cost o~ $2,400.00
for preparing the lot. Commissioner Watkins moved the City Engineer be authorized
to build a parking area at a cost of up to $2,400.00. Motion was seconded by
Commissioner Fields and carried unanimously.
The Engineer presented a plat of Fleetwood Subdivision for approval and stated
that he approved the plat although the streets have only a forty-four root right of
way. Commissioner Fields moved to approve the proposed plat of Fleetwood Subdivision
and accept the dedications shown thereon and to authorize the proper off~cials to sign
the plat. Motion was seconded by Commissioner Watlcins and carried unanimously.
The plat of Forrest Hill Estates Unit 2 \'laS presented ~or approval. The Engineer
reported that the developer, Mr. W. S. Wightman of the Standard Development Company,
had signed the contract in accordance lath Ordinances 632 and 750 and had posted bond
~or improvements. The Attorney called attention to the Zoning and Planning Board'S
recommendation that a 100 ~oot right of way should be dedicated for Highland Avenue
to conform to the MR-l plan for highways and streets. Mr. Wightman pointed out that
the County was only requiring 80 foot right of \~y in that area but said he would
agree to a setback restriction of ~ifteen feet from Highland Avenue. Conunissioner
Fields moved that the contract and bond from Standard Development Company covering
Forrest Hill Estates Unit 2 be accepted and that the plat o~ Forrest Hill Estates
Unit 2 be approved prOVided that there be placed thereon a setback or fifteen feet
from Highland Avenue and the proper officials be authorized to execute the plat
amended as provided herein. Motion was seconded by Commissioner Strang and carried
unanimoUSly.

Conmlios10ner Strang moved that the Manager be instructod to get together with Mr.
Leighton Hester, County Engineer, and the City Planner, Mr. 1I/o1le, to disouss this
MR-l plan for highways and streets, Motion wao seconded by Cornmdssioner Watkins and
oarried unanimously,
Mr. W. S. Wightman speaking for Clearwater Bay Mar1neways stated that the company
has an application to fill submerged land in Section 9-29-15 whioh will be ver,y near
to the Oi ty' 0 propol3ed bulldlead line and a eked that the Oi ty oubm:1. t a letter to the
County Wator und Navigation Authority that the C:Lty ha.B no objection to the buJ.lchead
line aB shown on the application with the county. Conun1osioner Watkins moved that
tho City Manager be instructed to write a letter to the Pino1las County Water and
Navigation ^uthority advioing them tl1,at this application does 1'all within the City' a
established bulkhead line and the City has no objoction. Motion was seconded by
Comndoo1oner Fields and carried unanimously.
The Engineer unnounced that the Sta te Road Board \1ould rece1 ve bids for paving
Myrtle Avenue on January 29, 1959.
Mr. James Novotny stated he had requeoted permission to pave a parking area ~n
front of a proposed motel on Lot 105, Lloyd-~1ite-Skinner, and in granting the
permission for the parking the city Engineer had required that a catchbasin at an
approximate cost of $300.00 be installed at the corner of Coronado and Third Street.
Mr. Novotny stated he did not believe the catchbasin was necessary, and if it was
reQuired, that a pro rata share should be assessed to other property owners, He
explained he had sold the property and aslced return o~ the $300.00 bond posted to
cover cost of catchbasin. Conunissioner \{atkins moved the matter be postponed unt:1l
the Mayor and Commissioner Insco have an opportunity to investigate this and that it
be put on the agenda for the next meeting. Motion was seconded by Commissioner Fields
and carried unanimously,
The Manager presented a copy of Supplemental Agreement #5 with the Ch1lton
Construction Company, Dunedin, in connection with the ~arina Station Sewage Plant
to cover addi tional piping at a cost of $992 .l~5, Conuni ssioner Strang moved that
Supplemental Agreement #5 on the Marina Station Sewage Plant be approved and the
proper officials be authorized to execute it, Motion was seconded by Commissioner
Watldns and carried unanimously.
Supplemental Agreement #7 with the Henry G. Dupree Company in connection with the
Marshall Street Selrage Plant contract was presented to cover the cost o~ soundprooring
at a cost of $770.20. Comnd.ssloner \'1atkins moved Supplemental Agreement #7 be
approved and the proper officials be authorized to execute it. Motion was seconded by
Commissioner Fields and carried unanimously.
The Manager presented Resolution 58-96 which would require twelve property owners
to clean their lots of weeds and underbrush. Commdssioner Strang moved that Resolution
58-96 be passed and adopted and the proper officials be authorized to execute it.
Motion was seconded by Commissioner Fields and carried unanimously.
It was requested by the Manager that he be reimbursed ror the amount of his
expense in moving to Clearwater in the amount of $179.50. Cornmdssioner Strang moved
the amount o~ $179.50 be approved ~or the cost of the City Manager moving to Clear\~ter.
Motion was seconded by Commissioner Fields and carried unanimously.
The Manager suggested that Mr. Gerald Weimer be g~ven additional compensation
~or the period that he served as Acting City ~~nager. The Mayor recommended that Mr.
Weimer be given additional payor *200.00 per month for the five months he served as
Acting Manager to be char~ed to the City Manager's budget. Commissioner Watkins moved
that Mr. Weimer be given $1,000.00 additional compensation. Motion was seconded by
Commissioner Fields and carried unanimously.
It was suggested by the Manager that the next regular meeting be held on
December 22nd instead of December 15th. Corunissioner Watkins moved that the next
regular meeting for the transaction of business be scheduled for December 22nd. Motion
was seconded by Commissioner Fields and carried unanimously.
Resolution 58-97 was presented which would assess the cost of paving, curb and
sanitary sewers in Chestnut Street from East Avenue to Court Street against the
benefited properties. Commissioner Strang moved Resolution 58-97 be passed and adopted
and the proper officials be authorized to execute it. Motion was seconded by
Commdssioner Fields and carried unanimously.
The Attorney presented ~or its first reading Ordinance 802 which would annex
into the City certain acreage in Section 17-29-16 which will be known as GuJ.f to Bay
Gardens Subdivision, Comrrdssioner Strang moved Ordinance 802 be passed on ~ts first
reading. Motion was seconded by Commissioner Fields and carried unanimously.

title only with the unanimous consent of the Commissioners present. Motion was
seconded by Commissioner Fields and carried unanimously. The Attorney read the

The Attorney explained that Edgar Miller in his request to have his acreage in
Section 27-29-15 annexed to the City had also asked permission to operate a trailer
park on the land. The Attorney reported the Engineer had approved the sewer hookup
and other matters relating to use as a trailer park. Commissioner Strang moved that
the request or Edgar ~ller that the property described as the west 1/3 of the east
3/5 o~ the NE~ oC the NWt of the NWt of Section 27-29-15 be allowed for use as an
automobile trailer park and that a special permit as required by Section VI,
Subsection 91 of the City Zoning Ordinancel be granted for the same, the City Comndssion
having conSidered ravorable recommendations of the City Zoning and Planning Board and
the City Engineer and the County Health Department. Motion was seconded by Commissioner
Fields and carried unanimously,
Resolution 58-98 was presented which would assess the cost of paving and drainage
in Eldridge Street rrom Missouri Avenue to Greenwood Avenue and paving or the alleys
in Greenfield Subdivision against the benerited properties. Commissioner Strang moved
Resolution 58-98 be passed and adopted and the proper orficials be authorized to
execute it. Motion was seconded by CommiSSioner Watkins and carried unanimously.
The Attorney read on its first reading Ordinance 804 which would prohibit the
giving of raIse information as to bombs and other hazards. Commissioner Strang moved
Ordinance 804 be passed on its first reading. Motion was seconded by Commissioner
Fields and carried unanimously.

the Marina Station Sewer Plants. Commissioner Strang moved Resolution 58-99 be
passed and adopted and the proper ofricials be authorized to execute it. Motion was
seconded by Commissioner Fields and carried unanimously.
A letter was read ~rom Mr. Herbert M. Brown, attorney for Ruth Tucker, offering
to exchange Lot 201 Block C, Fairmont Subdivision for two City-owned lotsl Lots 8 and
9, Block II Fa~rmont Subdivision. Commissioner Watkins moved the proposal as set out
in the letter of Herbert M. Brown as attorney for Ruth Tucker, the letter being dated
December 4, 1958, be accepted and the proper officials be authorized to proceed with
the exchange of lots under the conditions set out therein. Motion was seconded by
Commissioner Fields and carried unanimously.
The Attorney explained that the firm of Richards and Nodine had been appointed
on March 6, 19561 to represent the City in the case of Weidemeyer vs. the City and
others. He stated Mr. Richards had been paid $500.00 in December, 19561 that the suit
~s still in progress and Mr. Richards has submitted a bill ror $500.00. Commdasioner
Watkins moved the bl~l be paid and that the funds be allocated from unappropriated
funds. Motion was seconded by Commissioner Fields and carried unanimously.

WHEREAS: it has been determined by the City Commdss1on of the City o~ Clearwate~,
Florida, that the property described below should be cleaned of weeds, grass and/or
underbrush, and that arter ten (10) days notice and failure of the owner thereor to do
so, the City should clean such property and charge the costs thereof against the
respective property.
NOW THEREFORE BE IT RESOLVED by the City Comrrdssion of the City of Clearwater,
Florida, that the following described property, situate in said City, shall be
cleaned of weeds, grass and/or underbrush within ten (10) days after notice in writ:1ng
to the owners thereof to do so and that upon failure to comply with said notice, the
City shall perform such clean~ng and charge the costs thereof against the respective
properties in accordance with Section 128 of the Charter of the City of Clearwater,
as amended.

RESOLUTION

WHEREAS, after publ~c hearing on the 20th day of September, 1957, the City
Corrun~ssion of' the City ot: Clearwater Florida, determined that certain worle and improve-
ments hereinafter described should be done and made; and,
\1HEREAS, pursuant thereto said improvements have been made as f'olloWB:
Construct a pavement, curb, necessary drainage structures, necessary
sanitary sewers and appurtenances ~n Chestnut Street, from the East
line of East Avenue, easterly to the intersection of the West paving line
of Court Street, Clearwater, Florida.
The properties facing and abutting these improvements are deemed to derive special
benefits therefrom.
WHElillAS, under the provisions of' Section 123 and other pertinent provisions of
the City Charter, after said improvements shall have been completed, the City
Comnission shall assess the cost thereof against the properties facing and abutting and
receiving benef'its from said ~mprovements so made; and"
WHEREAS, certain parcels of real estate facing and abutting and in the vicinity
of said improvements have been benefitted thereby and the pro-rata cost thereof shall
be assessed against such propertyj
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF TKE CITY OF CLEARWATERJ
FLORIDA, IW SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS:
1. That the above described improvements in the area of Chestnut Street,
Clearwater, Florida, be and the same are hereby accepted and approved as having been
completed.
2. That the foJ.lowing described properties facing; and abutting arid in the
vicinity of the aroresaid improvements are hereby deemed to have been benefitted by
sa~d improvements in the follo\rlng proportions of the cost thereof, and the same are
hereby assessed in accordance with the following schedule:

of the City of Clearwater, FloridaJ determined that certa~n work and improvements
hereinarter descr~bed should be done and madej and,
vmEREAS, pursuant thereto said improvements have been made as follows:
Construct paving and necessary drainage in Eldridge Street f'rom
Missouri Avenue to Greenwood Avenue and paving of the alleys in
Greenfield Subdivision, Clearwater, Pinellas County, Florida.
The properties facing and abutting these improvements are deemed to derive special
benef'its therefrom.

WHEREAS, Briley, Wild and Associates have heretofore been retained by the City of
Clearwater to perform services as covered by the statement therefor hereinafter
described; and,
WHEREAS, said services, as so described, have been performed and there is due
and payable said Engineers from the City of Clearwater the sum of $2,497.59, according
to the statement of said Engineers dated Nov. 24, 1958, a copy of which is hereto
attached and by reference made a part hereof;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER"
FLORIDA, in session duly and regularly assembled, as follows:
1. That the sum of $2,497.59 be paid from the Construction Trust Fund by the
First National Bank of Clearwater, Florida, Trustee thereof of Construction Trust
Fund Agreement dated June 10, 1957, which Construction Trust Fund is derived from
proceeds of the sale of Utility Revenue Certificates Series of 1956.
2. That a certified copy of this Resolution be delivered forthwith to sa~d
Trustee, which said certified copy shall constitute the direction of the City of
Clearwater to said Trustee to pay the foregoing sum directly to the said Engineers
forthwith in compliance with Section 3 (b) and other provisions of said Construction
Trust Fund Agreement.

TYie Mayor called the n.ie�ting �o order. The Clerk adm.inistered the oath of ofFice
to Mr. James Stewart, City Manager. The Mayor explained that Commissio*�.er Insco was
in Washington, D.C., on City business. ComrrLi.ssioner, Ulatkins moved Cammissioner Insco
be excused from this meeting, Motion was seconded by Comrnis„ioner Fields and carried
unanimously,
Commissioner Fields moved that the minutes of the special meeting of Djovember 24th
be approved in accordance with copies subrnitted to each ComrrLssioner in vtriting,
Motiorx was secon,ded by Comini;ssioner Strang and carried unanimouslf.
The Mayor suggested that Patrol.man Dean Sigler who Uras recognized as the man of
the year by the Chamber of Commerce an� given the title, "l�,r, Clearwater", be givEn a
ci�ation from �he City in sincere appreciation for his public service as a police
officer. Commissioner Watkins moved that the citation be awarded. IKotinn was seconded
by Commissioner Fields and carried unanimously.
The Manager recommended that the low �Gid of Sy"5,44�.04 i'rom U.S, Pipe and Foundry
Company, Birmingham, Alabama, be accepted for 2,800 feet of six inch cast iran pi��e
and fittings for the Utilit�es Department, Commissioner Strang moved on the recom-
mendation of the proper officials that U.S. Pipe & Foundry Company be awarded the bid
for six inch cast iron pipe and fittings in the amoun� oz �5,4��-.��F, this being i;he
lowest and best bid, and the proper officials be authorized to execute the c�ntract.
Motion was seconded by Comrnissioner Fields and carried unanimously.
It tva� recommencied by the Manager that the loj�r bids of �1,614.23 for Item 1
(on� 2 ton truck for the Public GTorks De�artment%,�2,9Q4.04 for Item 2(tv�ro 12 ton
t�7'uck tor the Public Works Department), �9e69o.34 for Item 3(seven fordor sedans Tor
�olice D�p2rtment) be awarded bo Larry Dimmi��, Inc., C,learwater; and that the next
18west bid of $2,38E.38 for Item 4(one station wagon for Fire Department) be awa,rded
to Kennedy 8c Strickland, Clearwater, since the tailgate of the Ford permits greazer
ease in loading in emergencies. Commissioner Watkins moved upon the �ecommenda�ion
of the proper authorities that the bid of Larry Dinunitt in the amount oi �14,208.61
�'or Items 1, 2 and 3, be awarded and tha�t the nexf lotaest bid submitted by Kennedy &
Stricltland i'or Item 4, in �he amount of $2,386.38 bs aecepted and that the proper
transfers of funds tvithir. the departments be authorized and that the proper of'ficials
be authorized to execute the contraets, Motion was seconded by Commissioner Fields
and carried unanimously.
The City- Engineer presented a survey oi' a proposed parking area at the west end
of Seminole Street by the launching ramp and dock with an estimated cost of �2,400.00
for preparing the lot. CommissionPr Watkins moved the Cit� Engineer be authorized
to build a parkin� area at a cos� of up to $2,400.00. D4otian tivas seconded by
ComnLi.ssioner Fielda and carried unanimously,

Mr. James Novotny stated he had requested permission to pave a parking area 3n
front of a proposed motel on Lot 105, L?oyd-ti�ihite-Skinner, and in granting the
permission for the parking the City Engineer had required th�t a catchbasin at an
apuroxima�e cost of $300.00 be installed at the corner of �oronado and Third Stree:.
Mr. Novotny stated he did not believe the catchUasin was necessary, and if it was
required, that a pro rata share should be assessed to other property owners. He
explained he had sold the property and asked return of the �300,00 bond posted to
cover cost oi` catchbasin. Conun3.ssioner LJatlt3.ns moved the matter be postpaned until
the Mayor and Commis�ioner Tnsco have an opportunity to investi�ate tk�is and that it

The Manager piesented a copy of Sunplemental Agreement �5 with the Chil�on
Construction Company, Duri�din, 3n connection 1^rith the Marina Stat3on Sewage Plant

Supnlemental Agreement ��5 on the Marina Station S'ewage P1ant be approved and the

$500,00 be approprlated to the Safety Council from unappropriated surplus. Motion Was
seconded by Commissioner Strang and carried unanimously.
The Commission, now adjourned as the City Commission and acting as Trustees of
the Pension Fund, heard letters read recommending Janet V. Vollertson, Communications
Clerk, Utilities Department; and Julius G. Grant, laborer, Utilities Department, be
admitted to the Pension Plan. Commissioner Watkins moved these employees be admitted
