The city Comm~Gsion of the City of Clearwater met in regular session at the City
Hall, Monday, October 20, 1958, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. The invocation \~as given by the Reverend
J. S. Dauerty, acting assistant minister at Peace Memorial PreSbyterian Church.
Commissioner Fields moved that the minutes of September 29th and October 6th be
approved in accordance with copies submitted to each Commissioner in writing subject
to the approval of Con~issioner Insco. Motion was seconded by Commissioner Strang and
carried unanimously.

A Public Hearing was called on the conotruction o~ curbs, drainage and widening
in Mars Avenue from Drew to Gulf to Bay Boulevard and ~n Meteor Avenue from Cleveland
to Drew street and curbs and drainage in Cleveland Street from Saturn to Meteor.
The Engineer stated that this work was requested by petitions ~rom the property owners
except that on North Mars which was requested at the preliminary hearing. He
estimated the cost at $3.15 per front assessable foot and stated that the City would
bear its share in the cost of the resurfacing. The Mayor asked for a vote on the
enLire project. Fifteen property owners voted approval and twenty-two were opposed.
On Meteor Avenue, five approved and six were opposed; on North Mars three approved
and six were opposed; on South Mars seven approved and none were opposed. Commissioner
Insco moved that the hearing be continued until November 3rd l'lhile a questionnaire is
being sent by the Clerk to each property owner for him to express approval or dis-
approval of the project before the next meeting. Motion was seconded by Commissioner
Strang and carried unanimously.
The ~layor introduced rJlr. Al Rogero, State Road Board member, and asked him to
si t w~th the Corrmussion during the discussion of the one way street program. The
Mayor read the petition submitted by the Clearwater Business and Taxpayers Association
on October 6th which asked the Commission to abolish the existing one way street
system and restore the two way streets because the one way system was causing losses
to the owners of businesses and \1aS creating a traffic hazard because of excessive sped
of cars. Mr. S. Russell Bowen, speaking for the Association, stated he did not feel
that Clearwater \~ould be ready for a one way street system until Myrtle Avenue extension
was completed. police Chief \'J. Booth reported that the one way system showed an
overall increase in the volume of traffic carried, that traffic volume counts showed
the system relieved congestion and that it reduced most types of accidents in the
downtown area. He reported that the modification or the original system now in effect
(Garden Street north of Dre'li and North Fort Harrison north of Drew' returned to t\'lO
way streets) is confusing and that hazardous conditions are apparent at Garden and
Drew Street. He proposed a revision in the modified plan which would make Garden
Avenue one way north to Fort Harrison Avenue or a return to the original plan. ~w.
John Marceron presented a letter from the Safety Council I'ihich cri ti cized the modified
plan because it made a dangerous intersection of Drew and Garden and urged return to
the original plan for a trial period of one year. Among those opposed to the one way
streets were Joseph Schultz, Wm. Birchall, Leonard Merrell, Glen Yohe, Mrs. M. Gay.
Those who spoke j.n favor of the one way streets were George C. Harrison, Fred Walbolt,
Maurice Thayer and J. G. Robinson. Commissioner \vatk~ns moved to postpone the voting
on this petition until such time as a further study can be made both by the State
Road Department and by the Traffic Division and a report from our consulting engineer
be made available and at that time we can decide what is the nlost feasible thing to
do. Motion was seconded by Commissioner Insco and carried unanimOUSly. Mr. Al
Rogero urged the Commission to retain the one \'lay system for a trial period of one year
and stated that merchants in other cities did survive after a fair trial o~ one way
streets.
Mr. Herbert BrONn, appearing on behalf of P~. E. L. Burel, 507 Engman, presented
an application for his client to operate two taxicabs from a location on Clearwater
Beach. He explained the location on the street desired \~as the northwest corner of
Poinsettia Avenue and Causeway Boulevard. He explained that there 11ere no cabs based
on the Beach nm.; and his client thought there was a need for' such an operation. The
Police Chief approved th.e application. Representatives o~ the other cab companies
were present and protested the issuance of the license. Commissioner Fields moved
the permit be granted for two taxicabs and one street space. Motion was seconded by
Conunissioner Insco. Upon the vote being taken, Conmlissioners Fields, Insco, Strang
and Homer voted 11 Aye II , Commissioner Watkins voted lINo". Motion carried.

The Acting 0i ty Nanae;er recommended acc,epting the 10\1 bid of Ray Birkbecl<,
Dunedin, for $3,730. ho to construe t storm se'\/er at the north end of Bay Esplanade and
Eldorado. Conmdssioncr Strung moved that the contract for storm sewers at the north
end of Bay Espli.lnade and Eldorado be a\'iUrded to Ray Birkbec1c~ Dure din, in the amount
of $3,730.40~ this being the lowest and best bid, and the proper officials be
authorized to execute it. Motion was seconded by Commissioner Watkins and carried
unanimously.
Conuni ssioner Insco moved to recess the meeting until 7: 30 P. M. Motion was
seconded by COnilllissioner Fields and carried unanimously. The meeting was recessed at
5 : 45 P. 1>1.
The ~1ayor re-convened the meeting at 7: 30 P. 1.1. with all Commissioners present.
The Acting City Manager reported that he had shown the property at the northeast
corner of Missouri and Seminole to f'-1rs. ~J. A. fv1cMullen, Jr., Chairman of District #4
and Mrs. Erwin from the State Welfare Board as a possible site for a district office.
He said they approved the site but it would have to be approved and confirmed by the
State i.'/elfare Board. Conunissioner \vatleins moved the Manager be instructed to write a
letter to the State Welfare Board stating that this property is available to them and
giving ninety days to ~ccept the offer and one year to construct the building, the
deed to contain u reversion clause that the property will revert to the City if the
vlelfare Board stops usinG; it for an office. fJ1otion ViaS seconded by Commissioner
Fields and carried unanimously.
A request was presented from Mr. Chester B. McMullen, Jr.~ on behalf of Frank
Batchelor, ovmer of a portion of Lot 12" unnumbered blocle, Palm Parle" to vacate Ficht
Street shovm as ~'Jashine;ton Street in the plat of Palm Parle Addition. Commissioner
Watkins moved that the City Attorney be instructed to prepare a Resolution vacating
Ficht Street. Motion was seconded by Conwissioner Fields and carried unanimously.
Mr. Herbert IvI. BrO\'n1 represent:Lng 1~'I1"'. Leonard L. Bursten reported that his client
vIas interested in purchasing the Fleetvlood Apartments from the Federal Housing
Authority and would have a plat made of the area and dedicate the streets contained
therein. The Engineer recommended that the streets be resurfaced at an estimated cost
of $10,840.00 before beinc accepted by the City in order to meet City specifications.
rvIr. Brm-m thought the amount \'las too much for his client to assume and suggested that
the '.wr1c be done on an assessment basis later as his client planned to sell the
individual units of the apartlllent house project separately. Corcunissioner Strang moved
the matter be postponecl to the next regular meeting. l\lotion VIaS seconded by
Cownissioner Insco and carried unanimously.
The Engineer stated there is a drainage cond:t tion in the colf course \'lhich needs
correction and the Clearwater Countpy Club had offered to pa~/ for the pipe if the

The Engineer reported that the State Road Department llUd ~ndicated that they
would purchase drainage pipe of adequate size to run from Glenwood Park northwesterly
to the golf' course if the City vlould do the installation. He saj,d it was planned
to diS out a laJ<:e hl Glemlood Parle and also one in the middle uf 1i1ood Drive.
Comrnissioner Fields !!loved that the Engineer be authorized to neGotlate \'lith the State

The Eng~neer presented a revised plan for a metered pa~:in~ lot on Lot 1, City
Park Subdivision" vlith space reserved for a picnic area amonG the existing pine trees.
Conunissioner I'JatJ.cins moved to put this latest engineering plan out for bids. 1~lotion
\'las seconded by Commi ssioner Fields and carried unanimously.
Resolution s.'3-3Ll ",rus presented which \'lould require thirty-seven property owners
to clean their lots of I'lceds and underbrush. Corrunissioner str<:lng moved that
Resolution 58-84 be passed and adopted and the proper officials be authorized to
e.xecute it. Motion was seconded by Commissioner Insco and carried unanimously.
A request \'las read from the Shrine Club of Clearwater for permission to sponsor
the Clyde Beatty Circus in the parking area between Green Field and Jack Russell
Stadium on October 2Llth. The Acting; C1 t~l r,larw.ger stated the Police and Fire Department
had approved and a peri'ormance bond of :p500. 00 had been posted. Conunissioner Fields
moved that the performances be approved subject to the purchase of the necessary license.
Motion vIas seconded by Conunissioner Insco and carried unanimously.
A letter was read from Captain Richard W. Coryell, Company K, 211th Infantry,
Florida National Guard, stating that it was planned to fence the National Guard
Armpry property, that the State Government has appropriated $1~665.00 for the project
but $998.00 was still needed. Captain Coryell addressed the Commission asking that
the City and the County each appropriate $499.00 for the project. Commissioner Insco
moved that $499.00 be appropriated from unappropriated surplus. Motion was seconded
by Commissioner Fields and carried unanimously.

'1'he Acting C1 ty Hanager read a letter from Briley, "'ild and Associates,
Consulting Engineers, which enclosed progress curves showing the status of the
construction of the r''V-..lrina Station Plant on October 1, 1958. The letter stated the
\'lcather records SI'lOi"l fIfty \'lOrlcing dayn betl'lccn December 2, 1957, and September 3,
1958, as days of Inajor rainfall. The Actinc; City f'.'lanager as!ced if' the Commission
wished to consider granting the Chilton Construction an extension of time from
November 6th to Janu<.l.ry 8th, 1959, as a completion date. CO/lunisnioner Strang questioned
N'hether thu.t much time i'laG necessary and sur;gcuted keeping the letter on file and if
the Chilton Company runs over the contract tJ.mc use the letter to sho',., why no penalties
were claimed. By consent, the letter was received to be kept on record.
The Attorney cxplained in the case of George Bro\'ll1 VB. Fr<lll.l{ Abernathy, City

duct a je\"lelry il. uction on Clear't'later Beach. He said the effect of' the judge's ruling
is to hold that actually the type of business r,1r. BrOl'ln \'laS seeking to operate is not
a true auction and therefore it is not controlled by the jewelry auction ordinanc.e.
The business was described as an auction type sale or business '.'lhereby each person
bidding is given the option to return the item purchased within thirty days and receive
his money back. He did not reco~nend that an appeal be made but recommended that
Ordinance 791 which would regulate an auction type sale, provide f'or occupational
license, etc., be adopted. He proceeded to read Ordinance 791 on its f'irst reading.
Commissioner Strang moved that Ordinance 791 be passed on its Eirst reading. Motion
\'las seconded by C01lU11issioner Fields and carried unanimously.
COl1unissioner Strane; moved that Ordinancc 791 be considered on its second reading
by title only \'1i th the unanimous consent of' the Corrunission. lv1otion \vas seconded by
Corrunissioner Insco and carried unanimously. The Attorney read the ordinance by title

The Attorney presented for its second readine; Ordinance 786, the proposed roofing
code" and recomnlended that copies be distributed and that it be deferred to the next
meeting. Commissioner Hatkins moved the consideration of the ordinance be deferred.

The Attorney :reported that on December 10, 1956:J the City gave the Chamber of
Conm~rce a deed for the property occupied by their building w1th a reversion clause
thtl t the property l'lould revert to the City 11' j.t ceased to be used for Chamber of'
Corrunerce purposes. He explained the Chamber of Corrunerce has planned to remodel the
building and \'1ishe s to borroVl $ 30,000.00 on the property f'rom the First National Bank
and the bank is asking for a subordinantion agreem~nt VIi th the City so the clause of
reversion to the City vlould not apply during the term of the mortgage. Commissioner
v~tkins moved the approval of the subordination agreement between the City and the
First National Banl{ relating to the revcr'sionary provi sion on the Chamber of Conunerce
Building and autho:rize t11e proper officials to execute it. Motion was seconded by
Conunissioner Fields and carried unanimously.

City's intention to annex certain acreaGe in Section 23-29-15 and Lots 2l through
28, 69 through '(6, 117 through 120, Replat of' Ardmore Place. Conunissioner Fields

Conunissioner' 1I1SCO moved that Ordinance '''(92 be considered on its thir-d reading
with the unanimous consent of the Co~~io~ion. Motion was seconded by Commissioner
Fields and carried unanimously. The Attorney read the ordinance. Conunissioner Fields
moved that Ordinance '792 be passed on i to third and final reading and adopted and
that the proper officials be authorized to sien it. Motion was seconded by
Commissioner Watkins and carried unanimously.
Con~issioner strang commented that ~25,OOO.OO had been reserved in the budget
for the City Library and there were reconunenda ti on.s in the report from the State
Librarian that the City paint the library, install a new ceiling, heating, lighting,
and purchase tables, chairs L4nd other items. Commissioner Strang moved that the
Manager be authorized to put these items out for' bids and possibly get some or the
worl-c done before the "linter season. Motion I'las seconded by Commissioner \'latk:lns and
and carried unanimously. The Mayor commented this would be only the first step in
improvements to be made to the library as recomnended after a survey conducted by the
State Library Director.
Commissioner Strang suggested that the ~~nager be requested to secure an estimate
of' the cost of erecting a fire training tOi'ler for the Fire Department. He sa1.d tne
item had been deleted from the budget but it would improve the City'S ~ire rating i~ it
could be constructed. By consent, the Manager 1'186 asked to get the cost f'igures on
building a ~ire training tOi'ler vvl th a raclc f'or drying hose included.
Commissioner Insco inquired what happened to the report from the Planning Board
or Recreation Department on the survey that the Commission made alon~ with the other
groups on all Ci ty-ot'med property and parks. By consent, the Manager \'1as directed to
checlc on this.
The Mayor announced that the Florida Leae;ue of Municipalities \'las holding its
state convention in Clearwater October 23rd to 25th. Conmissioner Insco moved that
the Conmdssioners' expenses for registration, etc., should be paid out of funds
appropriated, for that purpose. Motion '\flas seconded by Commissioner Fields and carried

1. Increased activity at the National Guard Armory in Cleari-'later, Florida~
wherein other military elements and several civilian orGanizations have indicated their
desires to use the facilities, have made it necessary to install a security fence to
safeguard certain military equipment.
(B) An indoor small-bore ranGe is no 1'1 beinc; installed j.n the t>'lotor Storage Building
to provide ran[~e fac:!,li ties for the use of military and civilian personnel.
This range is being erected jo:intly between the Post, American Legion Junior
Rirle team and the Mandalay Rifle Club. Other rifle clubs in the area are
expected to use this range i\lhcn completed.
2. The State r,'lilitary Depal"'tment has already Bi'Tarded a contract to a Tampa
fence company to install fencing through the middle one-tl1il"'d of the parlc1ng lot. An
amount of $1665.00 has been appropriated as the maximum state money available" although
state military officials favor fencing 1n the entire parkine area.
3. An additional appropriation to finance the remainder of this project is
vitally needed ir the area is to be leept available for outdoor exhibits and shows, such
as might become avaj.lable through the Convention Bureau. Officials of the Convention
Bureau have indieated they oppose fencing in only the middle one-third of the parl<:ing
area.
4. In addition to the sum already appropriate<?- by the state, cost estimates
for completing the project indicate that the StUll of $540.00 \'1111 fence in two-thirds
of the area, \'lhile the sum of $998 will completely fence in the parlcing area, thus
providing the largest secure area and providing the most usable space for whatever
activity n~y arise.
5. In r1ay, 1956, the amount of $990.00 \'las returned to the City of Clearwater
, as money not used in the original construction of the $145,000 Armory. A similar
amount was returned to the County of Pinellas. Both the City of Clearwater and the
County of Pinellas had appropriated $20,,000 each for the construction. A fence was not
needed at that time.

in Mars Avenue f'rom Dretiv to Gult' to Baf Boulevard and in Meteor Avenue from GIEVEland
to Dreta Street and cunbs and drainaoe ir_ Cleveland Street from Saturn to Pleteor.
The En�Yneer stated that this woriz i�ras requested by petition.s from the nroperty o�tmers
except that �n North Mars which was req_ues�ed a:t the preliminary hearing. H�
estimated the cost at �3.15 per front assessable foot and stated that the City would
beGr its share in t1-ie cost of the resurfacin�. The Mayor asked for a vo�e on the
enii re pro jeet . Fifteen property ot�rners voted approval and tvaenty-two vrere opposed.
Jn Meteor Avenue, five approved a,nd six were opposed, an North Mars three anproved
and six were opposed; on South Mars seven approved and none were opposed. Gommissioner
Insco moved that the hearing be continued uniil November 3rd whils a questionnaire is

apgroval of the project befo.re the r_ext meeting, Motion was seconaed by Commiasioner
Strang and carried unanimously.
The Mayor introduced Mr, Al Rogero, S�ate Road Board member, and asked him �o
sit with �ne Commissior. du,rir� the discussion of �the one u�ay s�reet prooram. The
Mayor read the petition submitted by the C1earFaater Busir_ess and Taxpa�rers Associatzon
on Octuber 6th which as?ted the Commission to abolish the existing one way street
system and restore the �cvao way �treets because the one way system vras causing lossee
to the oYmers of businesses ancl Utas creaiin; a traffic hazard because oi excessive sped
oi cars. Mr. S. Russell BoU�en, speaking for the Association, stated he did not fsel
that Clearwat�r would be ready for a one �vay screet system until Myrtle Avenue extension
was ,;omp�.eted. Police Chief I�t. Booth reported that tihe one way system sho�ied an
overall increase in the volume of traff'ic carr3.ed, that traff�c volume counts shawed
the s�rstem relieved eon�estion and that it reduced most �ypes of accidents in the
downtotvn area, He repor�ed that the modification of the origiizal system now in ef=ect
(CTarden Street north of Drew and North Fort Harriaon north of Dretiv returned tc two
way s'treets) is confusin� and that hazardous conditions are abparent at Garden and
Dretv Street. He proposeci a revision in the modified glan tvhich vrould make Garden
Avenue one tzay north to Forb Harrison Avenue or a return to the original plan. i�lr.
John Marceron presented a letter from the Safety Council which ar3-�icized the modified
plan because it made a dangerous intersection of Drew and Garden and urged return to
the origizial plan fox a trial perzod :,f one s*ear. Among those opposed to the one tivay
streets were Joseph Schultz, Wm. Birchall, Leonard Merre7.l, Glen Yohe, Mrs. M. Gay.
Those who spoke in favor of the one way stre��s were George C. Harrison, Fred L+ialbolt,
Maurice Tnayer and J. G. Ro�,�nson. Commissioner 4�Jatkins movecl to postpone the votin;
on this petition until such time as a further study can be :nade l�ath by the State
Road D�partment and by the Traffic Div�sian and a report from our constzltinF; engineer
