The City COlTUulssion of the City of Clearvvater met in regular session at the Cl ty
Hall, Monday, September 15, 1958, at 1:30 P.M. with the following members present:

The Mayor called the meeting to order. rfhe invocation ~las given by the
Reverend E. C. Chastain of Skycrest Methodist Church, Clear1tlater. Comrnis6:1.oner v/atkins
moved that the minutes of the meetings of August 18th, 25th and September 8th and 9th,
1958, be approved in accordance with copies submitted to each Cornmdssioner in writing.
Motion was seconded by Con~issioner Strang and carried unanimously.
The Acting City Manager reported that only one bid had been received to construct
sanitary sewers in Eldorado Avenue to serve Lots 1 and 2, Blocl< 4, and Lots 1 and 2,
Block 11, Mandalay Subdivision. He recommended accepting the only bid received that of
Ray Birkbeck, Dunedin, for $993.80. COlnmissioner Watkins moved on the recommendation
of the City Engineer, Finance Director and Assistant purchasing Agent that the bid of
Ray Birkbeck for $993.80 for sanitary sewers in Eldorado be approved and the proper
officials be authorized to execute the contract. Motion was seconded by Commissioner
Fields and carried unanimously.
The Mayor asked permission to deviate from the agenda to hear a report from
Comnussioner Watkins regarding his trip to Atlanta, Georgia, to discuss rinancing a
new City Hall building. By consent, ~t was agreed to hear the report.
Commissioner Watkins explained he had gone to Atlanta on September lOth and had
discussed with Mr. Ben Massell of the Massell Company proposed plans for a new City
Hall to be located at the southeast corner of Cleveland Street and Pierce Boulevard.
He reported Mr. Massell was interested in building and financil~ such a building with
the loan to be paid over a long period of time and he would accept either bonds or
revenue certificates of either 3 3/4 or l~t. maximum interest rate over a period of
time. By consent, the matter was referred to the Attorney} Finance Director and the
Acting City Manager for further study as to the proper method of finance.
In answer to Co~nissioner Insco's inquiry, Commissioner Watkins stated Mr. Massell
said he would assist in building a police station and jail also. Commissioner Insco
explained there ,..,as an agreement that the City o\'ll1ed property adjoining the Farmers
Market \~ould be maintained as a parking facility until such time as the Merchants
Association and the County vacated that area for use as a Farmers Market which they have
done. He reported the County now is preparing to deed that parcel of land baclc to the
City of Clearwater. He said the City owned property on the southeast corner of Prospect
and Court Street was being considered as a prospective site for the new police station
and jail and the site of the Farmers Market (east 75 feet of' Lots 5-10, Block C,
Coachman Heights) would be needed to provide parking facilities. Commissioner Insco
moved on the recommendation of the City Engineer and the Architect that the Commission
designate the area that has been suggested for the City Hall with the 230 feet facing
on Cleveland Street and 240 feet on Pierce Boulevard on the north side of' the present
City Auditorium and also to designate the location of the City o~med property at Court
Street and Prospect Avenue for the proposed site for the police station and jail and
moved that those t\'lO locations be accepted for the purposes specified. Motion was
seconded by Commissioner Fields and carried unanimously. ~~. Arthur Kruse, Zoning
and Planning Board Chairman, stated that Bartholomew & Associates} now preparing a
master plan for the City, were malcing a study f'or location of municipal buildings.
It was recommended by the Acting City flJanager that the lo\', bid of $7} 09~'. 00 from
Van Orden and Van Ess, Tampa, be accepted for the construction of sanitary sewers in
Druid Heights Subdivision. Commissioner Watkins moved the bid of Van Orden and Van Ess
in the amount of $7}094.00 for the sanitary sewers in Druid Heights Subdivision be
approved and the proper authorities be authorized to execute the contract. Motion was
seconded by Commissioner Fields and carried unanimously.
The Acting City Manager recorrunended that a transfer of' funds be made to cover the
cost of $195.00 for a frame to support the civic club signs. Mr. Al Vasconi, vice
president of the Council of Service Clubs, explained this project had been suggested to
display the service club signs all on one sign and that member clubs of the organization
had purchased proper signs of the same size and nature to mount on the sign.
Commissioner Insco nloved that funds be appropriated from Publicity and Promotional Fund
unappropriated surplus to P-l5 for the civic si[!;n in the amount of $195.00. Motion
was seconded by Conunissioner Fields and carried unanimously.
The r~yor explained that no bids had been received f'or one 1959 four door station
wagon for the Fire Department due to the 1959 models not being ready for delivery and
the prices not established. By consent, the item was postponed for re-advertising at
a later date.

which stated that recorded traff'ic volumes at this intersection would warrant a seml-

Resolution 58-T7 ~'las presented \'Ihich Vlould require t\'lenty-two property owners to
clean their lots of vleeds and underbrush. Conunissioner Insco moved Resolution 58-77
be passed and adopted and the proper officials be authorized to execute it. Motion

The Acting City Manager reported that he and the City Engineer had been requested
to make a survey of Ci ty-ovmed property which could be used as a s1 te for the State
vlelfare Board's District Office. Commissioner Insco moved that the Acting City
Manager send a copy of that report to each Commissj,oner for study and bring it up at
the next meeting. Notion Vias seconded by Conuni saioner Strang and carried unanimously.
It was reported by the Acting City Manager that the estinmted cost for six tennis
courts at Crest Lake Parle including side\'TUllcs, driveway, parking area, lighting,
dressing facility would be approximately $30,000.00 and for this particular installa-
tion $25,120.00 was put in this year's budget. Commissioner Insco suggested that the
tennis courts be laid out north of' the \'later to.....ler and asked for a report back on it.
The Acting Manager estimated the cost of ti'lO courts at either Stevenson Creek Park or
Hillcrest Park including materials, labor, nets and backstops as follows: Layk61d-
$5,400.00; Grasstex - $7,700.00; Concrete - ~;9,300.00. He estimated it would cost
about $1,300.00 extra to include lighting. Conmussioner Insco moved that the report
be received and that it be studied by the Parks Survey Corruni ttee that has been
appointed for the study of' all the parks in the City of Clearwater. Motion was
seconded by Conunissioner Fields and carried unanj.lnously.
Resolution 58-78 ~'las presented vlhich \-'lould assess the cost of sanitary sewer in
Edge"later Drive from Charles to Granada and thence easterly to Hilson Boulevard,
against the benefited properties. The Mayor asked if there were any objections and
there were none. Conunissioner Strang moved that Resolution 58-78 be passed and adopted
and the proper officials be authorized to execute it. fiJ:otion was seconded by

The Attorney presented a proposed agreement i'lith the Scott r.1etal Finishing Company,
Inc., \'1hic11. vlOuld permit the company to dischare;e an industrial waste into the storm
sm'ler with the condition 'chat if' tests ShOl'-1 that such ,,,aste vlould be detrimental to
the storm sewer or pUblic health that such connection will be disconnected until such
time as effluent is treated to meet City, County and State requirements. He stated
the Eneineer had received approval of the agreelnent from the County but that it should
be submitted to the State Health Department for approval. Corrunissioner Str.ang moved
the agreement with Scott Metal Finishing Company, Inc., be approved and the proper
officials be authorized to execute it. fv1otion \'1as seconded by Corrunissioner ~ratldns
and carried unanimou.sly.
The Attorney explained that he had prepared Ordinance 787 which would complete
the annexation of Sunset Lalce Esta to s Unit 1, Sunset Highlands Unit I and other
properties. He said as a condition to tho annexation the City was to install sanitary
Se\'Ter transmission mains at no expense to the developers of' the property to be annexed.
He said the Engineer planned to run a 21" sanitary sewer main from the Marshall Street
Plant up Vlo :>dbine, north along Kings Highi'Tay, ea st on Sunset Point Road to the inter-
section o~ Highland Avenue. The Mayor recownended that the estimated cost of $77,800.00
be appropriated from the Utility Revenue Certificate Series of 1956. Conunissioner
Fields objected to providing the area to be annexed with a transmission main at no cost
since ".lhen sel'ler \'las installed in the Sl{ycrest area, the property o\'mers \'1ere assessed
for the cost of the main and the disposal plant. He e~plained the Skycrest area had
been inSide the City for a long period and t11at this new area had not paid any City
taxes. He thought the entire length of Gulf to Bay Boulevard that has been in the
City for thirty years should be provided with sewer before providing it for a newly
annexed area. The Mayor stated the Consulting Engineers were now planning a sewer
program for the section of tOi~n from Belcher Road east and when that sewer plant is
built, it vlill no doubt be financed by a revenue certificate issued. Commissioner
\'latkins moved that the City Engineer be authorized to submit this project for bids,
and when those bids are recel ved that a suf'f'icient amount of :noney be transferred from
the revenue certificate account to tal-ce care of it, and that the Commission authorize
the work to be done thereby assuring the prospective annexators of the fact that the
City vlill provide them i'lith sewer. Notion \'Tas seconded by Commissioner Strang. Upon
the vote being taken, Conunissioners "Jatkins, Strang, Insco and Homer voted II Aye II .
Conunissioner Fields voted "No". Motion carried
The Attorney read on its first reading Ordinance 787 which would annex into the
City Sunset Lake Estates Unit 1, Sunset Highlands Unit 1, part of Sunset H~ghlands
Unit 2, part of Zephyr Gardens, and acreage in Section 2-29-15. Commissioner Strang
moved Ordinance 787 be passed on its first reading. Motion was seconded by
Comrrdss~oner Watl{ins and carried unanimously.

Ordinance 648 to allow reciprocity with certain municipalities and counties ror
general contractors' licenses. Comrrdssioner Strang requested that he be permitted
to refrain from discussion and voting on this item. Commissioner Watkins moved that
Ordinance 785 be passed on its second reading as 'amended. Motion was seconded by
COllunissioner Fields and upon the vote being talcen, Conunissioners Hatkins" Fields,
Insco and Homer voted "Aye". Commissioner Strang did not vote. Motion carried.

that Ordinance 785 be amended be passed on its third and i'inal reading and adopted

Resolution 58-79 was presented which v10uld authorize that $4,310.62 be paid from
the Construction Trust Fund to Briley, Wild and Associates ~or services in connection
with the Marshall Street Se\'J'age Plant" r.1arina Station Plant and the 1958 \1ater Improve-
ment Project. COlnmissioner Watkins moved that Resolution 58-79 be passed and adopted
and that the proper officials be authorized to execute it. Motion was seconded by
Comrndssioner strang and carried unanimously.

In response to a question from COlnmissioner Insco, the Engineer reported that
the Marina Station plant construction is on schedule but the MarShall Street Sewage
Plant construction is badly behind as after the third extension of time it should have
been completed in August. Comrndssioner Strang moved that the Acting Manager request
that the Consulting Engineer immediately furnish the COmrrUssion \~ith copies of progress
sheets on the flIarshall Street Plant sho\lTing l'lhen the Henry G. Dupree Company was
supposed to complete it \'(1. th their extensions or time" \'lhen they are going
to complete it, and when the penalty takes effect so that all of us will know where we
stand. Motion was seconded by Co~ssioner Insco and carriedunanimously.
Corrun1ssioner Strang moved that the Commission meet on September 29th. Motion
was seconded by Commissioner Insco and carried unanimously.
Commissioner Strang commented on a letter from ~w. Charles R. Fischer, Chairman
of the County Commission" describing the presentation by him of the key to the City of
Clearwater to General Alberta Salinas Carranzo, Dir~ctor or Civil Aeronautics in
Mexico. He stated while he \iaS Acting Mayor he received a letter in Spanish from
General Carranzo which he would lilce to give to the Acting Manager to have translated
and asked that copies of the translation be sent to the Oommissioners and a copy
sent to the County Con~iss:ton.
Co~nissioner Fields aslced if there had been any decision regarding the spillway
on Druid Road in Druid Acres 2nd Addition at Allen's Creelc. He stated that part of
the roadbed ~or Druid Road was washing out into the lake. It was the Engineer'S
opinion that this was a County problem since Druid was a County road and the County
had installed the drainage.

~mER~S: it has been determined by the City Commission of the City of Clearwater,
Florida, that the property described below should be cleaned of weeds, grass and/or
underbrush, and that a~ter ten (10) days notice and failure of the owner thereof to do so,
the City should clean such property and charge the costs thereof against the respective
property.
NOW THEREFORE BE IT RESOLVED by the City Commission of the City of Clearwater,
Florida, that the following described property, situate in said City, shall be cleaned
of weeds, grass and/or underbrush within ten (10) days after notice in writing to the
owners thereof to do so and that upon failure to comply with said notice, the City
shall perform such cleaning and charge the costs thereof against the respective properties
in accordance with Section'128 of the Charter of the City of Clearwater, as amended.

vlliEREAS, after public hearing on the 7th day of October, 1957, the City Commission
o~ the City of Clearwater, Florida, determined that certain work and improvements here-
inafter described should be done and made; and,
WHEREAS, pursuant thereto said improvements have been made as follows: Construct
8 inch sanitary sewer and appurtenances in Edgewater Drive from existing sanitary
sewer in Charles st. Northerly to Granada St.; thence Easterly in Granada St. approxi-
mately 158 ft., thence Northerly to North line or Block A, LaJolla Subdivision, thence
Easterly along said line to Wilson Elvd. Properties deemed to derive benefits from
this sanitary sewer are Lots 1 thru 14 inclusive, Block A LaJolla Subdivisionj Lots 1
thru 5 inclusive, Block C, Bay Terrace Subdivision; Tracts A & B, Homewater Subdivision
and a parcel or land bounded on the N. by the S. line of Homewater Sub.; bounded on the
S. by the North line of Block A, LaJolla Subdivision; bounded on the East by Tract B,
Homewater Subdivision and bounded on the West by Edgewater Drive, Clearwater Florida.
WHEREAS, under the provisions of Section 123 and other pertinent provisions of
the City Charter, after said improvements shall have been completed, the City Commission
shall assess the cost thereof against the properties facing and abutting and receiving
benefits from said improvements so made; and,
\~EAS, certain parcels of real estate facing and abutting and in the vicinity o~
said improvements have been bene~itted thereby and the pro-rata cost thereof shall be
assessed against such property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER,
FLORIDA, IN SESSION DULY ~ND REGULARLY ASSEMBLED, AS FOLLOWS:
1. That the above described improvements in the area Edgewater Drive from Charles
Street to Granada Streets Clearwater Florida, be and the same are hereby accepted and
approved as having been completed.
2. That the following described properties facing and abutting and in the vicinity
of the aforesaid improvements are hereby deemed to have been beneritted by said improve-
ments in the following proportions of the cost thereof, and the same are hereby
assessed in accordance with the rollowing schedule:
3. That if assessments herein made are not paid \uthin thirty (30) days from the
date hereof, the City Treasurer is hereby directed to issue and sell certif~cates of
~ndebtedness under Section 124 or the City Charter, which certificates shall bear
interest at the rate of eight (8%) per annum against the foregoing properties for the
assessments herein made immediately upon the expiration of the foregoing thirty-day
period.

The Mayor called the meeting to order. The invocation t�ras given by the

19�8, be approv�d ln acco�dance with copies submitted to eaeh Commissioner in writing.

The Acting City Manager reported that only one bid had been received to construnt
sanitary sewers in r,ldorado Avenue to serve Lots 1 and 2, Block 4, and Lots 1 and 2,
Block 1.1, Mandalay Subdivision, i3e recommended accepting the Gnly bid receiveci that of
Ra�* Birkbeck, Dunedin, for $993.80, Commissioner t^Jatkins moved on the recommendation
of th� Ci�y Engineer, Einance Direetor a:�d Assistant Purchas3ng Agent that the bid of
Ray Birkbeck for �993.80 for sanitary sewers in Eldorado be approved and the proper
officials be authorizecl to execute the contract. P�otion �vas seconded by Commissioner
Fields and carr3ed unanimously.
The Mayor asked permission �o deviate from the agenda �o hear a rsport f�om
Comnissioner YJatkins regarding his triA to Atlanta, Georgia, to discuss financing a
new Gity Hall building, By cansent, it was ag.reed to hear the report.
Commisaioner �rJatkins explained he had gone to Atlanta on September 10th and had
discussed with NL:. Ben T�1a.ssell of the Massell Ccmpany proposed plans for a new City
Hall to be located at the southeast corner of Cleveland Str�et and pierce Boulevard.
He reported Mr. Massell wa� interested in building and finaneing such a building tivith
the loan to be paid over a long period af time and he urould acce�t either bonds or
revenue certificates of either 3 3j4 or 4� maximum interest rate over a period oi'
time, By consent, the matter was referred to the Attorney, rznance Director and the
Aci:ing City Manager for iurzher study as to the proper method of finance.
In answer to Commissicner Insco's inquiry, Commissioner ti�Iatkins stated Mr. Massell
said he taould assist ir_ buildir� a palice station and jail a1so. Commissioner Insco
e:,��lairied there was an agreement that the City owned propert�r adjoining the Farmers
Market would be maint�.ined as a parking �acility until such �ime as the I�terchants
Association and the County vacated that area for use as a Farmers Narket which they have
done, ZIe reported the County now is preparing to deed that parcal of lar_d back to the
City of Clea�water. He said tlie City owned property on the southeast coiner of Prospect
and: Court Street tvas be3ng considered as a prospective site for the nevi poiice station
and jail and the site oi the Farmers Market (east 75 feet of Lots 5-7:0, B1ock C,
Coachman Heights) woulcl be needed to provide parking facilities. Commissioner znsco
moved on the recommendatior. of the City Engineer and the Architect tha� the Commission
designat� the area that has been suggested for the City Hall taith the 230 feet facing
on Cleveland Street and 240 ieet on Pierce Boulevard on the north side of the presen-E
Clty Auditorium ar.d also to designate the loc.�tion of the City owned property at Court
Street and Prospect Avenue fo� the proposed site for the police station and jail and
maved that those twc loeaticns be aecepted for the purposes specified, Motion was

and Planning �3oard Chairman, stated that Bartholomew & Associates, now preparing a
master plan for the C3�ty, �rrere making a study for loca�ion of municipal buildin�s,
It wau xecommended by the Ac�ing City Manager that the lot+t bid of' $7,094,00 flrom
Van Orden and Van Ess, Tampa, be aecepted i�r the construction of sanitary sewers ii7
Druid Heights Subdivision. Comm3.ssioner irlaikins m�ved the bid of Van Orden and Van �ss
izz t11e amoun� of :�7,Og4.00 for the sanitary seivers in Druid Hei�h�s Subcli:vision be
approved and the proper autl�or-ities be authorized to execute the contract. Motion was
seconded by Commissioner Fields and carried unan3mously.
The Acting Clty Mana�er reconuaended that a transfer of funds be made to cover the
cost of �1g5.00 for a i'rame to supporL- the civic club signs, Mr, Al Vasconi, vice
pres3dent o�' the Council of Service C1Ltbs, explained this project had been sugges�ed t�
display the service club signs all on one sign and that member clubs of the orbanization
had purchased prop�r signs of the same size and nature �o mount on the sign.
Commissioner Insco moved that funds be appropriated from Publicity and Promotional Fund
unappropriated surplus to P-15 for the civlc ,�i�n in the amount of $1g5.00, Motion
tivas seconc�ed by Commission�r Fields and carried unanir.mously.
The Mayor �xplained that no bids had Ueen received for one 195g four cloor station
wagon for the Fire Department due to �he 1Q5g models not beit� reacly for delivery and
�the prices not establishecl, By consent, the item was postponefl for re-advertising at

Manager send a cop,y of that report to each Coimnis�inizer for study and br�ng it up at

courts at Crest Lake Park including sidetivalks, driveway, parking area, ligh�ing,

Inc., ��rhich ivould permit the company to discliarge an industrial waste into the storm
se�ier with the condition that if tests shotv �hat such T,vaste v�oulcl be detrimental to
tlze storm sewer or public l�ealth that sueh connection vrill be disconnectecl until such
time as exi7.uent is treated to meet Citiy, Coun��r and State requirements, ETe stated
the Engineer had received approval of the agreeinent f'rom the Cour�ty 'aut th�.t it shauld
be submitted to the State Health Department for approval. Commissioner Str.ang mov�ed

The Attorney explained that he had prepared Ordinance 787 which would complete
the anneration of Sunset Lake Estates Unit l, Sunse� Highlands Unit 1 and other
propzrties, He said as a condition to the annexation the City was �o install sanitary
sewer tran�mission mains at no expense zo the developers of the property to be annexed.
He said the Engineer planned to run a 21" sanitary sewer main from the Marshall Stre�t
Plant vp V•Joodbine, north �,long Kings Hightvay, east on Sunset Point Road to tne inter-
seetion of Hi.ghland Avenue, The Mayor recommended that the estimated cost of $77',800,00
be appropriated fr•om the Utility Revenue Certificat� Series of ig56. Commissicner
�'ields object�d to prcva�ding the area to be annexed with a transmission,main at no cost
siizce when sev�er was installed in the Skycrest area, the property owners were assessed
for �h,e cost of the mair and the disposal plant, He explainecl the Skycres� ax�ea had
been inside the Gity for a long period and that this neU7 area had not paid any City
taxes. FIe thought the entire length of GUlf tn Bay Boulevard tlzat h.as been in tre
City for thirty years should be provided tivith setaer before providing it; for a newly
annexecl area. The P�iayor stated the Consultin� Engineers were now plannir� a sewer
pro�ra:� for the sect�on of tovm from Selcher Road east and when that seiuer plant is
bvilt, it v1i11 no dovbt Ue i'inanced by a revenue eertificate issued. Commissioner
.�tat�tins m�ved that the Ci�� Engineer be au.thorized to submit thiu project for bids,
and t�rhen those bids are received that a sufiicient amount of _�oney Ue transferred i'rom
the revenue certificate account to take care pf it, and t11at tlle Commission authorize
the tivork to be done thereby a�suring the prospective annexators of the fact tY±at the

inoved that Donald S. 1di11iams be appointed to the Gharlty Solici�ations Board to take
the place of James Murray who resigned. P4otion wa..� secoizded by Commissioner Strang
and carried unanimously.
Ma,yor Homer stated that Mr. Roeco Grella had called ?zim as represen�ative
for the local Glianter of the American Federation of Musi�ians and o�'fered on behalf
of the organization to pay �1,500,00 totivard eight band concerts to be put on in the
bandshell at Coachman Park during the winter at a total cost of �3,500.00 for 2�
musicians and it would require an appropriation from tlze C3.ty of' �2,000.00.
Conunissi�ner Strar� sug�ested that the local union use the $1,500,00 for yoLtth
�rograms as had been dane beior� and aftex� January lst the City could appropriate
2,000.00 for a curtailed program if funds t�vere available at that time. By coi�sent,
the Commission agreed to th�.s procedure.
