rrhe City Commission of the City of Clearwater met in regular session at the
City Hall, r.'londay, April 21st, 1958, at 1:30 R.M. with the following members

The Mayor called the meeting to order. The invocation was given by the
Reverend H. L. Chesser of The Church of God, Clearwater. Commissioner Watkin~
moved tm t the Minutes of the regular meeting of March 3, 195$, be approved as
amended in accordance ~ith copies submitted to each Commissioner in writing.
Motion was seconded by Commissioner Strang and carried unanimously.
A Public Hearing ~as announced on the widening, repaving and drainage in
Turner Street from Lime Avenue to Green~ood Avenue. The Mayor explained that
bids had been received on April 7th for repaving Turner Street from Lime to
Greenwood but some of the property o~mers had petitioned to have the street
widened five feet on either side at the same time; therefore, the Commission
had 'Waived a preliminary hearing and scheduled the Public Hearin~ to be 'Wi thin
the thirty day limit on the repaving bids. The Engineer estimated ~ith the City
paying the cost of resurfacing the original paving that the cost for ~idening and
drainage would be ~3.39 per front assessable foot. Written objections were pre-
sented from rJIr. L. Stuart Jones, Mr. I'larvin Hamilton, Nrs. I'~adelyn Bauer, Nrs.
l\largaret. Dunn, Nrs. Dan Peters and from l"lr. Charles I-I, Phillips, Jr., on behalf
of Marie H. Sebby. A petiCion of objection was filed signed by forty-five
owners of property located on 1urner between Fort Harrison and Greenwood Avenue
objecting to the widening. Upon a question from the Mayor, all of the fifteen
owners of property between Myrtle and Greenwood who were present voted as opposed
to the widening and agreed to the removal of all parking on their portion of the
street. As to the portion between Myrtle and Fort Harrison, four out of the
seven owners present were opposed. Nrs. Madelyn Bauer and Mr. Harold Wallace
objected but thought if the street was ~idened that no parking should be allowed.
Regarding the area from Fort Harrison westerly to Clearwater Bay, seventeen
property ow ners were present and all were in favor of widening the street. The
City Engineer stated that he could not give an estimated cost of the work on
this area separately at this time. Commissioner Watkins moved that t he bid of
W. H. Armston Co., Inc., in the amount of $7,759.60 be accepted and the amount
be pro-rated for the resurfacing of Turner Street from Fort Harrison to Green-
wood and the proper officials be authorized to sign the contract. Motion was
seconded by Commissioner Fields and carried unanimously.
Commissioner Watkins moved that the Public Hearing on the widening of
Turner Street from Fort Harrison to Clearwater Bay be postponed to the next regularly
meeting, May 5th. Motion was seconded by Commissioner Fields ani carried unani-
mously.
Commissioner Strang moved that the portion of the Public Hearing on the
widening of Turner Street from Greenwood to Fort Harrison be cancelled. Motion
was seconded by Commissioner Watkins and carried unanimously.
Commissioner Watkins moved that by unanimous consent the Commission inter-
rupt the agenda to hear a report from the Planning Board at this particular time..
Motion was seconded by Con~issioner Strang and carried unanimously.
l~. Arthur Kruse, Planning Board Chairman, presented copies of a proposed
contract with Harland Bartholomew and Associates, City Planners, and the City in
which the consultants agree to prepare a master plan for the City's future growth,
in conjunction ~ith City Planner Woole and the Zoning and Planning Board, for
the sum of $20,000.00. Mr. Kruse introduced Mr. Frederick Robinson, an associate
member of the fir.m, who spoke briefly. Mayor Homer, Mr. Kruse and the Zoning and
Planning Board recommended acceptance of the contract. Commissioner Watkins
moved, on the recommendation of the Zoning and Planning Board and the City Planner,
that the agreement between Harland Bartholomew and Associates of Atlanta, Georgia,
and St. Louis, Missouri, and the City of Clearwater be approved am the proper
offic ials of the Oi ty be authoria-ed to sign this agreeme nt. Motion was seconded
by Commissioner St.rang and carried unanimously.

'fhe Mayor announced that he had di scussed with Iv1r. K. H. Gerlach, repre-
sentative of Island Estates, the possibility of dredging in the so-called Yacht
Club channel as a part of their next dredging program under the approved Island
Estates development, not because of shorta~e of fill but to serve the public
interest. The f.layor reported they have agreed to remove the sandbars and dredge
the area at no cost to the City, providing the City gets the permit to dredge.
Commissioner Strang rnoved that the proper City officials be authorized to make
application to the Corps of Engineers, U. S.Army, for authority to remove
shoal areas from vicinity of and in the existing Mandalay channel lying immed-
iately north and east of the ~est Memorial Causeway bridge. Motion was
seconded by Commissioner \'latkins and carried unanimousl)T.
A Public Hearing on construction of curb, draina~e and widenin~ of Cirus
Avenue from Rainbow to 335 feet south of Rainbow was announced. 'i'he Hayor in-
quired if there ware any objections and there were none. After having held
this Public Hearing and having heard no legal valid objections, Commissioner
Strang moved that the project for construction of curb, drainage and to widen
Cirus Avenue from Rainbow to 335 feet south of Rainbow be approved and the
proper officials be authorized to advertise for bids and to be assessed upon
completion. Illotion was seconded by Comrnissioner Fieids and carried unanimously.

Holcomb, Jr., Clearwater J for paving Lakeview Avenue from Greenwood to IU ssouri.
COIT@issioner Strang moved that the Lakeview Avenue paving from Greenwood to
rJ1issouri be approved and that the proper officials be authorized to execute
a contract with E. H. Holcomb, Jr., in the wnount of $6,.35.3.97, this being
the lowest ani best bid. Hotion was seconded by Co:amissioner Fields and
carried unanimously.

The Manager recommended accepting the low bid of $1,513.31 from Hadley Con-
tracting Company, Clearwater, for the resurfacing of Princess Street from Sunset
Drive to Fort Harrison Avenue. Commissioner vlatkins moved trat the bid of Hadley
Company in the amount of $1,513.31 for resurfacing Princess Street from Sunset
Drive to Fort Harrison be approved and the proper officials be authorized to sign
the contract. Motion was seconded by Com~issioner Fields and carried unanimously.
It was recommended by the 1-1anager that the low bid of $1,040.00 from E. H.
Holcomb, Jr., Clearwater, be accepted for oonstructing paving and drainage in
the alley in Block 12, I.lagncillia Park from the AGL Railroad east 244 feet. Com-
missioner Fields moved that the bid of $. H. Holcomb, Jr., Inc., recommended by
the City Manager, be accepted and the proper authorities be authorized to sign
the contract, subject to the right of the City to de~iver tre Jroposed area free
from encroachment. Motion was seconded by Commissioner Strang and carried unani-
mously.
The Manager recommended accepting the low bid or ~84l.65 from Graybar Electric,
Tampa, for a motor starter for the Water Division, Utilities Department, to be used
at the Industrial Park. Commissioner Strang moved that the motor starter bid be
awarded to Graybar Electric, Tmnpa, in the amount of ~g4l.65, this being considered
the lowest and best bid, and the proper officials be authorized to execute a con-
tract. Notion was seconded by Commissioner Fields and carried unanimously.
Regarding the bids for three transfonners for Marshall Street Sewage Treat-
ment Plant, the Manager reported that the low bid of ~5550.00 from General Electric,
'l'ampa, with l~2 days delivery, was only $.30 less than the bid of Florida Electric,
Tampa, with 21 days delivery; therefore, he recommended that the bid of Florida
Electric be accepted because of the better delivery offered. Commissioner Strang
moved the Manager's recommendation be accepted and that the bid be awarded to the
Florida Electric Company, 'fampa, in the anount of' *'5550.30, this being considered
the lowest and best bid, and the proper officials be authorized to execute the
contract. Motion was seconded by Commissioner Watkins and carried unanimously.
Regarding the bids for card catalog file cabinets for the Library, the Manager
reported only one bid had been received, t,h:Jt of .t?66.00 from Gaylord Bros., Syra-
cuse, New York, and reco:1l1ilended it be accepted. Conunissioner Fields moved that
the bid of Gaylord Bros., Inc., as recommended by the Library Director and the
City Manager, be accepted and the proper officials be authorized to execute the
contract. Notion was seconded by Commissioner Strang ani carried unanimously.
The Namger recommended acceptin.g the low bid of ;~l,708.80 from Martin's
Uniforms, Tampa, for summer uniforms for the Police Department; he explained the
bid was ~l08.80 over the budget appropriation and it would be necessary to trans-
fer that sum from funds wi thin the department. Commi.ssioner Strang moved that
the low bid of Martin's Uniforms, Tampa, in the amount of $1,708.$0 be accepted
and the proper officials be authorized to execute the conLract and the necessary

The Manager reported that Mrs. Lucile B. Harris, curator at the SeaOrama,
under con~ract to the City is permitted to use a Ci~ owned house on Clearwater
Bay behind the Library Annex for living quarters; however, due to an arthritic
corxiition she can no longer live in 'Chat location; therefore, he recommended
her monthly contract price be increased from $250.00 per month to $325.00 to
compensate for living quarters previously provided. Commissioner Strang moved
that since it appears that Lucile Harris is not able to use the housing accom-
modations provided for her in ~he agreement between her and the City dated
April 2, 1957, that in lieu of furnishing the residence at llO! North Osceola
Avenue, the Ci ty shall pay her an additional sum of' :$75.00 per month effective
upon the date of her delivery of the residence making the total salary to be
paid her from that date to the end of the existing agreement with her, the
sum of $325.00 per month. Motion was seconded by Commissioner Fields and car-
ried unanimously.
The Engineer reported he had made a study as directed by the Commission
to find out the feasibility of installing a sanitary sewer transmission line
on Higtlland Avenue from the City limits to Sunset Point Road to serve sub-
divisions which are requesting annexation in that area and estimated, on the
basis of' a preliminary study, that the line would cost approximately $77,000.00.
After discussion, the City Attorney said he could let the developers kno~ the
Commission is willing to consider providing sanitary sewer if they request
annexation in writing. By consent, the City Attorney was instructed to contact
the developers and ask them to submit conditional reouests for annexation for
Gons~deration on May 5th. &
The Engineer reported that more fill was needed to make the Industrial Park
property look better and asked approval of an appropriation of up to $2,500.00
for drainage and grading. Commissioner Watkins moved that the City Engineer
be authorized to expend up to $2,500.00 to complete the drainage and grading
on the Industrial Park. Motion was seconded by Commissioner Fields and carried

Resolution 5$-3~ was presented which would authorize the payment of $3;6.30 to
Briley, Wild and Associates for engineerin~ services in connection with the Marshall
Street and the Marina Sewage Treatment Plants. Commissioner Watkins moved that Re-
solution ;$-34 for the payment of Briley, Wild and Associates account in the amount
of ~3;6.30 be approved and the proper officials be authorized to sign it. Motion
was secOTlded by Conuni ssioner Fields and carried un an imous ly.
'fhe Attorney presented Resolution 5$-)5 which would assess the cost of con-
sLruction of sanitary sewer t.o serve an areF.l bounded on t.he north by 'l'ract A and B,
Sunset Court Subdivision, and Tract 5, JeEfords and Smoyer Subdivision, on the south
by Pierce Street, on the east by a line 185 feet west o~ Osceola Avenue, and on the
west by Clearv/ater Bay, against the benefited property owners. Commissioner Vlatkins
moved that Resolution 58-35 be adopted, the assessment spread as shown, and the pro-
per officials authorized to execute the Resolution. ~~tion was seconded by Commis-
sioner Fields and carried unanimously.
The Attorney presented a proposed contract with BrileY', \vild .and Associates,
Consu~ting Engineers, to provide resident supervision for t.he 1958 Water Improve-
ment Pro ject. Co.anis sioner Strang moved thR t the proper orficials be authorized to...
execute a proper contract with Briley, Wild and Associates for resident supervision
of the water project in conjunction "lith the other two projects. I.lotion was seconded
by Commissioner Watkins and carried unanimously.
The Attorney reported the City had submitted to the Finellas County Commission
a com.ract covering the installation of a water transmiss ion line on Sunset Point
Road, and they have submitted a revised contract which differs sliehtly. rrhe Eng-
ineer had prepared a map shO\-Jin::, the difference betv.jeen the two contracts. Commis-
sioner Watkins moved that the agreement between Pinellas County, Florida, acting
thro~gh its Board of County Commissioners, and the City o~ Clearwater, establishing
the deli very point for the County t s 'thirty inch water main and oth er items as pro-
posed by the County, be accepted and the proper officials be authorized to execute
the same. Botion was seconded by Commissioner Fields and carried unanimously.
A proposed plat was presented of an addition to the Clearwater Cemetery des-
cribed as Block 12, Clearwater Cemetery. Commissioner Strang moved to approve the
proposed plat of Block 12 of CleaI"'tJi.ter Cemetery property and authori ze the proper
officials to execute the same in order that it might be recorded among the public
records of Pinellas County. I-lotion was second ed by COI:1missioner Fiel ds and carried
unanimously.
In regard to the new plat of Block 12, Clearwater Cemetery, it was pointed
out that the prices of the lots were included on the plat. Corrunissioner \'latkins
moved to instruct the Clerk to sell the cemetery lots at the prices set on the plat.
I.lotion \'Ias seconded by Commissioner Fields and carried unanimously.
r-ir. VI. E. Eigenmann asked if the Ci ty was s till interested in additional
right of way for Chestnut Street from the Atlantic Coast Line Railroad to Fort
Harrison. The Engineer stated that an additional thirty f'eet "Jas needed to make
a sixty foot street. By consent, r.lr. Eigenmann was requested to contact the
other owners in that area to get an estimate of what they would accept for the
needed right of way.
Comlllissioner vlatkins commented he had recei ved a complaint about an alB.gator
in a culvert in the Skycrest area and asked what could be done about it. By don-
sent, the Manager was instructed to get in touch with the Wild Life Officer.
'l'he l\layor reported th"::Jt the JayCees in a letter had requested they be re-
lieved of responsibility for the Get Out The Vote project which was not carried
out last fall and asked the privilege of' retaining the $500.00 for use in helping
defray the expenses OI the Outboard Regatta held last Au~ust. Commissioner Watkins
moved that the JayCees be allo~ed to transfer the $;00,00 from the Get Out The Vote
Campaign to the Outboard Regatta. Motion was seconded by COlmnissioner Fields and
carried unanimously.
The Mayor reported in regard to the Negro Beach located just north of Courtney
Campbell Causeway that after a careful survey it was found that the one on the old
location was neither large enou,~ to improve or adequately situated; therefore,
he recommended authorizing the Attorney to prepare a proper Resolution requesting
the State Road Board to designate the area beginning at the west end of the westerly
bridge on Courtney Campbe~l Causeway and from there running 500 feet west on both
sides of the road as a beach area for negroes similar to the one on the Sunshine
SkY\'lay Bridge approach. Commissioner T~l]atkins moved that tre City Attorney be
authorized to prepare a Resolution and that the proper o~ficials be authorized to
execute it. Motion was seconded by Commissioner St~ang and carried unanimously.
It was reported by the Mayor that he had received a letter from Lt. Coryell,
Commanding Officer, National Guard Company K, Clearwater, ex:plaining that legislation
was now pending in Washington which would do away with the ~ational Guard Unit in
Clearwater and asking that the C;olIunission write to the Florida Senators and Congress-
man Cramer. Cornmissioner Watkins moved that the City prepare a Resolution that the
City de~initely does not want to see the National Guard Unit removed from Clearwater
or have any units in this area removed and prepare letters for signature by each Com-
missioner to send also. Motion was seconded by Commissioner Strang and carried
unanimously.

The Mayor reported he had received an invitation to attend a conference
being held in Mimni on ~ay 3rd and May 4th from the Committee for International
Economic Growth. Commissioner Strang moved traveling expenses be authorized
for the Mayor t~ attend the seminar in Miami. I~otion ~as seconded by Commis-
sioner Watkins and carried unanimously.
The Commission, now adjourned as the City Commission and acting as Trustees
of the Pension Fund heard letters read from the Advisory Committee recommending
that Martha Spake, Clerk II, Finance Department, Accounting Division; Jeanne M.
Gates, Switchboard operator, Finance Department; Clara K. Jones, Clerk 1, Police
Department, Traffic Division; George Jorgenson, laborer, Utilities Department,
Meter Reading; James L. Cooper, laborer, Public Utilities Department, Refuse

The Trustees considered the request of Thomas J. Murphy to transfer from

Works Department on August 26, 1957. Commissioner Vlatkins moved that Thomas

The Advisory Committee recommended that James Cutts, laborer, Parks De-
partment, be accepted into the Pension Fund subject to waiver for disability
attached to his application. Commissioner Watkins moved that the employee be
admitted to the Pension Fund subject to the waiver signed by him as approved
by the Advisory Committee. Motion was seconded by Commissioner Strang and
carried unanimously. There being no further business, the meeting was ad-

WHEREAS, after publi~ hearing on the 6th day of August, 1956, the City
Commission of the City of Clearwater, Florida, determined that certain work
and improvements hereinafter described should be done and made; and,
WHEREAS, pursuant thereto said improvements have been made as follows:
Construct an eight inch sanitary sewer and appurtenances,
including a lift station and force main, to serve the area
bounded on the North by the South line or Tract A and B of
Sunset Court Subdivision and Tract 5 or Jeffords and Smoyer
Subdivision, bounded on the South by the South line of Pierce
Street, bounded on the East by a line parallel to Osceola
Avenue and 1$5 feet West of Osceola Avenue and bounded on the
West by Clearwater Harbor.
The properties facing and abutting these improvements are deemed to derive
special benefits therefrom.
WHEREAS, under the provisions of Section 123 and other pertinent provisions
of the City Charter, after said improvements shall have been completed, the
City Commission shall assess the cost thereof against the properties facing
and abutting and receiving benefits from said improvements so made; and,
WHEREAS, certain parcels of real estate facing and abutting and in the

WHEREAS, it has come to the attention of the City Commission of the City
of Clearwater, Florida, that the Department of the Army of the United States is
proceeding with plans for a revision of the Army National Guard Troop Basis,
which will result in a reduction in the size of the National Guard; and,
WHEREAS, the City of Caearwater, Florida is the home of Company "K", 211th
Infantry Regiment of the 51st Infantry Division, a National Guard Unit which meets
at the Pinellas County Armory in Clearwater, and which is composed of outstanding
citizen soldiers from this area; and,
WHEREAS, it is desired to indicate approval of this outstanding National
Guard Unit and to oppose any reduction of the Army National Guard Troop Basis
which would result in elimination of this Unit.

A PuUlic Hearing was announced on the wider.ing, repaving and drainage in
Turner Street from Lime Avenue to Greenwood Avenue. The iyYayor explai ned that
bids had been received on April 7th f or repaving Turner Street from Lime to
Greenwood but some of the property ovaners had petitioned to have the street
widened five feet on eith er side at the same time; therefore, the Coff,mission
had waived a preliminary hearing and scheduled the Public Hearin� t o be within
the thirty c�ay limit on t he repavin� bids. The En�ineer estimated wzth the City
paying the cost of resurfacing the ariginal paving that the cost for widening and
drainage would be �3.3q per front assessable foot. Written objections were pre-

owners of property located on 'rurner between Fort Harrison and Greenwood Avenue
objecting to tha widening. Upon a question from the �ayor, all of the fifteen
owners of property between Myrtle and Greenwood who were present� voted as opposed
to the wid ening and agreed to the removal of all parking on their portion of the
street. As to the portion between I�Iyrtle and Fort Harrison, four out af the
seven owners present were opposed. Mrs. Madelyn Bauer and I��Ir. Harold Wallace
objected but thought if the street was widened that no parking should be allowed.
Regarding the area from Fort Harrison westerly to Glearw ater Bay, seventeen
property ow ners were present and all were in favor of widening the street. The
City Engineer stated that he could not give an estimated cost of the work on
this area separately at this time. Commissioner Watkins moved that the bid of
W. H. Armston Co., Inc., in the amoun� of �7,759.60 be accepted and t he amount
be pro-rated for i;he resurfacing of Turner Street from Fort Harrison to Green-
wood and the proper officials be authorized to sign the co ntract. R�oti on was
seconded by Commissioner Fields and carried unanimously.
Commissioner Watkins moved that the PuUlic Hearing on th.a r�idening of
Turner Street fro m For* Hax�rison to Clearwater Bay be postponed to the next reoularly

rupt the agenda to hear a report frora the Planning Board at this particular time*

Mr. Ar�hur Kruse, Planning Board Chairm an, presented copies af a proposed
contract with Harland Bartholomew and Associates, City Planners, and the City in
which the consultanta agree to prepare a master plan fc�r the City+s future �rowth,
in co njunction with Cit3= Planne r Wcole and the Zonino and Planning Board, for
the sum of :�20,000.00. Mr. Kruse introducad Mr. Frederick Robinson, an associate
member of the firm, who spoke briefly. NIayor Homer, I�Tr, Kruse and the Zoning and
Planning Board recommended acceptance of the contract. Com�issioner Watkins
moved, on the recommenclation of the Zoning and Planning Board and the City Planner,
that the a�reement between Harland Bartholomew and Associates of Atlanta, Georgia,
and St. Louis, Missouri, and the City of Clearwater be approved and the proper
officials of the City be authoriz;ed to sign this agreemer_t. Motion was seconded

sentative of Island Estates, the possibility of dredging in the s�-Galled Yacht
Club channel as a part of their ne�t dredging program under the appr�ved Island
Estates development, not because of shortage of fill l�ui; to serve the puUlic
interest. The llayor reported they have agreed to remove the sandbass and dred�e
the area at no cost to the City, pro vidino the City gets the �ermit to dredge.
Gommissioner Strang moved that the proper City officials be au�horized to make
applica�ion to the Corps of Engineers, U. S.Army, for authorii;y to xemove
shoal areas from vicinity of and in the existing I�fa:ndalay channel lying immed-
iately north and east of the west Memorial Causeway bridge. I�Zotian was

A Public Hearing on construction of curb, drainage and wideninp; of Cirus
Avenue from Rainbow to 335 feet south of Rainbovt was announced. '1'he T�layor in-

Strang moved that the project for construction of curb, drainage and to w iden

the lowest and best bid, and the proper officials be authorized to eacecute a con-

The Nianager reported that Ivirs. Zucile E. Harris, curator at the SeaOrai,:�,
under con.ract to the City is permittsd to use a City otaned house on Clearvaater
Bay behind the Library Annex for living qusrters, however, due to an arthritic
condition she can no longer live in that location; therefore, ha recommended
her monthly coni;ract price be increased from �250.00 per month to �3�5.00 to
compensate for living quarters previously provided. Commissioner Strang moved
that since it appears that Lucile Harris a.s not able to use the housing accom--
modations provided for her in the agreement beL-ween her and the City dated
April 2, 1957, that in lieu of furnishing the residence at; 1102 North Osceola
Avenue, the Cii:y shall pay her an additional sum of :�s75.00 per month effective
upon the date of her delivery o� the residence making the tot al salary to be
paid her from that d.ate to the end of the existing agreement with her, the

The En�ineer reported he had made a study as directed by t he Comr,iissior.
to �ind out the feasibility of installin� a sanitary sewer �ransmission li;ne
on Hi�h land Avenue from t he City limits to Sunset Point Road to serve sub-
divisions which are requ�sting annexation in that area and estimated,,�n the
basis of a preliminary study, that the line wouTd cost appraximately w77,000,00.
tlf�er discussion, t,he Gity Attorney said he could let the developers know the
Commission is willing to consider providing sanitary sewer if they request
anne�ation in wri-�ing. By cansent, �he City .4ttorney r�as instructed to contact
the developers and ask them to submit conditional requests fur annexation for
consideratio� on May 5th.
The Engineer reported that more fill was needed to make the Indus�rial Park
property �:ook better and asked approval of an appropriation of up to �2,500.00
for drainage and grading. Commissioner 4Jat,kins moved that the City Engineer
be aut horized to expend up to �2,500.00 to complete the drainage and grading

the State Road Board to desi�ate the area beginninr; at the west end of the westerly

proceeding with plans for a revision of the Army National Guard Troop Basis,
which will result in a reduction in the size of the National Guard; and,

Infan�ry Regiment of the 5lst Infantry Aivision, a I3ational Guard Unit which meets
at the Pinellas Cotmty Armory in Clearwater, and which is composed of outstanding
citizen soldiers from this area; and,
