of the proper officials that the Lowest bid of w3;311.00 submitted by Ray
Birk beck, Dunedin, be accepted far the storm sewers on P?Tango Street from Bruc e
Avenue to Clear<?aater Bay and the proper officials be authorized to execute the

Before taking up the next item on the agenda, "Bids, Turner Street Resur-
facing, Lime Avenue to Greenwood Avenue", the Mayor read a petition si,?,ned by
sixteen owners of propart;r loc?t?;d on 'Turner Street between Fort Harri.?,n and
Clearwater Bay asking that the street be widened five feet on each side. The
Mayor reported that a considerable number of people had contacted him about
having East 't'urner Street widened, from Fort Harrison to Greenwood. He suggested
a Public Hearin; on both requests be adverti sed for the meetinr; of April 21st.
Commissioner Strang moved that consideration of these bids be postponed until
Apri 1 21st. ?iotion was seconded by Cor??rnissioner Insco and carried unanimously.
. Commissioner Strang moved that a Public Hearing be set irp for the widening
and improvement of 'Purner Street from its western???ost line to Greenwood Avenue
and that the preliminary hearing be dispensed with. Motion was seconded by ?

The Manager presented copies of tabulations from P?Tr? Harold Briley, Con- II
salting Engineer, for bids on the installation of materials, and bids on the
materials for the Vdater Improvement Project, 195$ Program. `The Pdanager re-
commended that cast iron pipe be used throu;hout the project instead of concrete
pipe. The City Engineer and the Consulting Engineer agreed with this recommen-
dation. htr? Briley revised the tabulation to fit the substitution of cast iron
pipe and recommended accepting the low bid of X100,206?50 from the Boyce Company,
Clearwater, for the installation of materials and acceptin; the low bid of
X254.,503.60, plus fittings at tir4.30,00 per ton, from the U.S. Pipe & Foundry
Company, Birmingham, Alabama, for materials. Commissioner Strang moved on re-
conunendation of the proper officials and the Consulting Engineer that the Boyce
Company of Clearwater be awarded the contract for the installation of materials
for the dater Improvement Project, 195$ Frogram, in the amount of X100,206?50,
that being the lowest and best bid according to the final tabulation sheet as
submitted by the Engineer on the basis of using cast iron pipe, Motion was
seconded by Commissioner Watkins and carried unanimously.

The City Attorney reported the City had been served with notice of an
injunction suit by Joseph G. Schultz and others, in connection with parking
meters and it was necessary to pass a Resolution authorizing the defense of
the suit. He said he had prepared Resolution 5$-32 which would authorize
the Assistant City Attorney and himself to defend the suit. Commissioner
Watkins moved that Resolution 58-32 be passed and adopted on April 7, 195$,
and the proper officials be authorized to execute it, Motion was seconded
by Cornrnissioner Insco and carried unanimously.
The Attorney read Resolution 5$-33 which would ratify and confirm Re-
solution 5$-2$, adopted I?larch 31st, establishin¢ parking; zones in which park-
ing meters would be installed on Clearwater Beach, in an area south of Bayrnont
Street, since objection was made in the Schultz suit that Resolution 5$-2$ was
not introduced in written form. Commissioner Strang moved that Resolution 5$-33
be passed and adopted and that the proper officials be authorized to execute it.
IYlotion was seconded by Commissioner ?9atkins. Upon the vote bein; taken, Commis-
sioners Strang, Watkins and Homer voted "Yes". Commissioners Insco and Fields
voted "No". I?lotion carried.
The Attorney read on its first reading Ordinance 769 which would amend
Article VII, Parkin, P?leters, Chapter 31, Code of the City of Clearwater, 1950,
by adding an additional section authorizir>,; the use of coins of different de-
nominations for various periods of time, and other changes. Several amendments
were sug;ested by the Commissioners, which were noted by the City Attorney.

on Hercules Avenue near the proposed intersection of Palmetto for a Little League
Ba11 Park, He commented that the suggested location in Stevenson Creek Park had
been criticized by the Recreation Board because of danger to the children from the
heavy traffic on Fort Harrison. He felt with the Industrial Park and the heavy
industries already located on Hercules Avenue there would be a traffic problem
there also. He asked that the Recreation Board reconsider the location in Steven-
son Creek Park and also the acreage near the Marshall Street Disposal Plant.

that Thomas J. Murphy, who transferred from the Fire Department to the Public

WHEREAS, parking meters have heretofore been installed on Clearwater Beach,
in the City of Clearwater, and it is desired to make definite, authorize, ratify
and confirm the establishment of parking zones in which parking meters shall be
established; and,
WHEREAS, Resolution 5$-2$, accomplishing the same was adopted on March 31,'
195$, and it is desired to ratify and confirm the adoption of said Resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA, IN SESSION DULY AND REGULARLY ASSEMBLED, AS FOLLOWS.
1. That the following areas on Clearwater Beach, Clearwater, Florida,
are hereby designated as parking zones, along and within which the City Manager
shall cause to be installed parking meters, and shall cause parking meter spaces
to be designated:
Both the East and West sides of Mandalay
Avenue from Baymont Street South to Marianne
Street. The East North and West aides of
the area marked "ark" on City Park Subdivis-
ion, the East side of Lots 3 and 4 of City

which or for which such meter is placed and to designate the denomination of United
States coin or coins which may be deposited therein for the purpose of obtaining
legal parking for such period of time so designated. Dther sections of this article
are amended to provide for the use of coin or coins as so designated fcr the desig-
nation of legal parking time resulting therefrom by the Citp Managers to make illegal

against the City, the members of the City Commission and the City Manager,
in the Circuit Court of the Sixth Judicial Circuit of the State of Florida,

Turner St. West, being advised of immediate letting of contracts, for work
to be done on Turner St. Do hereby petetion the city commission;. as to the
desires of we who will be affected most by this work.
1. We do not under any circumstances, want the continuity of the curb line
broken or set back, or out, at any one poiht, for any purpose other than
the point of junction where streets intersect.
2. We do not want more give off on one side more than bhe other at any
point or altogether on one certain side of the street.
3. We are willing and desirous that the street be widened not more nor not
less than five feet on each side of the street.
?.. We consider the added ten feet to this street will be adequate to handle
the transportation of vehicles at present and will be for some time to come,
even allowing for consi derable growth.

ruary 2L�th be approved in �ccordance with copies subrnitted to each Commissioner
in writing. Motion was seconded by Commissioner Fields and ca.rried unanimously.

dation. Mr. Briley revised the tabulation to fit the substitu-�ion of cast iron
pipe and recommended acaepting the low bid of �pl(70,206.50 from the Boyce Ccmpaizy,
Clearwater, for the installation of materials and acceptin� the low bid oF
��54,5a3.60, plus fittings at ti�430.00 per ton, from the U.S. Pipe & Foundry
Company, Birmingham, Alaba�na, for materials, Coirmiissioner Strang moved on re-
conunendation of the proper officials and the Consulting Engineer that the Boyce
Cumpany of Clearwater be awarded the contract for the installation of materials

bidder, J. B. Clow & Sons, Birmingha:n, Alabama, in the amount of �1,754.92.
Commissio ner Strang moved on the recommendation of the proper ofiicials that the
contract with Price �roth�rs for the 16 inch tappir�; valves with saddle asseml�ly
be cancelled with no penalty to either party and t hat they and the City be re-
lieved of any obligation thereunder, and that the coritract be replaced with J. B..
Glow & Sons ?n the amount of $p1,751�.92, th•�t being the next lotiaest bid, and the

Road Departmen� for permission to instal.l the water mains either along or across
certain state roads and asked that the Niayor and the Clerk sign them. Commissioner
Insco moved that the proper officials be authorized to execute the applications.

The Niarager recommended acceptin; the lovi bid of �;765.�.5 :£rom Pinellas
Stationery, Clearwater, for one transit, and the low bid of �,;3$7.4.5 from the same
firm for one level for the Er�ineerin� Department. Commissioner Strang moved to
accept the bid of Pinellas Stationery Company, this being the lowest and b�st bid,

Concerriing the bids for termiting the T+Iunicipal Auditorium the Manager re-
commended acceptinj the lavr bid of Termitrol En�inesrs, Clearwa�ter, for a lump sum
of �697.00 for freein? the building of subterranean termites and :�50.00 a year for
fi��e yeara for inspection service. Commissioner Watkins moved that the bid for
+..ermiting the it'iunicipal Auditorium by the Termitral Engineers in the amount of
�69'J.00, the lump sum, and a yearly fee of �50.00 for five years, be accepted
and the proper of�icials be authorized to sign the contract. Motion was seconded
by Cornmissioner Fields and carried unanimously.
The I�ianager submitted a tabulation of bids for sale of the City�s surplus
gropane bulk delivery �ruck showing that Hetro Gas Company, Inc., Safety Harbor,
made the high bid of �3,2U0.00, arxt recomrnended acceptance of that bid; hovaever,
he st�ted Mr. D. J. Raye, Sanitary Sewer Plant Superintendent, has now said the.
City can usE this truck in lieu of ordering a new sludge tank truck for the Marina
Station Sewaoe Plant. N1r. Harold Briley, Consulting Engineer, said he had in-
vestigated that possibility but believed a larger tank would be needed and sug-
gested trying to locate one through th e Surplus Property nivision of the U. S.
Army, Commissioner Wa�kins moved tY�at the Gi-i,y sell to the Hetro Gas Company,
Inc., for the sum of �3,200.00, the stmplus propane btilk delivery truck ancl the

It was recommended �y the Zoning and Plannin� Board that the following re-
quests be pla:ce� on tY�e next zoning referendum: the request for •a chang� fx:om
R-2 to Business zonin; from 1�1r. 4Varren Stickney for L�ts 5 and 6, Block C, Caro-
lina Terrace Subdiviaion, and from P+Ir. E, E. Turner for Lat 7 of the same block
for Business zoning. The Zoning and Planning Board further recommended that

parkino meters be replaced on both sides of the street adjacent to i,he beach
between Rockac��ay Street and Bay EsplanadE. A letter si�ned by Z+Ir. Gonza�o
Garcia, Presi:dent, ClearWater Beach Business Group, was submitted supporting
the request to reinstall the mEters at this location. Commiss_oner Vlatkins
moved the letters be accep�ed and referrecl to the proper officials for further
study, 1%iotion was seconded by Commi�sioner Strang and carried unanimously.
A petition was presented si�ned by twelve property owners askir_g for
curbing on l�orth Meteor Avenue from Drew to Gleveland Street. Gonmissioner
Strang moved the petition be referred to the Engineer for s�udy, arri set up
a preliminary hearing. Nlotion was seconded by Co�issioner '�iatkins and
carried unan imously.
The T�Tana;er repor�ed at the time wher_ the �;heater• owners c omplained
of the two hour me�ers in �he Coachmail Park parking lot the Commission
had approved a courtes� program for th�t lot; since that time it had baen
found that a special mechanism can ;ive a three hour meter, bu� before placir�
the order he would like the Commi'ssionTs approval, Co.*amissioner 5trano moved
�he matter be tabl�d. IIo�tion was seconded by Cammissioner Insco and carried
unanimously.
The CiLy Attorney reported the City had been served with notice of an
injunction suit by Joseph G. Schultz and others, in connectian with parking
meters and it was necessary to pass a Resolut ion authorizing the defense of
the suit. He said he had prepar•ed Resolui:ion 5$-32 which would authorize
the Assistant City �ttorney and himself �o defend the suit. Commissioner
�Tatkins moved tha� Resolution 58-32 be passed an3 adopted on April 7, 195�,
and the proper officials be autlzorized to execute it. r�toi.ion was seconded
by Commissioner Insco and carried unanimously.
The Attorney read Resolution 5$-33 which would razify and confirm Re-
solutiion 58-2$, adopted r7arch 31st, establishing parking zones in which park-
ing meters would be installed on Clearwater Beach, in an area south af Baymont
Street, since objectien was made in the Schultz suit that Resolution 5$-2$ was
not in�:roduced in written form. Commissioner Strang movzd that Resolution 5$-33
be passed and adopted and that thz proper officials be autl�orize� to execute it.
tlotion was seconded by Commissioner Watkins. Upon the vote being taken, Commis-
sioners Strang, tiVatkins and Homer voted "Yestf, Commissioners Insco and �ields
voted "No". Motion carried.
The Att�r.ney read on its first reading Ordinance 76g which would amend
Articl� VII, Parking 1�Teters, Chapter 31, Code of the Gity of Clearwater, 19j0,
by adding an additional section authorizin� the use of coins a�' differenL- de-
nominations for varieus periods oi time, and other changes. SPveral amendments
were suggested b;� the Commissioners, which were noted by the City Attorney.
Commissioner Insco moved the passage of Ordinance �69 on iLs first reading as
amended. I�Totion was seconded by Commissi_oner �datkins and carried unanimously.
Commissioner Z�Vatkins moved that Ordinance 769 be considered on its second
reading by title only with the unanimous consent of the Commission. Notian was
seconded by Commissioner Insco and �arried unanimcusly. The Attor ney read the
Ordinance by title only. Commissioner Watkins moved that Ordinance 769 be passed
on its �econd readin� by title only. Moticn was seconded by Cot;unissionar Insco

Commissioner Watkins reported that he had received comp�laints that driveways
which were to be replaced by the City in connection Svith Cirus Avenue pavin� and
drainaoe work were to be paved with blacktop instead of conarete. Commissioner
Strang moved th�t a.n all assessment projects that if th� City removed the driveway
that it be put back in the same material that it was ori;inally, as long as it was
in 000d condition. ���otion was seconded by Conunissioner rields and carried unani-
mously.
Commissioner Watkins moved tlzat the previous motion be applied to Cirus Avenue

Commissioner Strang mentioned hearin� of plans bein� r.iade to use City property
on Hercules Avenue near the proposed intersection of Palmetto for a Little League
B?1� Park. He commented that the s�gested location in Stevenson Creek Park had
been criticized by the Recre�tion Board because of dan�er to the children from the
heavy traffic on Fort Harrison. He felt with the Industrial Park and the heavy
industries already located on Hercules Avenue there woul3 be a traffic problerri
there also. He asked that the Recreation Board reconsider the location in Steven-
son CrEek Park and also the acreage near the NIarshall Street Disposal Plant.
Commissioner Fields s�gested that the Commission meet with Nir. A1 Rogero,
State Road Board member, to discuss the l�iyrtle �venuP paving, and other projectso
The �Zayor concurred with Commissioner Fields' suggesti,on. Commissioner Insco re-
commended a meetino with the County Commission also, to discuss the road program<
Commissioner Fields asked what progress had been made on the Be],cher Road
drainage pro jec�t. The Er�ir.eer reported that aftar the Public Hearir_g he had
asked the State Road Department and the County if tr8� would share in the project
by paying one third. He said both aoencies had expresse� willingness to cooperate
but no f�ther action had beentaken. It was suogested that the k�ngineer set up
a meeting with the County to discuss the subjec�.
2'he Tiayor read a letter from I�Ir. David E. Caesar, 2�$7 East Druid Faad, ex-
pressing appreciation for the Commission's assistance in helping to get the land
cleared adjacent t� his home and reported that I+7r. P�Zoody of the Palm Harbor Citrus
Associatior_ had cleaned not only fif'ty feet as requested but the entire 330 feet
alon� Druid Road.
The Commission norv adjourned as the City Commission and actin� as Trustees
of the Pension Fund h�ard a letter read from the �Advisory Committee rec�mmending
that Thornas J. i�iurphy, who transferred from the Fire Department to the Public
l�Torks Departmcrit , on August 26, 1957, be acee�ted �s a member o�' i,hc� Employees t
Pension Plan and the ypz57.L�$ he had contributed to �he �'iremari''s �'ension Fund
be transferr�d to Lhe Employees� Pension Fund, Commissioner Watkins moved the
