The Mayor called the meetine to order. The invocation was g~ven by the Reverend
A. N. Bostrom of Cleart'la ter Bible Church. Conuni ssioner \'Jatlclns moved that the minutes
of the regular meeting of June 3rd be approved in accordance t'li th copies furnished
each member in. writlne. Motlon was seconded by ConllnissJoner Strang and carried
unanimously.

The Mayor announced a Public Hearine on the construction of thirty foot pavement,
curb, drainage and eight inch sanitary se1,ler in Lincoln Avenue bet\jeen Court Street
and Druid Road. The Engineer reported that a petition had been received from some of
the property o'..mers requesting the improvements. He explained that the part of the
area in Hibiscus Gardens already had curbs i'.J'hich could be used. He said the rest of
the area 'VIas acreage but that a ppoposed plat had been submitted f'or a portion of it
by Mr. Nick Lembo and that he was willing to g:L ve the right of way ad,ioining his
property. The Engineer stated that Mr. Aldo Chambers, who was present" was willing
to give right of way also. ~~. Lloyd Phillips, representing ~~s. Elizabeth Lind,
o\'mer of part of the acreage on the east s1de of the proposed street" stated that
she opposed the opening of the street if she has tCl contribute thirty feet to the
rieht of way as her property has a depth of 110 feet and t~klng thirty feet off would
leave only an 80 foot depth. Mr. Krentzman said he understood Nr. Charles Phillips
was representing Mr. Lembo and that ~w. Phillips had been instructed to cooperate in
any way possible to obtain the necessary right of way. Mrs. Fran1\: Benns, owner of
Lot 1, Block T" Hibiscu's Gardens, expressed approval of the project. The Mayor
stated that this seemed to be a matter of adjustment bet\~een property owners and
suggested that the hearing 1)e adjourned to another meetine to allow the affected
property O'r'ffiel~S to \!lOrl~ 1 tout bet'ween themselves. Coromi ssioner Strang moved that
this Public Hearing be adjourned until June 24th at 1:30 P.M. Motion was seconded
by Commi ssioner Watldns and carried unanimously.
In regard to bids received for truck chassis and cabs for refuse bod~es, the
Manager read a letter in which he reconunended that the bid of $2,599.00 from Larry
Dimmitt" Inc., be accepted for one truck chassis,; that the b:i.d of $9, 9L~0.29 for three
trucJ\. chassis ot' 21,,000 GVld and the bid of $15,1'TI~.8'( for three trucl<: chassis of
29,000 GVW from Hunt Truck Sales" Tampa, be accepted as it was considered that the
purchase of this equipment i'-1ould produce the most economical operation. Mr. George
Dal by, representing Orange State Motors, \'lD.S present and spolce brj.ei'ly. There i.,as
discussion on the costs of maintenance of the different types of' truclcs being bid.
Conun:ts sioner Strang pointed out that tilere l,'laS approximately $800.00 difference per
truclc between the 10t'1 bid from Thayer Motor Company and the bid recommended and he
doubted that even if maintenance cost should run slightly higher that the difference
in maintenance costs "Iould exceed $800.00 during the estimated life of the truclc.
COnllnissioner Strang moved t.hat the bids on the truck chassis be awarded under Item A
to Larry Dinunitt in the amount of $2,599.00; under Item B be awarded to Thayer Motor
Company in the amount of' $8,,691.00 f'or the three units and that the three truck chassis
and cabs under Item C be a\'larded to Thayer Motor Company in the amount of $l2,,645.00,
these bids being considered the best and lowest bids and meeting the spec1fications.

Conun:issioner Vlatkins reported trlat the City Attorney prior to Nay l~(th advi sed
the Commission that Mr. Alex D. Finch had some additional information regarding
POlice Chief Irving Dribben and the City Attorney had been instructed to \"lri te Mr.
Finch a letter requesting the information that Mr. Finch had reported that he had
which reflected detrimentally on the record o~ Chief Dribben as a police off'icer
prior to his service in th.e City. Commissioner vlatkins reported that the letter
wri tten by the City Attorney ''las sent May l'(th and that to date there had been no
reply from rrlr. Finch.
The Manager reported that Acting Fire Chief Dobson had requested app~oval of
his absence from the City from June 14th to June 17th and of his vacation from June 16th
to 29th and had recommended that the Fire Department be left in charge of the Senior
Captains Danny Becl\: and John Neadows. The Manager suggested that one of these men be
appointed Acting Fire Chiei' for that period. Comnd.ssioner Insco moved that Acting
Fire Chief' Dobson be granted his regular amount of vacation and that the Senior
Captain be appointed Acting Chief during his absence. Motion \~as seconded by
Commissioner vlatkins and carried. unanimously.

previously followed. He said after analyzing the cost of administering the lot
cleuning pr0cess he \,tould recollunend n $15,00 minimum charge for lots up to 6,000

The tw1anager reported that a proposed blll for a separate pension plan for the
members of the Clearwater Police Department '.'las put in the hopper at Tallahassee
last \'leej( and said he was informed by a member of the Police Department \'Iho had a
part ill initiating the bill that the request for the bill had been dropped.
The Manager read a Ie tter from Mr. Di cj( Nel son, Gas Plant Superintendent J which
stated that for the paat several months a program for converting t~e present water-gas
plant to 100% Hasche Reformed f"lethod 1'1a s been under considera t:1, on and due to the time
involved for delivery of materials f'or eigher method it is imperative to make a
decision. The letter Save several reasons for continuing the conversion to the Hasche
Reformed Method:
1. Lower cost of operat~on.
2. It would provide a stand-by for natural gas.
3. It would require less than (;ne half the manpower ror operation.
4. vii til the reformine; method, operation \<Tould be more simpli1'ied,
5. There ,'!ould be no return to 525 BTU gas and no readJustment of bill B
and appliances.
The Ivlanager ex.plained that if the C:it~ \'laS G;oing to continue the water-gas system a.
major maintenance overhaul \.TOuld be necessary. He said in adopting the Hasche
system it would mean spending about $135,000.00. By consent, the Conunission agreed
to malce a trip to the Gas Plant as soon as the meeting ViaS over.
The City Attorney presented for approval an escrOVl agreement with Constantine
Farms, Incorporated, and reported that the agreement llad been executed by the
Constantines Bnd that they had deposited with the City a checl, for $2,423.74 as
provided to cover tl1eir proportionate share 01' the paving of Gunn Avenue as their
adjoining acreage is outside the Ci ty and not assessable. Conuni ssio11.er Strang moved
that the escrow agreement be approved and the proper officials be authorized to
execute it. ~1oti on Nas seconded by Conunizsioner Insco and carried unanimo....,sly.
In regard to the nwnber 01' ree;istered voters living \\'itilin Gates Knoll 1st Addition,
the Ci ty Attorney reported that he 110. ~1 chec:ced at the Tax l\.ssesscr I s office and found
that as of this date there are now ti':.irteen !lov.ses in the subd:lvJ,sion. He said the
Ci ty has on file a S'i'lOrn affidavi t b~r !'vIr. Cecil Gates, the O\'ll1er of the ma ~ori ty of
the lots in the subdiv:lsion, to the effect that there \'lere less than ten registered
voters living there and it was the City Attorney's opinion that the ordinance as
adopted annexing the subdivision is leGal.
Regarding the a,1l1cxation of Ba~i Bluff's Estates" the City Attorney explained that
he had prepared Ordinance 741 for the final annexation of the subdivision and that the
area had been zoned R-l by the Zoning Board. However, he ccmmented that the Ordinance
632 contract had net been approved and the subdivision plat was not yet approved. He
read Ordinan.ce 741 on 1 ts first reading. filotion "laS seconded by Conunissioner Ha tl-cins
and carried ~nanimous1y. The City Attorney recommended that second and third readings
be deferred.
The City Attorney inquired if tl'1e Conunission \'lished to go ahead \'lith Resolution
5',,{-32 Nhich \'lOuld require forty- seven property m'1l1ers to clear, their lots of weeds
and underbru.sh. The Mayor suggested adoptinG the Resolution and having the "lor]\: done
at the new cost. Commissioner Strang moved that Resolution 57-32 be passed and adopted
and the proper of'ficial s be authorized to execute it. I'lotion ''las seconded by Conunissioner
Hatldns and carried unanimously.
In connection \'lith the sale of' the revenue certificates of 1956, the City
Attorney stated it \'las Ylecessary to establish a Construction Trust Fund and that he had
prepared such an agreement \'!ith the First National Bank of Clear\'later acting as Trustee.
He read Resolution 5'7-33 desic;natin[; the First National B n1: of Clearwater as Trustee,
approving the Canst nction Agreement and settinc; up the compensatlo11 for the Trustee.
He stated that the City Treasurer had approved the agreement and it had been checked
with the First National B:..mlc. Commissioner \'latkins moved that R0so1ution 5~(-33 be
adopted and that the proper officials be authorized to execute it. Motion was seconded
by Conunissioner Insco and carried unanimousl:y.
The A.ttorney reported that the Engineer had submitted to him a request from the
Seaboard Air Line Railroad Compa.ny for an easement along Railroad Avenue north of
BfH1eair Street to suppl~r a spur tracl-: for filoderll. Roofing Company. The Engineer stated
that :Railroad Avenue was a forty foot unpaved street and he had no object~on to granting
the easement. The Attorney reconunel1ded that this be a revocable casement in case the
City wi.shed to open and pave the street later. Conunissioner \'latlcins moved that the
C~ty indicate its approval of a revocable easement in favor of the Seaboard Air Line
Railroad in the vicinity of Modern Roofing Conwany, Clearwater, in Railroad Avenue
" sub..iect to an acceptable easement f'orm to be approved by th.e Conunission and subject to
an~rdt'a.j,nage corrective action as determined by the City Engineer. Motion was

Conunissioner Strang reported that the City Commiss:i,on last SUll'uner had as]{ed the
Elks Club to move its Nursery School f'rc'm City cJ\med property north of the Nunicipal
Auditorium on Pierce Boulev2.rd and Cleveland Street and had offered to give the Elks
Cl ub the building if it \'TaS moved \'li thin une year. Dr. John Crump and another
representat~i '.Ie from the Ell':s Club aslced permission tG move the school tCJ City o,med
property located on Mi s souri Avenue east of the National Guard Armc.Jry. Arter checking

but ~e was of the opinion that HiGhland Avenue from Cleveland to Gulf' to Bay Should

Highland from Cleveland to Druid Road. By consent, the EnGineer was directed to
advertise the resurfac:i n~ of Hi[;l1laild frem Cleveland to Druid Read as an alternate to
the originally authorized bid.
Conunissioner Insco reported that several months aso Ordinance '(24 1'laS adopted
regarding the maintenance of ,:un;'~yard3 1'1:!. 'chin ti1e City limits and tha t a six
months grace period l,'/as included to gi ve one uf t~1e dealers time to decide ~'lhether
he \'lanted to go out of bus:ness or maJce arrangements to 1"'8. ve his place cleaned up and
fenced. The Manacer reported that the effect::. ve date of the Ordinance ~'lOuld be
June 11th and the Assistant City ^ttorney and the Police Chief will take action if this
wo~c has not been done by the effective date.
Cornm:i.ssioner Insco inquired as to the proGress on the plans for Fire Station #4
and VlaS informed that the Architect" Mr. Barace Hamlin, '-las \'lorldng en changes in the
dra\'lings. The Manager :.'lBS asJ-::ed for a report at the nex.t meeting as to 1,'lhen the plans
'-lould be ready.
Commissioner Insco as;,;:ed about the progress of plans for the ne~" Ncgl"o Recreation
Center. The Ene;ineer said he hoped to put the plans out i'or bids nex.t '</eei~.
In regard to the agreement with the Seaboard Air Line R ilroad for exchange of
certain property, the Attorney reported that the a~reement prOVided that the area 100
feet along the tracks neur Druid Road should be filled ~'lithin two years from the
date of' the agreemel1t Jul:y 15, 1955. He explained that he and the Engineer had met
with r/Ir. E. B. Cusler, the railroad's representative, and explained that the City had
been putting fill into the area but would not l1ave the 100 feet compl etely filled by
that time limi t. He said that Mr. Casler advised him to \'lrite a letter to the railroad
explainins that tL"le City might not have it completed by July 15, 1957" and asl{ed if
they would submit an extension agreement. Comr~ssioner strang reported tiat the con-
tractors in the Ci ty \'lere notified c;ver a month ago that they could not dump in the
area any more so he thought t,he fill must be almost complete. The C1 ty Attorney said
he \'lould f'urni sh the Manager \'/'i th a copy of the ae;reemen t . The Cornmi ssion a sl-ced for
a report all "-1ho issued the orders stopping the dumping in that area.
The Nayor reported that ~1r. H. H. Freeze, the ol'mer of h/enty acres on the south
side 01' Lake Belleview, h:1.d told him tha t he had an offer to sell the propert;v i'or
$5,000.00 per acre but he would give the City the opportunity to buy the property for
a park site with 10% dOl'm and 10% payment eCl.ch year if the City "las still interested.
He explained that the Planning Board and the Ci t;,T had been tryin~ to secur€ some
property f'or a parl<. in South Clear\'l9.ter. Corrunissioner StranG moved that the Engineer
be author~zed to do what ~s necessary to ascertain the useful land on this tract of
ground and make a report to us at the next meeting and inform the property owner i'le
are interested in further d,; scussion. Motion \'las seconded by COITU1ussioner Insco and
carried unanimously.

WHEREAS, it is necessary and appropriate that the CITY OF CLEARWATER enter into a
Construction Trust Fund Agreement with a National Bank in the City of Clearwater,
F~orida, having trust powers in order to accomplish the payment in the proper manner
of expenses of construction of improvements according to the provisions of
Ordinance No. 718 of said CitYj and
\iHEREAS, the CITY OF CLEARWATFR has sold $2,000,000.00 utility Revenue
Certificates, Series o~ 1956, and the proceeds are available for placing with a
Trustee to accomplish the foregoing purpose.
NOW, THF~EFORE, BE IT RESOLVED, by the City Commission of the City of
Clearwater, Florida, in session duly and regularly assembled as rollows:
(1) THE FIRST NATIONAL BANK OF CLEARWATER, Clearwater, Florida, a banking
corporation organized and existing under the laws of the United States of America~
and having trust powers is hereby designated as the Trustee for the purposes Bet
out in Ordinance No. 718 and in Construction Trust Fund Agreement dated June 10, 1957.
(2) That said Construction Fund Agreement is approved and ratified and the City
hereby binds itself to the provisions thereof, and the Mayor, City Manager, City
Clerk, City Treasurer and City Attorney be and they are hereby authorized to
e~ecute same fo:r the City.
(3) That the officials authorized to execute requisitions according to
Section 3 (A) or said Construction Trust Fund Agreement are as follows:

Section 8 of the Construction Trust Fund Agreement shall be the City Treasurer,

grass and/or underbrush: and that after ten (10) days notice and failure of the

The Mayor announced a Public Hearing on the construction of thirty foat pavement,
curb, draiizage and eiglz� i�zch sanitary sewer in Lincoln Avenue betti��een Court St�eet
and Druid Roac3. The Engineer reported that a petition had been received irom some of
the property oumers requestiiZg the imnrovements. He �xplained that the part c�f the
ar��a in Hibiscus Gardens already had curbs t�rh3ch cauld be used. He said the rest of
�h�a area U�as acreage hut that a proposed plat had been submitted ior a portion of it
by Mr,fiNicic Zembo and that he was yrillino to give the right of tivay adjoining h�s
�roper„J. �The Enoineer stated that A7r. A1do Chambers, who rrras present, was ��ailling
t� g3.v� right of way aiso. Mr. Lloyd Phill�.�s, representing I�Irs. Elizabeth Lind,
otvner �f part of the acreage on the ea.st side of the proposed street, stated tiiat
she oppased the opening of the street if slze has ta e�ntribute thirtjr feet to the
right of way as her property has a de�th ot' 110 feet and t:�:��ng thirty feet off would
leave only an 80 foot depth. Mr. Krentzman said he understood t�7r. Charles Phillips
t�ras representing Mr. Lembo and that irir. Phillips had been instructzd to ccoperate in
any tvay possible to obtain �he necessary right of way. NIrs. Frank Benns, owner of
Lot 1, Blocic T, Hibiscu's G�rdens, expressed approval of the project. The Mayor
stated that this seemed te be a matter of adjus�ment betjaeen property owners and

In regard to bids received for truck chassis and cabs for rei'use bodies, the
Manager r.ead a letter in which he recommended that the bid of $2,599-00 from Larry
Dimmitt, Inc., be accepted for one truc�; chassis; that the bid of y�g,940.2g for three
truc�;. ehassis of 21,000 GVGJ and the bid of y�15,1;4.87 for three truck chassis of
29,000 GViJ from FIunt Trucl; Sales, Tampa, be accepted as it was considered tha� the
purchase of this equipmer_t t�rould produce tne most economical opera�ion, r1r. George
Dalby, representing Orange S�Eat� Tfotora, was present and spoke briefly. ^lhere tras
discussion on the costs of mainienance oz the �ziffere�t types oi trucics being bid.
Commission�r Strang pointed out that tnere pras approximately $800,00 difierence per
�rucic between the lo`v bid from Thayer Motar Company and the bid recommended and he
doubted that even if maintenance cast sliouid r•un 5lightly higher that tne difierence
in maintenance costs would exceecl �800.00 during the estimated life of the trucl�.

Police Chief Irving Dr�bbeii and the City Attorney had been instructad tio t�vr3te Mr.
Finch a 1etLer requesting the information that Mr. Finch had reported that he had
which reflected detrimentally on tlze record oi Ch3ef Dribben as a police ofiicer
prior to h3s service in the City, Commissioner VTat�cins -reported that the letter
written Ly the City Attorney was sent May ],7th and Lhat to date �chere had bee» no
reply from NTr. Finch�
The Manager reported that Acting Fire Chiei Dabson had requested approval of
his abseilce from the City from June 14th to June 17th and of lzis vacation from June 16�h
to 29th and had z�ecommended`that the Fire Department bz lef� in charge oi' th� Senior
Captains Dannu Beck aiid John Meadows. The Mans,ger suggested that one of'these men be
appointed Acting Fire Chief for that period. Commissioner Iizsco moved that Actind
Fire Chief Dobson be granted his regular amount of vacation and that the Senior

involved ior delivery of materials for ei�her metllod it is imperative to make a
decision. Tne letter gave several reasons for continuin� the conversion to the Hasche
Reformed MeLhod;

2. It would provide a stand-by for r_atura.I gas.
3. It would reauire less than one half the manpotaTer for operation.

Reg;irding the annexatian of Bay Bluffs Estates, the City �lttorney explained that
he had prepared Ordinance 741 for �he #'ir�al annexation of the subdivisiori and that the
area had been zaned R-1 by the Zonino Board. Hoi�rever, he commented that the Ordinance
632 contraat had not been a�iproved and the subdiv3sion plat was not yet approved. He
read Ordinanc� 741 on •lis first reading, P4otion t�ras seconded by Commissioner Watltins

The C:i.ty Attorney inquirecl if the Commission tvished to go ahead with Resolution

Construction Trust Fund Agreement with a NaLional Bank in the City of Clearwater,
Florida, having trust powers in order to accomplish the payment in the proper manner
of expenses of construction of improvements according to the provisio�.� uf
Ordinance No. 718 oz said City, and
6+IHEREAS, the CITY OF CLEARWATER has sold $2,000,000.00 Utility Revenue
Certifica�es, Series oi 1g56, and the proeeeds are ava�lable for placing with a
Trustee to accomplish the foregoing purpose.
NOW, THEREFORE, BE IT RESOLVED, by the City Commission of the City of
Clearwater, Florida, in session duly and regularly assembled as foilows;
(1) THE FIRST NAfiIONAL BANK OF CZEARWATER, Clearwater, Florida, a banking
carporation organized and existing under �he lavts of the United States of America,
and having trust potaers i� hereby designated as the Trustee for the purposes set
ouz in Or�dinance No, 718 and in Construction Trust Fund Agreement da�ed June lo, 1957.
(2) That said Canstruction rund Agreement is approved and ratified and the City
hereby binds itself to the provisions tYl,ereof, and the Mayor, C�ty Manager, City
Clerk, Gity Treasurer and City Attorney be and they are hereb;� authorized to
