~lhe City Conmission of the Cit}T of Clearwater met in regular session at the
Cit.y Hall, Nonday, r-1ay 6, 1957, at 1:)0 P.M. with the following mEJllbers present:

The me~ting was called to order by the ~~yor. Commissioner Watkins moved
that the minutes of the special roo eting of April 22nd be approved in accordance
with copies furnished each member in writin~. Motion was seconded by Commissioner
Roberts and carried unanimously.
In observance of Elks National Youth Day, Mr. John Hamla, Elks Club Chairman
of the event, in~roduced the sLudents from Clearwater High School who were
acCing as City of'ficials for the day. Commissioner Insco moved that the Commission
tenporarily adjourn this meeting and let the student officials from the school
take over at this time.. Motion was seconded by Commissioner Roberts and carried
unanimously.
After the ~ tudent officials closed their meeting, Mayor Horner announced the
continuance of the regular meecing. The Mayor inquired if the Commission would
like to consider che approval of the minutes of the special meeting of April 29th.
By consent, approval of the mdnuces of April 29th was deferred Co the next meeting.
The Attorney read a reporC on che operation of cheMunicipal Court prepared
by Municipal Judge John Bonne r and Municipal Prosecutor Owen Allbritton, III, in
reply ~o a Federation of Civic Clubs' resolution published in the Clearwater Sun
on April 28, 1957, which resolution su~gested the creation of~additional court
wit.h more trained personnel and more time be ~iven each case. The report stated
that the Municipal Judge and the Prosecutor were trained in Traffic Court problems,
that each defendant has an opportunity to state his case and suggested that the
Federation of Civic Clubs be invited to send representatives to observe the
operation and procedure of the Court. Commissioner Strang moved that the
COllll1lission compliment the Munic ipal Gourt, accept this very fine report and ask
that a copy of this be forwarded to the Federation of Civic Clubs.. Motion was
seconded by Commissioner Robert.s and carried unanimously.
In regard. .to bids received for two mobile street sweepers and one hand powered
broom filling machine, the Manager recommended accepting the low bid of $9,255.84
for one four wheeled street 8'leeper \oJith the broom machine and the bid of $9,445.00
from the Power Brake & Equipment ~ompany of Tampa for one three wheeled street
sweeper because the thbee wheeled machine would give greater mobilir.y in sweeping
the downtown area and che four wheeled machine would be better suited for the
residential area. Commissioner Strang moved on the recommendation of the City
Manager that the bids be awarded accordin~ to this report, that is to che Florida
Equipment of Tampa for $9,255.84 for ~he s~reet ~weeper and broom machine and to
the Po~er Brake & Equipment Company, Tampa, for the other street sweeper, these
being considered ~he best and lowest bids, and the proper officials be authorized
to eXecute the contract.. Mot ion was seconded by Commissioner Roberts and carried
unanimously..
It was the recommendation of the Manager that the low bid of ~64a.OO from
McGain Uniform Company, birmingham, Alabama, be accepted for summer uniforms
for t.he Fire DepartmenC. Comissi oner Watkins moved on the recormnenda tion of
the Acting Fire Chief and the Purchasing Agent in which the City Manager coneurred
that the low bid of ~64g.00 for uniforms for .the Fire Department be awarded to
McCain Uniform Company, Birmi~ham, Alabama, and the proper officials be authorized
to sign the concract. Motion was seconded by Commissioner Roberts and carried
unanimously 0
Regarding the bids for four gas Cleaning tanks for the Utilities Department,
the Manager recommended accepting the low bid of $900.00 from Mr. K. O. Finch,
Clearwat.er. COl!nissioner Roberts moved that the bid of the K. O. Finch Company
for $900.00 for the four cleani.ng tanks for the gas plant be approved and the
properofficials be authorized to sign the contract.. Motion was seconded by
COlIlllissioner Watki~,. Wat kins and carrie d unanimously.
The Manager presented tbe request from Act,ing Fire Chief R. C. Dobson, for
four additional firemen at this time and explained that the ass ignment of the
present personnel showed tha~ it would be impossible to let some of the firemen
go on vacation without leaving seme of the stations understaffedu The Manager
reported that the Southeastern Fire Underwriters Association had recommended
twenty additional firemen for the number of stations Clearwater now has.
CO~lissioner Watkins moved that the City Manager be instructed to employ through
the Civil Service Board these four additional men and that the Finance Director
be authori3ed to trans:fer the necesstry funds. Motion was seconded by Commissj_oner

The Man~er submi~ted a statement from Mr. Ross Norton for $1,000.00 far
services as Myrtle Avenue Right of Way Agent f'ran January ls~ through March
31st, 1957. Commissioner Roberts moved that the bill in the amount of $1,000600
be paid to Mr. floss Norton for his work on Myrtle Avenue right of way extension
and that the Cit.y Clerk be inst.ructed to send Mr. Nort,on a letter thanking him
on behalf of' che Cocnmission :for the excellent job in the way he obtairled the .
right of way. Mocion was seconded by Commissioner Strang and carried unanimously.
1vlr. J hn Hanna inquired if it wo uld be possi ble to set the "curbs back and
round off ehe corners ',at, r-lyrtle Avenue and JeffonB and at Greewlloo:l and Jeffords
because or the heav.~y traffic :from t.he luhlher yards, etc. The Mayor informed Mr.
Hanna that. the Engineer was WOl"king on SUtch a project.
A r eque st was presented by the Manager for permissi on to secure bids for an
acc ourt. ing era chi ne, a b illi ng machine .an d a validati ng machine. HE/explained that
the bids are being asked for t.he purpose of expediting delivery i:f it is decided
to order them, that the accounting machine is needed now and that. a survey is
being made to determine if t.he purchas e of th e other tw~ would save time, labor J
<:Ind money. Cocnmissiorer Roberts moved on the recommendation of' tr:&e City Manager
that he be authorized to obtain bids on these machines wi th the understanding
that the quest.ion of buying chern will come up later. Mot ion was seconded by
Commissioner Watkins and carried unanimouiy.
The Manager reported t.hat Mr. H. M. Turnburke of turnburke, Brock and Raines,
auditors for the City.. had asked that a statement be submitted to t.he Commission
in reply to tlE critJJ./m of ef the '.l'urnburke firm bl a local group ~hich was
quot ed in t.he Clearwater Sun several mont hs ago. The statement apIes rs in the
following pages of these m~nutes and by reference is made a part hereof. Mr.

The Manager presented a recommerrlation that the City adopt l;he same
holidays as the local banMs -- July 4th, Labor Day, Thanks~iving, Chrd8~ma8
and New Year's Day. Cornmissi oner Watkins comme nted that. he did not approve
of leaving out Armistice Day and Memorial Day. Commissioner Strang moved that
this be returned to the C-it.y Manager and brought back to the next mee.tiI}g.
Motion was seconded by Commissioner Insco and carried unanimously.
'l'he Manager presented Resolution 57-26 which wo uld require twenty-three
property owners Co clean t.heir lots of weeds ani underbrush. Cormnissioner
Strang moved that Resolution 57-26 be passed and adopted and the proper officials
be authorized Co execute itp Mot.ion was seconded by Commissioner Insco and
carried unanimously.

The Mayor announced that the City took an inceresl; in the purchase of' land
created by accretion south of Bayside #5 by the developers from the Internal
Improvement Board and the City Engineer had recommended that a bulkhead be
required to prevent further accretion. Mr. H. H. Baskin, Sr., speaking for
W. D. Owens and ot.hers. the developers. reported that t.he application for a deed
fr.om the I. I. Board was a technical mat.ter in order to obtain ~t~Le insurance
to the land. He said that the develoJ:a rs were meeting the requirements o:r the
State Road Boare as to free right of way for the approach ~o the proposed bridge.
He suggested t.hat the 3ate Road Department may move the channel to the south as
the elevation of' the bridge and grade would require it. The Mayor scated that
the City was interested in ~n chings -- the fi. nal locat ion and staOdization of
the channel and the traffic situation t hat will be caused by 'the proposed bridge,
and that the Cit.y ha.s never been consulted on the location of the bridge or any
of its appurtenances. Commissioner Strang suggested a joint meeting bet.we~l
representatives of che Scata Road Department, the developers of Bayside #5
and the Commission. Commissioner Strang moved 'that c he Conunission go on record
as inscructing t he City Manager to notify the Stat e Road Department that chis
matl.er is going to be discussed at next Monday's meeting and t.hat the Conmission
would be pleasaito have their representatives in atr.endance to expJain plans
for the proposed bridge and also to invite the Bayside #5 developers as well.

The Manager submiLted a tabulation of the bids :for the addition to the
Marshall Street Sewage T~tment Plant. and recommended that. 'the low base bid of
~67J,775.00 submit.ted by the Henry G. Dupree Company of Jacksonville, Florida,
be accepted racher tran t, he alternace bid of $659.304.00 from the same firm
because of increased efficiency in operation and maintenance by use of s~ing
diffuser equipment over stationary diffuser in aeration Lbanks. Commissioner
Insco moved 06 che recommendation of the City Manager and Briley, Wild and
A~ociates, Consult.ing Engineers, that t he low ba se bid of Henry G. Dupree
Company in the sum of :t673,775.QO for the Marshall St.reet Sewage Treat.ment Plarlt
be accep'ted and the proper officials be auchorized to execute a co ntract

In regard to the purchasing of Block 6, Gould & Ewing 1st Addi tion, ~or an
o.ffi-e& st,reet parking lot, the Manager reported that Assistant Ci ty AttOI'l'ley
Allbrittonl'Bd made a survey and estimated cost of acquiring such property and
the proposed total cost according to his estimate was a great deal higher than
the cost estimated by t~ Merchants Association. He sugge,<:',ed referring 'the
mat.ter back to the Merchants Association. Conmi5sion~r Watkins moved that the
City Manager be instruct.ed to get in touch with the President of the 14ercharts
Association, discuss the matt.er with him and ask for their help again. Motion
was seconded by Commissioner Roberts and carried unanimously.
'J.'he I~nager reported that the employees havQ asked that several things be
added to the Pension Plan which would call. 1'or an amendment to the Employees
Pens:ton Act. and that he had sent the Commissioners a letter on the subject. He
sugges~ed ~et~ing an act.uarial survey on this plan and also on the Firemen's
Pension Plan. Commissioner Roberts moved that the City Manager be instracted
to submit t.he employees pension p~ans to one or more reputable actuaries to get
a report as to just. what the City has, how sound it is actuarially, and what 'Would
be ~he ult:tnate result projecting it. into the years, and ask i'or recommendations
as to jus~ wh<~ti type and plan should be adopted. IJIotion was seconded by
Commissioner Watkins and carried unanimously.
The Manager sugges~ed askin1 the local insurance underwriters association
to recommend a standard incentive retirement program beyond Social Security for
employees under Social Securit.y but providing for not more than 3iu of the payroll.
By consent~ the Manager was instruct.ed to request the local insurance underwriters
to check on this incent.ive retir:ement program. 1'he Attorney suggested tnat the
Ac't.uary be asked to compare,. tbe '~Empiloyees Pension Fund with t.he benefits that
could be deI'ived from Social Secul71.tiy.
It was reported by the Mana~er that a request had been received from the
Pinellas County Commission to either. approve or disapprove by resolut.ion the
conversion o~ Old ~ampa Bay north of Courtney Campbell Causeway into a fresh
wa~er lake. the Attorney stated that a Comrnit~ee from the Chamber o~ Commerce
had been actively invest.igat. ing the pro}:osiL and sUf~~ested that the Commission
request a report froIIl "the Chairman of that Committee. Commissioner Watkins
moved that the ma tt.er be placed on the ne:xt. Monday's a~enda and that the Chairman
of the Chamber of CQmmerce Commit.tee be asked to c orne up to present the case as

The Manager reported that he had received a request from the Cmin of Missi ons
.for $50.00 through t.he Speoial Events Fund. He suggested de1'erring the item to

request from the Bomber Booster Club for $3,000.00 would be discussed at that time
also.
A report was presented from the City Engineer concerning the resurfacing ~ork
on ~ North East Cleveland which stated that the work had been comple~ed, ahat it
'Was done under tre supervision of the City Engineer and according totOO speci1'ications
for the job whj.ch specificat.ions were taken from the Stat e Road Department
speci..fications. Commissioner Watkins commented that he still thought it. was a
poor job and needed rolling or something to make the sur.face more even. By consent,
the matter was deferred ~or further investigation.

In accordance with a request of t.l'e Coromi ssion, the City Attorney reported
that he had studied a copy of a proposed le~lative act being sponsored by the
Flor.ida Planning and Zoning Assoc iation and :fount! t.hat. if suc h an act was passed
by t.he Florida Legislature it would revise a good p8rt of the City Charter and
many o:f the City's special acts. He said the Association's position was that
it was an enabling act which, if adopted, as ~eneral law, would make available
to the various municipalities the right toaiopt por,tions of it. He recommended
that since chis proposed act. had not been incroduced in the Legislat.ure t.hat
no endorsement be rrade until it was introduced. Commissioner Watkins moved
that the mat.tE'r be t. abled until the act is introduced int.o the Legislature.

In reg;ard to the request cf Mr. Herbert f.iI. Brown, attorney for lllr. N. Alfred
Gregory, for a five year renewal of thB le ase on Room 9 of t.he Marina Bui lding
to operat.e a gift shop, ~he City Attorney stated t.hat. he had recommended
that since cOJlplaints had been received from Mr. George Butcher, ta1ant in Room 4
of the lliarina Building, about some apparent conflict between his lease and !,1r.
Gregory's lease, that ~r. Butcher should be hear.d before renewal of the lease was
approved. tl1r. Brown asked ~,lr. E. H. Pierson, former holder of the lease on Room
9, to speak concerning ~he right to sell film. Mr. Pierson st.ated that he had
discussed the mat\.er wit;,h t-'lr. F. C. IVliddleton, former City I.1anager, and had lihen
contacted Messrs. David Hand and George But.cher and rec~ived verbal permission
from them t.o sell film. ~1r". Butcher commented the verbal agreement was on a
mont.h to month basis and 'Was not transferable to another tenant. Mr. John W.
Ro\'~e, appearing :for :~. Bticher, reported that l'-1r. Wm. Lemke, former holder of
the lease on Room 4, had been given permission to sell film and other items of

Commission had previously approved execution of such a deed but tbe State Road

The Mayor announced that the Industrial Committee had approved a contract
for the purchase of Lot. 1 in the unrecorded plat. of the Clearwater Industrial
Park for ~15, 750.00 and that the check from Mr. Ray H. DePasquale of Technical
Material Corporation) Mamaroneck, New York, was on ~ile. The Attorney report.ed
t.hat he would appear Defore the County Commission on 'l:uesday, Nay 7th, to
request vaca1:.ion of cert,ain old rights of ~ays on th e Pinellaa '}roves Subdivision,
t.hen the plat of t.he Industrial Park could be revised, and the rest.rictions and
che plat could be recorded. Commissioner Watkins moved t.hat the Commission approve

at the Marshall Street Disposal Plant at a cost of $2,400.00 as an emergency measure.

,The Commission no'W adjourned as the City Commission and acting as Trustees of
the Pension Fund heard a lett er read from t he Advisory Committee of the Pension Fund
which recommended that. Freddie McCray, Building Cust.odian, City Hall, be accepted in-
to membership in t.he Pension Plan. CQrnmissioner Roberts moved on the recornmendatiion

Mr. Turnburke, of Turnburke, Brock and Raines, City's Auditors, has asked that
the follo~ing stat.ement. be made ~o ~he City Commission which is quoted verbat.im:
"Several months ago members of a local group were quoted in a front page
story of the Clearwater Sun as being critical of the professional services
of Turnburke, Brock and Raines, cert.ified pub1ic accountants, which firm
has been performing t.he audit. \Ork or t.he Cit.y for a number of years past.
on a continuous audit basis. Shortly t.hereafter the City engaged t.he
nat.ionally known public account.ing firm of Price Waterhouse and Company
to make an examination of the City's :financial "records for its fiscal
year ended June 30, 1956, a1though Turnburke, Brock and Raines were then
in the process of completing t..heir own audit. of che same ~8CC'al year.
"Upon examination of tre Price Wat.erhw se audit. report and compar.:ison with
the audit report of Turnburke, Brock and Raines it. 'Was found that the
financial position of t. he City as at June 30, 1956 in all of its seventeen
funds as stat.ed in the two reports was identical, except ror the accrual
by Price Waterhouse as at that date in the Utility Revenue Fund of certain
items of income arn expense which were treated as July: 1956 transactions
by ~h. e Cit. y and by 'l'nrnburke, Brock and Rai nes in t he interests or consistent
accoanting treatment.. from year to year. The net result of these accruals
had on1y a mDnor effect upon the Utility Fund Balance Sheet.
"Subsequent to the recehpt of' t.h e Pri ce Waterhouse report, the then Mayor,
Mr. Kerbert M. Brown, wrote that firm inquiring whether or not as the
res ult o:f its audi t_ t.ogether wi th its examination of the work papers of.
turnburke, Broct and Raines and consultations with the members of said
firm, f>>rice Waterhouse waS. .convinced of the adequacy of'the auditing
pro.cedures and Jr of'essional cOI~t.ency of Turnburke, Broc k and Raines.
Price Wat.eraause replied tihat there was no doubt in t.he minds of its
represencatives who parformed the Clearwater audit as ~o t.he quality of
the work and th e independence of 'l'urnburke, Brock and Raines.
"Inasmuch as the publicit.y pert.aining to the services of Turnbnrke, Brock and
Raines and the engagement of Price Wat.erhouse might have been construed as a
refiection upon the professional competency, a bility and independence of
'l'urnburle, Brock and Rai nes, t.he Oity Commission is glad to make t.his public
st.atement. to correct such impression. The City Commission has bomp1ete con-
fidence in the professional ability and independence or the firm of Turnburke
Brock and Raines, and is satisfied that said firm is rendering competent
and effpicient accouncing services for the City of Clearwat.er."

The meeting was callad to order by the Mayor. Commissioner G,atkins moved
that the minutes of the special me etin� of April 22nd be approved in accordance
with copies furnished each member in writing. �Totion was seconded by Comrni.ssioner
Roberts and carried unanimously.
In observance af Elks I�ationaZ Youth Day, Mr. John Hanna, Elks C1.ub Chairman
o£ the event, introduced the students from Clearwater High School who were
acting as City of'ficials for t;he day. Commissioner Insco m�ved that the Commission
temporarily adjourn this meeting and let the student officials from the schoo].

After Lhe s tudent officials closed their meetin;, �Qayor Homer announced the
continuance of the regular meeting. The Mayor inquired if the Commission would
like to consider Lhe approval of ihe minuees of the special meeti ng of April 29th.
By consent, approval oi the minutes of April 29th was deferred to the next meeting.
The Attorney read a report on the operation of the Municipal Court prepared
by Municipal Judge John Bonne r and Muni�ipal Prosecutor Owen Allbritton, III, in
reply to a Federation of Civic C1ubs' resolution published in the Clearwater Sun
on April 2g, 1957, which resolution su�gested the creation of additional court
wiLh more trained personnel and more �ime be �iven each casa. The report stated
that the Municipal Judge and the Prosecutor were t rained in Traific Court problems,
that each defendant has an opportunii;y to staLe his case and su�gested Lha� the
Federation o� Civic Clubs be invited to send representatives to observe the
operation and procedure of the Court. Cornmissioner Strang moved that the
Commission complimenL the NIunicipal Court, accept tk�is very f ine report and ask
that a copy of this be forwarded to the Federation of Civic Clubs. Motidn was
seconded by Commissioner Roberts and carrie d unanimously.
Tn regard•.to bids received for tV�o mobile street sweepers and one hand powered
broom filling machine, �he P�Ianager recommended accepting the low bid of �9,255.$4
for or.e four wheeled street sveeper with'the broom machine and tha bid of �9,445.00
from the Power Brake & Equipmant �ompany of Tampa for one t�ree wheeled street
sweeper because the t}s'r.ee wheeled machine would giJe greater mobili�y in sweeping
the downtown area and the four wheeled machine would be better suited for the
residential area. Gommissi oner Str ang moved on the recommandat ion o� the City
i�lana;er that the bids be awarded according to this report, that is to Lhe Florida
Equipment of Tampa for �9,255.$4 for the sLreet �sweeper and broom machine and to
the Power Brake & Equipment Company, Tampa, for the othe.r street swesper, these
being considered the best and lo�vest bids, ard i;he proper ufficials be authorized
to execute the contract. Motion �vas seconded by Commissioner Roberts and carried
unanimouslyv
I� was the recommendation of the Manager that the low bid o�' ��,'61�$.00 from
NlcCain Uniform GompanX, �irmingham, Alabama, be accepted �or summe r uniforms
for the Fire Department. GouEnissioner Watkins moved on the recommendation of
the Acting Fire Chiei and the Purchasing tlgent in which the City Pdanager conaurred
that the low bid of v�6�.$.QO for uniforms for �he Fire Department be awarded to
McCain Uniform Company, Birmingham, Alabama, and the proper oi£icials be authorized
to sign the contract. Motion was seconded by Conmissioner Roberts and carried
unanimously.
Regarding the bids f or four gas cleaning tanks f or the Utilities Department,
the Nlanager recommended accepting the low bid of �900.00 from NIr� K. 0. Finch,
Clearwater. �orranissioner Roberts moved that the bid of the K. Q. Finch Company
for �'a900.00 for the four clPaniro tanks for the gas plant be approved and the
pr operofficials be authorized to sign the cnntract.. Motio n was seconded lry
Commissioner Watki��<.Watkins and carried unanimously.
The Manager presented the request from Acting Fire Chief R. C. Dobson, for
four additional firemeti at this time and explained th�t the assignmant of the
present personnel showed that it w ould be impossible to let some of the firemen
go on vacation without leaving some of t he stations understaffed. The Manager
reported that the Soutaeastern Fir e Underwriters Associat ion had r ecommended
twenty additional firemen for the number of stations Clearwater now has.
Co�rimissioner T�atkins moved that the City Manager be instructed to employ through
the Givil Service Board these four additional men and that t he Finance Director
be aufi�horized to transfer the necessay �`.'unds. Motion was seconded by Co�nmissioner
Strang and carried unanimously.

services as Myrtle Avenue Right of Way �lgent fro�n Januarl� lst through March
31st, 1957. Commissioner Roberts moved that the bill in the amount of �1,000.30
be paid to n'Ir. Ross Nor�on for his t+�ork on Myrtle Avenue right of �oay ex�ension
and that the City Clerk be instructed to send P�ir. Nor�on a letter thanking him
on behalf oi the Commission f�r the excelle.nt job in the way he obtained the
right of wag. Motion was seconded by Commissior_er Strang and carried unanimously.
Mr. J hn Hanna inquired if it wo uld be possible to s zt the cu�bs back and
raund off �'he corners F:at M�tle Avenue and Jeffo� and at Greenwoqd and Jeffords
becai:�se of the heav�y traffic from the luinber y�ards, etc. �'he Mayor informed Mr.
Hanna that the Engin�er was warkir� on �r�rch a�roject.
A request was presented by the i�Ianager f`or permissi�n to secur� bicls for an
accouriting �zchine, a billing mnchine and a validatin� machine. H�explained that
the bids are being asked for the purpose of expediting delivery if it is decided
to order them, that the accounting machine is needed now and that a survey is
being made to determine ii the purchase of th e other tt�D would save time, labor,
and money. Gommissior�r Roberts moved on the recommendation of the C�ty Manager
that he be authorized to obtain bids on these c�achines with the understanding
that the quesLion of buying them will come up later. Metion was seconded by
Commissioner Watkins and carried unanin�ots7.y.
The Manager reported that NIr, H. M. Turnburke of Turnburke, Brock and Raines,
audi�ors for the City,,had asked that a statement be submi�ted to the Commission
in reply to the criti�`sui of e� the Turnburke firm by a local graap which was
quoted in the Clearwater Sun severaJ. months ago. The s�atement appears in the
followin� pages of these m�nutes and by reference is made a part hereof. NIr.
Turnburke requested thati this stateu�nt bs apg•ov�ed by the Commission ar�d be

granted and that the firm be sent a copy of �he minutes showirl� the Commission's

The Manager presented a recommer�.ation that �he CitS• adopt the same
holidays as the local ban�:s -- Juiy 4th, Labor Day, Thanksgiving, Chi�i.stmas

of Ieaving out Armistice Bay and Niemorial Day. Commissioner Strang moved that

The i�iayor announced that the City took an interest in the purchase of land
created by accretion south of $ayside �5 by the developers from the Internal
Tmprovement Board and the City Engineer had recorrunended that a bulkhead be
reqizired to prevent further accretion. Mr. H. H. Baskin, Sr., speaking for
W. D. Owans and others, the developers, reported that the applic�.tion for a deed
from the I. I. Board was a technical matter in order to obta3n £ac��e insurance
to the land. He said that the developers were meeting the requirements of the
Stat� Road Board as to free right of way for the approach to the proposed bridge.
He suggested that i.Y.e Sate R�ad Degartment may move the channel to the south as
the elevation of the bridge and grade would require it. The Mayor.stated that
',:he City was interested in is�o things -- the final location an�' stabrlization of
tY�e channe� and the traffic sit.uation that will be caused by the prop�sed bridge,
and t hat the Citp Ysa s nev-er been consulted on the locati on o f the brid&e or any
of its �ppurtenances. Commissioner Btrang suggested a joint meeting betweer
representatives of tihe State Road Department, ti� developer s of Bayside #5
and the Commisszon. Commissianer Strang moved that the Com�ission go on record
as instructing trie City P4anager to notify the State Road Department that this
matc.er is going to be discussed at next Monday's meeting and that the Comraission

AllbrittonYad made a survey and estimated cost o.f acquiring such propertp and
the proposed total cost accoxding to his estimate was a grsat deal hi�her than
the cost estimat,�d by the Merchants kssociation. He suggested referring the
matter back to the Pnerchants Association. Commissioner Watkins moved that the
City Manager be ins�tructed to get in to�ach with the Presiden� o£ the Mercharts
Associ�?.tion, discuss the matter with him and a'sk for their help again. Motion
was seconded by Comnissi�ner Roberts and cdrried unanimously,

add�� to the Pension Plan which would call for an amendment to the Employees

suggested �etting an actuarial survey on this plan and also on the Firemen's
Pensian Plan, Commissioner Roberts movAd that the City Manager be instructed
to submit the employees pension p�.ans to one or more reputable actuaries to get
a report as to just what the City has, hota sound it is actuarially, and what would
be the ultim�te result projectiing it into the years, and ask fer recommendations
as to just wh��t type and plan should be adopLed. Pnotion was secorded by

Pinellas County Commission to either, approve or disapprove by resolution the
conversion of Old ^lampa Bay north of Courtney Campbell Causeway into a fresh
wafier lake, The Attorney stated that a Cor,miiti:ee from the Chamber of C:ommerce
had been actively investigating i;he propo�l and suggested that the Commission
request a report from the CY:airman of that Committee. Commissioner Watkins
moved that the matter be placed on the next i�Ionday's agenda and that the Chairman
of the Ghamt�er of Cnmmerce Cor�ittee be asked to come up to present the case as

1'he P�Ianager stated he had baen directed by the Commission to have parking
meters installed on CourL Street in the area between the two railroads. He
repor�ed that an enginaer from the �rking metzr company had �ubmi�ted a layout
for meters to be installed over a period of time as there would be a lower cost
�ier meter by ordering a greater number. The Niaaza�er presenteda map showing the
layout of the proposed meters. By cor_sent, the ma��e�rwas deferred to next

A report w�s presented frocn the Citq En�ineer concerning the resurfacing work
on t�re North East Clevelarld which stated that the wcark had been completed, �at it
was done under the supervision of the Citq Engineer and acco rding t o i he specifications
for bhe job which specifications were taken from the State Road Department
specifications. Commissioner UJatkins �ommented that he still thought �t was a
poor job and needed rolling or something to make the surface mor� even. By consent,

D�veloper� of Is1and Estates'� be deferred as some of the represen�atives
of that organization were still out of town. By consent, the Commission
agreed �o this.
In accordance with a request of t132 Commission, the City Attor�ey reported
that he had studied a copy of a proposea legislative act being sponsored by the
Flo�.ida Planning and Zoning Association and fountl that if such an act• was passed
by �he Fl,orida Legislature ic would revise a good part of the City Charter and
many of the Gityfs special acts. He said the Associatior_Ts position was that
it was an enabling act which, if adcpted, as gen eral law, wou�d make available
to the various municiFalities the right toaiopt pn�tions of it, He recommended
that sinee this proposed act had r.ot been introduced in the Legislature that
no endorsement be macle until it was introducsd. Commissioner Watkins moved
that the maLter be tabled until the act is tintroduced into the Legislatur�.

that since cognplaints had been received from i�Ir. George Butcller, taiant in Room l�
of the I�arir.a Building, about some apparent conflict between his lease and iVir.
Gregory's l.ease, that i�Ir. Butcher should be h�a�d before renewal of the lease �vas
approved. T4r. Brown asked vlr. E. A. Fierson, former holder of the lease ori Room
9, to speak concerning Lhe rig.H�z to sell film. Mr. Pierson stated that he had
discussed the �atter cvith Nir. F. C, i+Iiddlet�n, f�rmer City Manager, and had then
contacted Messrs. David Hand and George Butcher and rec�zved verbal permission
frora them to sall film. iuIr. Butcher commented the verbal agreement was on a
month to morith oasis and was not t,ransi'erable to another tanant. NIr, John W.
Rowe, appearing for ;4r. 3uteher, reported tnat Ms. Wm. Lemke, foimer holder of
the lease on Room 4, had been given permission to sell film and other items of

Department had made a mistake in the descr�ption so a revised deed was necessary.

has been pexforming the audi�vark of the Gi.ty for a number of years past
on a continuou� audit basis. Shortly t hereafter the City en�aged t he
na� ionally known public accoiznting �i rm of Pri ce Wat erhouse and Comp3ny
to m�ke an examination of the �ityTs finan.cial ''records for its fiscal
year ended June 3�, 1956, although Turnburke, Brock and Raines were then
in tihe process of completing their own audit of Lhe same ��s�al year.
'tUpon examination of the Price Waterhou se audit report and compax:ison with
tne audit report of Turnburke, Broc:� and Raines it �aas found that the
f inancial pa sitio n of & he City as at June 30, 1956 in all o� its seventBen
iunds as staLed in the Lwo reports was identical, except for the accrual
by Pric� Waternouse as aL that flate i� the Utilit y Revenue Fund af eertain
items of inaou�e and expense which were treated as July� 19,56 transactions
by the City and by Tnrnburke, Bro�k and Raines in the interests of consis�ent
accounting treatment, from year to year. The net result of these accruals
