at, t.he City Hall, Monday, April 15, 1957, at. 1:.30 P.M. with the following

The Mayor called the meeting to crder. The invocati on ~as given by the
Reverend C. C. Martin of Friendship Methodi st Church, Clearwater. Conm1ssioner
Roberts moved that the Dinutes of the special meeting of March 25~h and the
rQgular meeting of April 1st be approved in accordance with copies furnished
each member in Writing. Motion was seconded by Commissioner Insco and carried
unanimaaly.
Police Chief Dribben presented eight policemen who had just compleued a
t.wo 't,eek training course. The Mayor complimented the Pollce Chief' on behalf
of the City € or the fi ne work done in this lira i ning schoo 1.
'rhe Mayor announced t.he continuation ot tl'e Public Hearing on the request
of Mr. G. C. Eldridge and ot.hers tor BU3iness usage (to erect a shopping center)
on the Ei of the NW~ of the SE! and part of the NWi ot the NW~ of the SEi,
Section 13 -29-15 (located between G\1lf' to Bay Boulevard and Druid RG,sd west of
Bamboo Subdivision). The 11~nager read the Planning Board's letter which
recommended ~hat the project be disapproved unless the following features
were included in the plan insofar as t.raffic and planning were concerned:

An objection was read from. l-h-s. Anna May Smit h, owner of Lot 11, Bamboo Sud-
diviSion. Mr. Lloyd Phillips, attorney for Mr. Eldridge, offered to cooperate
with tm Planning Board and the Seate Road Department. in handling the traffic
problem. Mr. R. L. Eaker, owner of Lot 16, Block 1, Druid Park, objected to
the proposed Business use o~ the property. ~. F. R. Colo, Mr. Hu~ Baker,
Mr. Victor Nylen, Mr. J. W. Lester. SrQ, Mr. and Mrs. Lester, III, Mm. W. H.
Richards, Mrs. Fred Griffin, and other affected p~perty owners objected to
the granting or the applic at-ion. It was suggested t.hat possibl, this area
\"as 1:,00 large to be considered a hardship case. It was pointed out that the
applicants could put their buildings \IIithin the present Bui5iness zone and
use the adjoining R-l areCf'south to Druid Road f'bl7 pirking according to
Ordinance 627, the ZoningOrdinan~e. The Mayor suggested appointing a Committee
of the property owners to study the si tuati on and endeavor to work out a
compromise or t,he problem with the develO}:e rs of the proposed shopping cent.ar.
Upon receiving the approval of t he Commission, the Mayor appoint.ed the following
Comm1~'tee: Mr. R. L. Baker, Chairman, Mr. Hugh Baker, Mr. J. W. Lester ,III,
and ~'. Victor Nylen. Commissioner Watkins moved that the Public Hearing be
continued until April 29t.h, at 1:30 F..J(. Motion was seconded by Commissioner

The Manager 1n a written report stated t.hat. Mr. Chester McMullen, Jr.,
had asked that the City-ownen property on Tampa Bay north of Court.ney Campbell
Causeway, formerly used as a Negro Beach Park operated by the Bt.a'te but now
abandoned, be sold back to his t'amily. It was tte Manager's r ecommendati. on
that. the Cit;y "retain t.his pro perty at le ast until after a master plan is
ado.pt.ed. Commissioner Serang moved the: Manager's report be accepted and the
request, be denied. Motion was seconded by Commissionef Roberts and carried

$660.00) be deferred for consideration in ~he next. fiscal budget. Commissioner
Strang moved t.hat the Manag~r's report. be accepted ani t.hat it be considered for
the next budg--.et and that. Mr. Mylander be so fiotificd. Mot.ion was sec:onded by
Commissioner Roberts and carried unanimously. May~ Homer did not vote.
Commissioner Insco re l1nquished tre Chair to Mayor Homer.
In connection wi t.h t.lhe repaving of Haven Street after installation of the
storm sewer t.he Marager asked for authority to settle the bill of $3,70.3.06 from
W. D. Owens Constr\.C~ion Company for $750.00, the cost of 600 square yards of
paving mat. erials, a s that was ~ all the City bad agreed to pay. Co mInis sioner
St.rang moved the Manager's report be accepted ard that he be authorized to
settle this bill with the construction company fOr $750.00 which is the City's
total obligation. Motion was seconded by Commissioner Roberts a.ni carried
unanimously.
It was reported by the Manager 'tm't an off stree't parking lot was available
next. 1;0 the City Englneer's office for lease at $35.00 per month. He recoJ1JJ1ended
the leasing of this lot. on a month 'to month basis for the use of Cit.y employees
and also for ci'tizens doing business with those City agencies located in the
Briggs Building at 415 am 417 Garden:... Commissioner Roberts moved on recommendation
of the City Manager 'tha't the Commission alL horize the leaung of 'this piece
of property for a parking lot for $35.00 a month and that. t,he recessary funds
be transferred to provide this amount. for the balance of the present fiscal year.
Mot.iam was seconded by Commissiorer Serang and carried unanimously.
Commissioner Strang reported t.hat the Mana~er had asked him to work with
Recreational Direct.'Q'ltt' Eddie Moore in check ing some Cit;y -owned property next t.o
the Negro S\iimming Pool between the ballpark and the foo'tball field near the
COl~er of Russell and Ho~t Street.. He sta'ted it would be possible to loeaae a
bui~ding there for a recrea~ional center as the one the City is renting now on
North Greenwood Avenue is inadequate. He estimated that the City could secure
a prefabricat.ed metal building, 50 x 60 feet, wit h a co ncrete floor and
necessary plumbing for about ~8,OOO.00. He said he had not t.alked with the
Library Board members but it was felt that this was not tt~ proper location
:for a library. He indicat.ed th~re was about $8,000.00 left in one of the City's
escrow funds (Clearwa1ier Athletic Field Insur8l1ce Fund). Too Mayor inquired
if it could be built wi~h block sides and metal ends and:itwas suggested that
bids could be taken both ways. Commissioner Roberts moved that this project
be approved by the Commission and that tl's Engineering Department be instructed
to prepare plans and specificat.ions ,on bo'th types, of all metal and part
concrete block and metal, that it be put out. for ~ids as soon as possible
and that t:bmmissioner Strang be commended for his work on this project. Motion
was seconded by Commissioner Watkins and carried unanimously.
'fhe Manager presented for approval a copy of t he amended contract with the
Houston Texas Gas and Oil Corporation and explained that it was amended ~n
accordance wi'th the requiremant.s 01: th e Federal Power Commission. The Cl:ty
Attorney explained the various changes in t he ex> ntrac t. Mr. John Y. Hunter,
vice-president of the City Fuel Oil Company, ouestioned SOll2 of'the provisions
of the contract, but after an explamat.ion by t he Mayor that the City was losing
money on its gas utilitrf a,nd that conversi on to natural gas may put it on a
more profitable basis, he withdrew his objecti ons in the hope that the~~ would
be a more market.able utility to sell in the future as he believed that... City
should not be in the gas business. COIlll'lissiomr Robert.s moved that the proper
City officials be author ized to execute this amended contract with the Houston
Texas Gas and Oil Corpora'tion dated Apri 1 15, 1957. Mot.ion was seconded by
Commissioner Strang ani carried unanimously..
The Manager reported that. two bids had been received for 186 lineal f&et
of concrete bulkhead at. the west end of Jeffords Street and that the lowest
bid was .3,933.90 which was approximately $1,300.00 more than the Engineer's
estimate; therefore, the Manager recommended that all bids be re~ected and
authorization be gi~v.en to re-advertise. Commissioner Roberts moved that
all bids be re jected and authon. zation be given to re-advertis e tor bids.
Motion was seconded by Commissioner Strang and carried unanimously.
It was x'ecoumended by the MaftAger that the low bid of $;a,085.00 from
McCain Uniform Company, BirmingQam, Alabama, be accepted for summer uniforms
for the Police Department. He st.ated tha't the Plymol.1th Rock Shirt Company sub-
mit.ted the lowest bid on shir~s only, $495.00, but as this one item bid was
only $3.22 lower t.han th e shirt price quoted in the ]c)\t'1est averall bid,
acceptance uas not being recommended. Commissioner Watkins moved upon the
recommendation of t.he Police Chief, the Purchasing Agent and the City Manager
that the bid of McCain Uniform Company in the amount of $2,085.00 be accepted

The Manager ,recommended accepting the lowest bid of ~1,687.24 from Graybar
Electric Supply vompany, St. Petersburg, to supply fluorescent lighting
fixtures for the Library Annex Building. It was explained that this amount
would be covered by the t~,044.00 work order. approved for repairs and improve-
ments to the Library Annex. Commissioner Insco moved that the low bid of
.~6g7.24 from Gra,bar Electric Supply be accepted and that the proper officials
be authorized to execute the con~r~ct. Motion was seconded by Commissioner
Watkins arid carried unanimously.
Tba Mayor explained that. it will be necessary on several occasions to send
~he qity Attorney and possibly others to Tallahasseee in connection with tho
City ~ legislative progran. The Manager recommended approval of such expenditures.
Commfssioner Roberts moved that the City Mana ger and t.he City 'l'reasurer be
authorized to approve travel expenses for the City Attorney, the Mayor and/or
any of the Commissioners to go to 'j,'allahassee in connection with the City's
legislative program. Motion was seconded by Commissioner Insco and carried
una ni~ou s ly.
'i'he Manager presented a request for authorization to dispose of a City-
owned boat at the Marina assigned "Co the Police Department for rescue work.
It was reported that it \'IC1l1d cost t~a2.00 to put the boat in good condition,
and since the various departments concerned feel the boat is too small for any
purpose within their jurisdiction, it 'Was necommerlded that. the boat and its
tmiler be sold by advertising ror bids. Commissioner Insco suggested the Parks
Department might use it at Crest Lake Park. Commissioner Watkins moved that
unless the Parks Department can find some use for the boat that the ~~na~er be
authorized to advertise for bids on it. Motion was seconded by Commissioner
Insco and carried unanimously.
Resolution 57-2Q which would req1lired nine property owners to have their
lots cleaned of weeds and underbrush::was presented by the Manager. Commissioner
Strang moved that Resoluti on 57-20 be passed and act> pted and t he proper officials
be authorized to sign it. Motion was seconded by Commissior..er Insco and caITied
unanimous ly.
The At-to mey read on it-s third readi rig Ordinance 733 which would make
illegal t he offense of failing to have vehicles under control. Commissioner
Insco moved that Ordinance 733 be passed on its third and final reading and
adop~ed and t.hat. the proper officials be authorized to e:xecute it. Motion
was seconded by Commissioner Watkins and carried unanimously.
'fhe City Attorney presented Resolution 57-21 which ~ould assess the cost
of construc~9.~ of paving and curb in Hobart Street from approximately 115 feet
south of the A line of Pinewood Stre et to t he no rth 1 ine 01' Dre\ri Street against
the benefited properties. Commissione r Roberts moved that Resolution 57-21
assessing proper't,y owners for Hobart Street improvements be passed and the
proper officials be authorized 'to sign it. Motion was seconded by Commissioner
Watkins and carried unanimously.
The Attorney presented Resoluti on 57-22 which \'Iould vacate an eighteen
foot alley on the \~est side of Bay Height s Subdivision. He explained that the
Cit y had been made a paJ1ty to a suit which was brought by certain pro perty
owners to establish the property lin es in this area and in order to make
everyone concerned have the right amoun~ of land eighteen feet of prope rty
was ne eded. Mr. 111m. Nodine, at torney, explained that the Circuit Conrt
Judge had suggested t.he possibility or havin~ the City vac ate this eighteen
foot alley. The City Attorney stated that he and the Clty Engineer recommended
it be vacat.ed. Commissioner Watkins moved that Resolution 57-22 be adopted and
in addition t.hat the City Attorney be authorized to enter into a consent decree
in the case of Groves versus Williams. Motion was seconded by Commissioner
Roberts and carried unanimous ly.
The City Attorney reported that the Clearwater Woman's Club was request1~g
a ten year extension to its lease in order to continue its use of the building
in Seminole Park. Commissioner Insco moved the approval of the extension
agreement between t.he City and t. he Woman's Club of Clear16ter, Incorporated,
dated April 9, 1957, and that the prop~r officials be authorized to execute the
same. Motion \'Ias seconded by Comnissione r Watkins and carried unanimously. The
Manager suggested that in any future contracts 'Where the City leases property
to an orgainzation for excwsiwe use and gives permission to rent out in part,
that the organization should pay current expenses such as utility cost, '
mirior repai'i's and t he portion of the insuran ce that t he City la s to carTY on that
building.
The Attorney presented a proposed ~e.asement and agreement between Gso~ge
Hostetter, Jean Yeager and the City granting an easement for sewer line through
a portion of Block M, Skycresc Terrace 2nd Addbion, to serve a proposed bowling
alley locat.ed abouc 600 feet outside the City limits. It was recoDlnended by
the Commission t.ha~ an agreement be obtained to supply water to this property
also and tbat a sewer tapping :fee and a wat er tapping "ree be charged. By
consent, the ma'Lter was returned to the City Manager to oonfer with the parties
concerned regarding the necessary cont.racts.

The Manager reported that the City had received a statement for i~,370.00
from Hammond Iron Works for extra work on the water tank constructed on Clearwater
Beach caused by a change of j.'t~ftnt.y feet in the elevat.ion. Commissioner Watkins
moved that the bill for $4,370.00 be paid from the Const.ruct.ion Trust Fund.
Motion was seconded by Commissioner Roberts and carried unanimously.
It was reported by the Attorney that the City mad been askedvto approve
an assignment of the lease on Room 7 in ~he Marina Building BEom Mr. John B.
Pierson to Mr. Roy J. Fullmer to continue its present use as an agency for
Ni~a Massage. The Manager approved the assignment. Conmissioner Roberts moved
approval of the assignment of the lease covering Room ? in the Marina Building.

The City Attorney reported that he had been informed that a bill had
been introduc~ed in the Florida Legislat.ure ~hich would have t.he effect of re-
st.ricting t.he maximum dut,y hours of firemen to a 56 hour week except in emer-
gencies in municipalitieswith a population over 15,000. He reported Ite had
prepared a telegram ~o the members of the legislative delegation, to the
Chairman9f t.he Committee on Municipal Affairs and to the League of Municipalit.ies
st.ating t.hat t.he City of Clearwater is opposed to such a bill. He requested
appro va 1 to se nd a telegram in the name of t he Mayor and t.he Ci ty Commissioner s.
Commissioner W'atk ins moved t.hat. the City Attorney be authorized to send S1ch a
telegram. Mot.ion was seconded by Conunissioner Strang aoo carried unanimously.
The City Engineer reported that the develo]:ers,6f'" Island Estates had
requested that the Cownission approve tentatively the zoning ~brr pant of their
proposed development so that their Engineers can continue their work. The
Commission took no action as the plan submitted was too snall to see clearly bu~
t.he Commission did designate to the City Engineer the approximate location of'
the proposed disposal plant and the land needed by the Cit.y. Commissioner
Insco recommended t.hat tm developers be required to go through the same
procedure as ~o~her developers of new subdivisions by presenting a proper plat .~,
and having it approved by the Engi neer, the Att.orney and t.he Manager before
being presented to the Co~nission. Commissioner Roberts pointed out t.hat the
C1 ty should secure an agreement in writing from the developers as to f il.ling
in the land for the Ci~y, the providing of' access roads, construction of t.he
decelerat.ion lane, et-c. It was the Manager's report that the requirements for
a new subdivision had not been fulf'illed. Commissioner Watkins moved that the
Comnission tak e no action untiil the requirement. s have been fulfilled satisfactory

plans for t.he fire stat-ion at Drew Street and Weber Road be instructed to re-
design the station to nave two pieces of equipment and proceed so the City can
go ahead and est.ablish the station in t.he east end of tCl'll'l and be authorized
to put it out. for bids as soon as possible. Mot.ion was seconded by Commissioner

Navajo Park Assoc iation had repairted t.he st one monument s in the City ~rkways

should be given a vote of thanks. Commissioner Strang moved that a letter of thanHs
be sent from tbe Cit.y commending them f'or this action. Motion was seconded by
Commissioner Roberts and carried unanimously.
Mayor Homer suggested that a lett.er of commendat~on be ~ritten t.o Mr.
Aubrey Ort for the excellent job of light ing engineering that ~as done at the

Landscaped buffer zones, tweD~y-five (25) feet wide, are to be
provided along t he north and soQj;h boundaries of the Slopping
Center and are to be main'ta1ned by the operators or own~r.o of" ~he
Shopping Genter in such a manner a s to beautify but. not obstruct
the vi.sion of the traveling public in the area. In ot-her words,
the hazards of inflow and outflow traffic from or to Gulf-to-Bay
Boulevard and Druid Road are to be minimized.
4. The owne rs should be required to dedicate a sixty (60) .foot
street right-of-way in a north-south direction along the we sterly
boundary of t1'E platted property for the purpose of connecting the
full sixty (60) foot dedicated wid the of Rogers and Turner Streets..

5. The dedication of sufficien~ right-o~-way along the entire south
boundary of the property will be required to eff'eet the lIidening
of Druid Road to a width of fif'ty (50) feet from the center line;
this is in accordance witih t l'E Highway Plan "M R 1" adopted by the
Cit.y of Clearwat.er.
It will be noted that the foregoin~ recommerxiatiions partain primarily
t;o traff'ic problems. It is recognized that there is the import.ant ma~ter of
non-conf"orming use of the propert.y. Recommeniations concerning this part# of
the problem ha va been submitted by the Zoning Board and, therefore, no co mmonts
are made thereto.

WHEREAS, after public hearing on t he let day of August, 1955,' the
City CODlllission of the City of Clearwater, Florida, determined that certain,
work and improvements hereinafter described should be done and made; and,
WHEREAS. pursuant thereto said improvemen~s have been made
Construct a pavement and curb in Hobart Street from approximately
One Hundred and Fif'teen (115) feet. "'South of the South line of "
Pinewood Street to the North line of Drew Street.
The proper-tie 5 facing and abutting these improvements are

same are hereby accepted and appro ved as havting been completed.
2. 'fhat the following described properties facing and a butt-ingand
in the vicinity of the aforesaid improvements are :.hereby deemed to have been

Police Chief Dribben presented eight policemen who had just completied a
two week training course. The i�layor complimented tY�e Police Chief on behalf
of the City for the fine work dcne in this Lraining school.
`Phe Mayor announced the continuation of tl� Public Hearing on tY�e request
of Mr. G. C. Eldrid e and ot hers for Business usage (to erect a s hopping cent er)
on the E� of the NW� of the SE� and p�t of the ATW� of the NW4 of the SE�,
Ssction T3-z9-7.5 (located between Gulf to B2y Boulevard and Drui3 Road west of
Bamboo Subdiaisi�n), Ths Manager read t he Planning Board�s letter which
recommended that the project be disa�proved unless the follov�ing features
were included in t he plan inso�'ar as traffic and planning were concernec'i:
�. Provision for vehieular entranc� and exit shc uld be restricted to one
limited access at both �ul£-to-Bay Boulevard and Druid with appropriate
decelerat ion lanes.
2. That a ten foat landsc�ped buffer zor� be provided on t he e�st.
3. 7'o provide landscaped buffer zones, twenty-�'ive feet wide on �he north
and south boundaries.
�.. To require a dedication of a sixty foot rig ht of way in a north-south
direction aiong the westerly boundary of t he platted pro p�rty to connect
the sixty fc�ot dedicated widths of Rogers and Turner S reet s.
5. Dedication of sufiicient right of wap along the soutY; �ioundary to widen
Druid Road to fifty feet from the center line.
An objec�ion was read from NIrs. Anna May Smiih, owner of Lot », Baynboo Sud-
3ivision. Mr. Lloyd Phillips, attorney for Mr. Eldridge, o�fered to cooperate
with the Pl�nning Board and the S�ate Road Department in handling -the traff�c
problem. NTr. R. L. Baker,, ownes of Lot 16, Block �, Druid Fark , objectzd to
the proposed Business use of the property. Mr, F. R, Colo, Nir. Hu� Baker,
iKr. Victor Nylen, Mr. J. [�1. Lester, Sr., Mr. and Mrs. Lesier, III, Mzs. W. H.
Richards, Mrs. �ed Grfifin, and othFJ• affected property owners objected to
the granting of tho application. It was suggested that possibl� this area
was too large to be �unsidereci a hardship case. It was pointed out that the
applicants could put their buildings within the present Business zone and
use the adjoining R-1 are south to Druid Road fb� parking according to
Ordinance 6;z�, � he Zoning�Ordinance� The Mayor s uggested appointing a Committee
of the property owners to stuc3y the situation and endeavor to work out a
compromise of the problem with L he developers of the proposed shopping center.
Upon receivin� the approval of t he Commission, the Mayor appointed the iollowing
ComraiLtes: Mr. R. L, Baker, Chai rman, Mr. Hugh Baker, Mr. J. W. Lester,III,
and Mr. Victor Nylen. Co�missioner k�atkins moved that the PubZic Hearing be

The Manager in a written i�eport stated that Mr. Chester I�lcl�fullen, Jr.,
had asked that the City-ownei3 property on Tampa Bay north of Courtney Campbell
Causeway, formeriy used as a Negro Beach Park operated bp the �tate but no�v
abandoned, be so�d back to his family. It was the Manager's recommendation
thaL t he City ,retain this pro perty at le ast un�il after a master plan is

af the next item as he was an affeci:ed prope.rty owner. The Manager reported in
writing the receipt of a petition from Mr. E. L. Mylander and t hirty-nine other
persons asking the construction of permanent steps on Mango Street at the seawall
on the Gul.f side. The Manager recommended that tk� request (estimated cost
�p660.00� be deferrsd for consideration in the next fisaal budget. Corrmtissioner
Strang moved that the Manager's report be acc2pteci and that it be considered for
the next budg,�t and that Mr. Mylander be so fioti£i�d. Motion was seconded by
Commissioner Roberts and carr�ied unanimously. �Iajrgr Homer did not vote.

In connection wi.*�h the re�ving of Haven Street after installatian of the
storm sewer the iviar�ger �sked for authoritSr L•o settle the bill of $�3, �03.06 from
W, D. Owens Gonstruction Company for $p75Q.00, the cost of 600 squar e yards of
paving materials, as that ea"s' all the Gity }iad agreed to pay. Conunissioner
Strang moved the Managerfs report be accepted arxi that he be authorized to
settle this bill with the construction company �or �75G.00 which is the City�s
total obligation. Motion was seconded by Commissioner Roberts and carried
unanimously.
It was reported by the iKanagar t1�1: an off street parking lot was available
next to the City En�ineer's office for lease at �35•Q� pe�' month. He recor�mended
the leasing of this lot on a month to month basis for tha use of City employees
and also for citizens doing business with those City agencies located in the
Briggs Building at �.15 and l+17 �arden� . Co�mi�sioner Roberts moved on recommend3tion
of the City �anager that the Commis,ion a�Ywrize the leas�.ng of this pieae
of Froperty for a parking lot for �35.00 a month and that the re cessary fuz�ds
be transferred to provide this amount for the balance of the present �'iscal year.
Motimn was seconded by Commissio�r Strang and carried unanimously.
Commissioner Strang reportEd zh.at the Manager had asked hiui to work with
Recreational Dirsc�cmr Eddie Moor�e in checking sorae Cizy-owned property next to
the Negrq Swimming Pool betwesn the ballpark and the footba7.1 fi�Id near the
corner of Russell and Holt Street. He stated it would be possible to loca�e a
bui�ding ihere for a recrea-�ional center as the onz the City is renting now on
North GreenFvood Avenue is inadequate. He estimatsd tihat the City could secure
a prefabricated metal building, 50 x b0 feet , wit h a co ncrete floor and
necessary plumbing for about �$,000.00. He said he had not talked with the
Library Board members but �:z was felt that this was not the proper location
fQr a library. He indicaLed there was about ;�$,000.00 left in one of the City°s
escrow funds (Clearwater Athletic Field Insurance Fund), Tl� Mayor inquired
if it cou�d be built with block sides and r�e�tal ends anditwas sug�ested that
bids co��ld be taken both ways. Commissioner Roberts motied that this project
be approved by the Commission and that the Engineering Department be instructed
to prepare plans and specifications _on both types, of all metal and part
concrete block and uetal, that it be put out for 23ids as soon as possible
and that �bmmissioner Strang be commended for his work on thzs project. Pdotion
was seccnded by Commissioner Watkins and carried unanimously.
The Manager presented for approval a copy of the amended contract wi�h the
HousLon Texas Gas and Oil Corporation arri explained that it was araended in
accordance with the requirements of th e Federal Power Commission. The C�ty
Attorney explained the various changes in the ooni;ract. Mr. John Y. I�unter,
vice-president of the City Fuel Oil Company, questioned some of the provisions
of the contract, but after an explanation by the Mayor that the City was losing
money on its gas utilitx and that conversion to natural gas may put it on a
more profitable basisa he withdrew his objections in the hope that the�,r�e would
be a more marketable uLility to sell in the iuture as he believed that„�i�y
should not be in the gas b-¢sine ss. Comnissi or�e r Roberts moved that t he proper
City afficials be authar�ized to execute this amended contrac� with the Houston
Texas Gas and Oil Carporation clated April 15, 1957, Motionwas seconc3ed by

The Nanager reported that two bids had been received for 1$6 lineal f.eet
of concrete bulkhead at the wesb end of Jeffords Street and that the lowest
bid was �3,933.90 which was approximately �p1,300.00 more than the Engineer�s
estimate; there%re, the Manager recommended that all bids be rejected and
authorization be gi�`�en to re-advertisa. Commissioner Roberts moved that
all bids be re jected and authori zation be gi�en to re-advertise for bids.
�Iotion was seconded by Commissioner Strang and carried unanimously.
It was recoam�ended by the Ma�ger that the low bid of ��,0$S.OQ froan
NicCain Uniform �ompany, Birmingham, Alabama, be accepted for summer uniforms
for th e Polic e Department. He stated that the Plymouth Rock Shirb Company sub-
mitted the lowest bid on shirts �nly, �y.��.QO, but as this one item bid �as
only �3.22 lower th�n the shirt price quoted in the ]owest mverall bid,
acceptance was not bein� recommend�d. Co�missioner Watkins moved upon the
recommendation of the Police Chief, th� Purchasing Agent and the City �anagar
that the bid of I�IcCain Uni�orm Comp3ny in the amount of �2, 0$,5.00 be accepted

The Mayor explained thaL it will be necessary on several occas5.ons tc� send

authoriaed to approve travel expenses for the City Attorney, th� MayTor and/or
any of the Coimnisaioners to go to Tallahassee in connection with the City�s

owned boat a� Lhe i�tarina assi�ned to tlie Police Department for resr.ue �ork.
It was reported th�t it w�ld cast �f�22.00 to put the b�at in good condition,
and since the various departments concerned feel the boat is too small for any
purpose with�p their jurisdiction, ii �as xecommended that the boat and its
trailEr be sold by advertising ior bzds. Commissior�r Insco sugoested the Pa.rks
De�ar�ment might use it at Grest La�e Park. Gommissioner Watkins moved that
unless the Parks lle�artment can find some use for the boat i:hat the f�ianager be
authorized to advertise for bids on it. Motion was seconded by Commissioner
Insco and carried unanimously.
Resolution 5%-2A which would required nine property owners to have their
lots cleaned oi weeds and underbrush:was presented by the Mana�er. Com�issioner
S�rang mov�ed that Resolution 5']-20 be passed and adopted and the proper officials
be authori�ed to sign it. Motion was seconded by Commissioner Insco and carried
unanimous ly.
The Attorney read on its third reading Ordinance 73� which would make
illegal the �ffense af failing to have vehicles under control. Commissioner
Insco moved i;hat Ordinance 733 be passed on its third and final readinp and
adapi.ed and that the proper officials be authorized ia execute it. Motior_.
was seconded by Coffinissioner Watkins and carried unanimously,
'Phe Cit}� Attoxney presented Resolution 57-21 which would assess the cost
of construct�i g� o£ p�ving and curb in Hobart Street from approxiu�tely 115 feet
south of the�line of Pinewood Street to the north line of Drew Street against
the benefit€;d properties. Gommissioner Roberts moved that Resol`ution 5%-21
assessing propertg owners for Hobart Stxeet improvements be passed ar.d the
proper officials be authorized Lo sign it, Motion v�as secondecl by Cowmissioner

^lhe Attorney p.resented Resolution 57-22 which would vacate an eighteen
foot alley nn the west side of Bay Heights Subdivision. He explained that the
City had been made a przuty to a suit which was brought by certain property
owners to establish the property lines in this area and in order to make
everyone concerned have the right amouni of land ei�hteen feet of proper'-;�
was needed. idr. d�tm. Nodir�, attorney, e�plained that the Circuit Goxtrt
Judge had suggssted the possibility of having the City vacate this �ighteen
foot alley. The City Attorn�y stated that he and the City Enginser recommended
it be vacated. Cor�nissioner �hTatkins moved that ResoZution 57-22 be adopted and
in addition that �he City �#ttorney be authorized to enter into a consent decree
in Lhe case of Groves versus �'�illiams, iKotion was seconded by �ommissioner
Roberts and carried unanimouslp.
The Gity Attorney reparted that the Clearwater I�domanrs Club was requesting
a ten qear extension to its lease in order to continue its use of the buildino
in Seminole Park. Commissioner Insco moved the approval of the extension ,
a�reemenL between the City and t he Woman°s Club of Clearwater, Incorporeted,
dated April 9, 1957, and that the proper officials be authorized to execute �,.he
same. Motion was seconded by Commissioner Watkins and carried unanimousl,y. The
Manager suggested that in any future contracts where the City leases property
to an orgainzation for exdusise use and gives permission to rent out zn part,
that the organization should pay current expenses such as utiliiy ��st,
minor repa'r'rs and the porcion of the insurance that the City h�s tn carry on that
building.
The Attorney presented a proposed �easeraent and agreement betv�een GEo�ge
Hostetter, Jean Ys3ger and tkze City granting an easement for sewer �ine through
a po.rtion of Block id, Skycrest Terrac� �nd Adc£�ion, to serve a propased bowling
all�ey located about 600 feet outside the City limiLs. It �vas recor�nnended by
the Commission that ar� agreement be obtained to su�ply water to this property
also and that a set�er tapping fee and a water tapping fes be charged. By
con=�ent, the matter was returned to the Cit3 Manager to confer with the parties
concerned regarding the necessary contracts.

from Hammond Iron Works for extra work on the water tank constructed on Clearwater
Beach caused by a change,of ':tw�nty feet in the elevation. Commissioner Watkins
moved that the bi11 for �1�,�70.00 be paid from the Cons�cruc�ion Trust Fund.
Motion was seconded by Commissioner Roberts and carried unanimousl}�.
It was reported 'oy the Attorn ey that tha Ci�y had been asked to approve
an assi�nment of the lease on Room 7 in the Marina Building �r,om Mr. John B.
Pierson to Mr. Roy J. Flxllmer to continue its present use as an agency f or
ATia �ra yiassage. Th� Manager approved the assignnent. Commissioner Roberts moved
appx`oval af the as�ignr�ent of the lease covering Room '] in the Nlarina Building,
under the same terms and conditions as the oriainal lease, to Mr. Roy 3. Fullmer
and authoriaa.ng tine proper officials to execute the same. Motion was seconded
by Gorumissioner Stran� and carried unanimously.
The City Attorney reported that the City �vas being sued by Mr. Herbert
Fields and asked authorization to defend the su�ti, Commissioner RTatkins moved
that the City Attorney be aui;horized �nd directed to file appropriate answer.s and
defend the in�erestis af all concerned therein. Motion was seconded by
Commissioner Sirang and carried unanimously.
The City Attorney reported that he had been informed that a bill haa
been irtroduc�ted in the Flerida Legislature which would ha�re the effect oi' re-
sLr?�tin� the maximum duty hours o� firemen to a 56 ho� week except in emer-
ge�cies ir. municipaliti�sw;z�:,�a a population over 15,000. He reported he had
prepared a telegram to the members of the legislative de�egation, t.o tlie
Chairmanqf the Cammittee on �Iunicipai A.ffairs and to the League oi Municipalities
st�tin� that the City oi Clearwater is apposed to such a bi ll. He re quested
approval to send a telegram in ihe name of t he Mayor and the City Commissioners.
Commis�ioner Watkins moved thai the Qity Attorney be authorized to s endsuch a
telegram. P�totion was secon�ied by 4ocunissioner Stran� and carried unanimously.
The City Engineer reparted that the developer.6f Island Estates had
requested that the Commission approve tent atively the zoning ��� � pa�t of their
proposed development so thati their En�ineers can continue their work. The
Commission took no action as the plan submitted was t�o snalZ to see clearly but
the Commission did designate to the City �ngineer the apps� ximate loca�ion Gf
th2 proFosed disposal plant and the land needed by the City. Co�r,missioner
Insc� reco�nended that the develo�rs be required to go through the same
proced�sre as :oLher developers of new subdivisions by presenting a proper plat ,
and having it approved by the En�ineer, the Atborney and th:: i�anager before
being presented to the Comcnission. Cousnissioner Roberts pointed out that the
City should secure an agreement in writir� .from ths developers as t o f illing
in the land for the Cit}�, the prcviding of aecess roads, construction of the
deceleration lane, etc. It was the Mar�gerts report that the requirements for
a new subdivision Yaad i�at been fulfilled. Commissioner Watkins moved �hat the

Corrmissioner Roberts moved that the City Engineer be instructed to take

tihe pumping or the filling is within the authorization and that the Commission �
request � progress re�ort once a month pessibly on the e�cter_t of the same
project £rom the Pine�$as County Water and Navigation Board. Moti on was seconded

Commissioner Insco moved Lhat Mr. Horace Hamlin, Jro, who drew the
plans ior the fire staLion at Drew Street and �9eber Road be instructed to re-
design the station to have two pieces of equi�ment and proceed so the City can
go ahead and establish the station in Lhe east end of tavn and be authorized
ta put it out �'or bids as soon as possible. Motion was seConded by Commi�sioner
hoberts �nd carried unanimously.
Commissioner Insco repoxt ed that i:he Marymont Civic Association and the�
Navajo Park AsFeciation had repairted the stone monuments in the City p�rkways
which identif ied tho� particular subdivisions arnl c o�nented that the organizations
should be given a vote of thar�ks. Commissioner Strang moved that a lei;ter of thant�s
be sent from the City commenciing them for this acbion. Motion was seconded by
Commissioner Roberts and c arried unanimously.
I�layor Homer suggested thaL a letter o£ commendation be written to Mr,
Aubrey Ort for the excell.ent job of li�hting en�ineering that was dQne at the

In regard to the reccmmendation of Yrof�ssor P. Brunn to shorten the scope
of ��tt1e Pass by lengi;hening the causeway portion of the propos�d bricige, the
Mayor raporbed •that the SL•ate Road De�rtment had informed him �;hat they wou�3
have to ha�ve more information from Professor Brunn. He staL-ed thE City Had
received a letter from Dr. Brunn stating it would cost between �$,OOO.QO and
7V9,000.00 to do the further engineering required. He reported that he had
contacted the State Road Board and found that the Engineer of the State Road
Board is very mu�:h opposed Co L-his proposalYaving had a bad situation at
Matanzas Pass on the East Coast with the same t;�pe of program and a hurricane
washed out the causeway. The Mayor recommende� that the City drop t he subjecC
and go ahead with the origiral pro ject for the dredging that the City En�ineer
and Lhe U, S. Army Corps of En�j.neers are working on. Commissioner Strang.
moved that the r eport be accepted, Motion was seconded b y Commissioner
Watkins and carried unanimously.
The Nayor reported that he nad been asked to make an investigation on a
beach for the negro people in Clearwater and this area of Florida on behalf
of the Commission since the beach north of CQ��a�ey Campbell Causeway has been
discontinued because the siingarees in ,he water made it tinaccept,�ble for
�swimming; he recomrnended after making an extensive investigation and contacting
the 5tate �:oad Board the creation of a beach in the area on both side�f
�ourtney Cambell Causeway between the two bridpes if the City of Tamp agrees
with the proposal. Commissioner Insco moved that the Mayor Ue instructed to
work on this project as a Committes from the Commission and to meet wi�h the
Mayor of '1`ampa and report back to the Commission. �Iotion w�s seconded by
Cocomissioner Waticins arrl carried unanimously.

Pvrsuant to your ingtructions, the Planning Board has investigated and
ana�:yzed the feasihility o�' Lhe proposed Shopping C�nter as 'indicated on the
plet plan att ached herewiths dated January 17, 1957, prepared by Southeastern
Enoineering Compnay. In addition to the ana�y�is of this plan, a conference
was hel� with represent atives of the developers.
Based on the plot plan and on t he facts submitted by t he developers, we
beg to report disapproval of this �roject as presen:�ly plan�ed, The objections
of t he Planning Board can, howeaer, be overcome and upon incorporation of the
following features�. we would be inclined te approve the plot plan insofar as
traiffic and planning are concer�ed:
l. Provision for vehicular entrance and exit of the general public or
customer should be restric�ed to one limited access at both Gulf-to--
B3y Boulevard and Druid Road and appropriate deceleration lanas will
be required. Similar provision will be re�aired £or the proposed
service ar�a'i.ndicated on the pZot plan.
