Having held a duly constituted public hearing and since, based on the material submitted by the applicant, good cause has been shown, Mr. Regulski moved to grant the request with the provision that the building permit be obtained within si~ (6) months of this date. Mr. Gans seconded the motion which carried unanimously. Item #2 - Otha Hansford for a variance to erect a 6 ft fence in building setback area abutting CR 102 on Lot 17, Block B, Northwood Estates Tract F, located at 2887 Deer Run S and zoned RS 60 (single family). The Building Official reported the applicant appeared before the Board on 2/14/80 and was granted a setback variance for the house but not for the fence height. The Planning Official reported the closest 6 ft fence on the north side of CR 102 is approximately 700 ft east of this site. A condition of subdivision approval on the south side of CR 102 was that the developer provide a post and rail fence with continuous ligustrum planting. A proposed change to the zoning code would permit a fence up to 4 ft.in height in areas such as this. Joseph Cottle, Building Cont~actor representing the ap- plicant, stated a wooden fence is needed because there is a pool and the family needs privacy and protection from intru- ders. The double frontage lot creates the need for a variance. In response to a question, he stated there are no new condi- tions present since the previous hearing, but at that time they were much more interested in obtaining the variance for construction of the house and didn't push the request for the fence.. It was their feeling the fence would be no problem at a future date since 6 ft fences do exist in the area. No one spoke in opposi~ion. Having held a duly constituted public hearing and since, based on the material submitted by the applicant, there are practical difficulties 9r u~necessary hardships in complying with the code, Mr. Gans moved to grant the request subject to said fence being set back not less than three feet from the property line with an access gate for maintenance purposes and the finished side facing out, and a planting plan being sub- mitted for approval by the Building and Planning Departments, with the pr9vision that the building permit be obtained within six (6) months : from this date. .Mr. Regulslci seconded the motion. . . .
