there are practical difficulties or unnecessary hardships in
the way of carrying out the strict letter of the provisions of
the zoning ordinance as it affects such property and that the
same can be varied in harmony with the general purposes and
intent of the zoning ordinance, Mr. House moved that such
~ appeal be granted in accordance with the application submitted
\WI therewith, with the provision that said fence be set back not
less than three feet from the property line with an access
gate for maintenance purposes and the finished side facing
out, and that a planting plan be submitted for approval by
the Building and Planning Departments, and with the further
provision that the right to obtain a building permit in
accordance with such variances shall cease after six (6)
months from this date. Mr. Gans seconded the motion.
Upon the vote being taken, Messrs. House, Gans and
Regulski voted "Aye"; Messrs. Donnell and Morris voted "Nay.1I
Request granted.
ITEM #6 - Request of Enterprise Properties for setback
variances to construct an office bUilding.
The Building Official reported the areas for \ihich
these variances are being requested abut an existing parking
lot.
The Planning Official noted there is more parking pro-
vided than required by the Code, and suggested any parking
beyond Code requirements should either be deleted or pro-
vided in a permeable surface.
Emil C. Marquardt, Jr. t attorney' representing the appli-
cant, reported both Family Mart and U.S, Home, adjoining
property owners, have expressed approval of the site plan and
their proposed landscaping. The additional parking is being
provided at the request of the prospective building occupant.
Ingress and egress for this site, through the Family Mart
property, was approved at the time approval was given for the
Family ~fart Site Plan--the object being to limit the number
of cuts into Enterprise Road, There will be no adverse
effects on adjoining property o\mers by the granting of these
variances. He displayed a drawing showing a small green
space to the north of this site which provides a buffer.
One of the conditions included in the sales agreement re-
stricts usage to offices only.
Upon consideration of the appeal of Enterprise Properties
~ from the decision of the Building Official concerning the
requests foT. side and rear setback variances to construct an
office building upon 0.536 acres MOL in the northeast quarter
of Section 31~28-16, which property is located approximately
.250 feet east of U. S. 19, south of Family Mart and nOl'th of
Bn~erprise Road and is zoned CP (parkway business), it
