Upon consideration of the appeal of John Sinclaire
from the decision of the Building Official concerning the
request for a variance to erect a 6-foot fence in building
setback area abutting Landmark Drive upon Lot 101, Landmark
Woods Second Addition, ''Ihich property is located at 2898
Greenmeadow Court and is zoned RS-SO (Single-family residen-
tial), it appearing, after this duly constituted public
hearing, that there are not such practical difficulties or
unnecessary hardships in the way of carrying out the strict
letter of the provisions of the zoning ordinance as it affects
such property as would justify a variance of such provisions
and that the same cannot be varied in harmony with the gen-
oral purpose and intent of the zoning ordinance, Nr. Gans
moved that such appeal be denied. Mr. Regulski seconded
the motion ,...hich carried unanimously.
The appl icant ,...as advised of his right to appeal to the
City Commission within ten (lO) days.
ITEM #6 - Request of Alex Plisko, Jr. for a special excep-
tion and a variance.
Alex Plisko, Jr. stated he needs the special exception
and setback variance in order to provide additional living
area. The proposed addition would retain the character of
the house.
No one spoke in opposition.
Upon consideration of the appeal of Alex Plisko, Jr.
from the decision of the Building Official concerning a
special exception to erect an addition to single-family
dwell ing an the south 1/2 of Lot 3, Block 4, Starr and Save ry' s
Addition, which property is located at 706 Oak Avenue and is
zoned IDf-28 (High density multi-family), it appearing, after
this duly constituted public hearing, that the proposed use
is consistent with the general zoning plan and with the
public interest, Mr. Regulski moved that said appeal be granted
in accordance with the application submitted therewith, with
the provision that the right to obtain a use permit in accord-
ance with said special exception shall cease after six (6)
months from this date. Mr. House seconded the motion which
carried unanimously.
Upon consideration of the appeal of Alex Pliska, Jr. from
the decision of the Building Official concerning the request
for a side setback variance ~o make structural alterations to
existing single-family dwelling upon the property described

ITEM #8 - Request of Fincher Construction Company for a
fence variance.
The Building Official reported the application h&s been
approved by the Engineering Department subject to installation
of a l2-foot gate for maintenance purposes with the gate to be
located near the head wall.
The Planning Official suggested the Doard establish uni-
formity along Enterprise Road.
Charles Fincher stated this is his home and he has spent
over $2,500.00 reshaping and improving the retention pond.
The fence is needed for privacy and security reasons as this
is a busy intersection.
No one spoke in opposition.
Upon consideration of the appeal of Fincher Construction
Company from the decision of the Building Official concerning
the request for a variance to erect a 6-foot fence in building
setba.ck area abutting Enterprise Road upon Lot 13, Block I,
Northwood Estates, Tract F, which property is located at
2977 Deer Run South and is zoned RS-60 (Single-family residen-
tial), it appearing, after this duly constituted public hear-
in& that there are practical difficulties or unnecessary hard-
ships in the way of carrying out the strict letter of the
provisions of the zoning ordinance as it affects such property
and that the same can be varied in harmony with the general
purposes and intent of the zoning ordinance, ~Ir. Gans moved
that such appeal be granted in accordance with the applica-
tion submi tted therel~i th, ld th the provis ion that said fence
be set back not less than three feet from the property line
l~i th the finished side facing Enterprise Road; that a 12 - foot
access gate be installed for maintenance purposes in the rear
fence section; that a planting plan be submitted for approval
by the Building and Planning Departments; such approval to
be consistent with, but not limited hy, the criteria s,et
forth in Section 33.09 of the Zoning' Ordinance , with parti-
cular attention to Paragraph (4) (b), and l~ith the further
provision that the right to obtain a buildinn permit in
accordance with such variance shall cease after six (6) months
from this date. Nr. Regulskisecondcd the motion which
carried unanimously.
MINUTES - The Chairman picsentcd the minutes of the
meeting of October 11, 1979, for consideration. Hearing no
objection, he declared the minutes approved in accordance 1'Iith
copies submitted to each Board member in writing.
