William Gilkey, Attorney, stated the residence was under construction before the setback error was discovered and an undue hardship and burden would be placed upon the applicant if the wall had to be torn down. Service Corp. from the decision of the Building Official concerning the re- quest for a variance to allow construction of a residence with a 24.35 ft. setback upon Lot 19, Block F, Northwood Estates, Tract C, which property is located at corner of Burntfork and Brandywine Drive and is zoned RS-60 (single family), it appear- ing, after this duly constituted public hearing, that there are practical difficulties or unnecessary hardships in the way of carrying out the strict letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied in harmony with the general purposes and intent of the zoning ordinance, Mr. House moved that such appeal be granted in accordance with the application submitted therewith, with the provision that the right to obtain a building permit in accordance with such variance shall cease after six (6) months from this date. Mr. Morris seconded the motion which carried unanimously. ITEM #3 - Request of Phase I Homes for a variance to construct a building. The Planning Official stated Commission had approved the site plan for this construction on August 3, 1978, subject to consideration of variance by this Board. Ralph Hanson, Jr., representative, stated they would re- tain as many of the trees as possible and the buildings would complement the neighborhood. George Platt stated the side setback conforms with the existing structure. The Building Official pointed out that the parking spaces referred to by the applicant are non-conforming inasmuch as they are on City right-of-way and require backout into the right-of-way. Applicant stated the only space he had for off-street parking would require destruction of considerable landscaping. six letters in support of the request were read into the record. No one spoke in opposition.
