ITEM #2- Request of C.F.S. Service Corp. for a variance
to construct a residence.
William Gilkey, Attorney, stated the residence was under
construction before the setback error was discovered and an
undue hardship and burden would be placed upon the applicant
if the wall had to be torn down. The lot fronts on three streets.

Upon consideration of the appeal of C.F.S. Service Corp.
from the decision of the Building Official concerning the re-
quest for a variance to allow construction of a residence with
a 24.35 ft. setback upon Lot 19, Block F, Northwood Estates,
Tract C, which property is located at corner of Burntfork and
Brandywine Drive and is zoned RS-60 (single family), it appear-
ing, after this duly constituted public hearing, that there are
practical difficulties or unnecessary hardships in the way of
carrying out the strict letter of the provisions of the zoning
ordinance as it affects such property and that the same can be
varied in harmony with the general purposes and intent of the
zoning ordinance, Mr. House moved that such appeal be granted
in accordance with the application submitted therewith, with
the provision that the right to obtain a building permit in
accordance with such variance shall cease after six (6) months
from this date. Mr. Morris seconded the motion which carried
unanimously.
ITEM #3 - Request of Phase I Homes for a variance to
construct a building.
The Planning Official stated Commission had approved the
site plan for this construction on August 3, 1978, subject to
consideration of variance by this Board.
Ralph Hanson, Jr., representative, stated they would re-
tain as many of the trees as possible and the buildings
would complement the neighborhood. Only 14 units will be con-
.structed instead of the 25 units permitted and all parki.ng will
:be on the upper slope.

ITEM #5 - Request of George Platt for a variance to con-
struct second story to existing building and variance for
off-street parking spaces.
George Platt stated the side setback conforms with the
existing structure.
The Building Official pointed out that the parking spaces
referred to by the applicant are non-conforming inasmuch as
they are on City right-of-way and require backout into the
right-of-way. Applicant stated the only space he had for
off-street parking would require destruction of considerable
landscaping.

79, Mandalay Unit 5, which property is located at 606 Bay
Esplanade and is zoned CTF (commercial tourist facilities) it
appearing, after this duly constituted public hearing, that
there are practical difficulties or unnecessary hardships in
the way of carrying out the strict letter of the provisions of
the zoning ordinance as it affects such property and that the
same can be varied in harmony with the general purposes and in-
tent of the zoning ordinance, Mr. House moved that such appeal
be granted in accordance with the application submitted there-
with, with the provision that the right to obtain a building
permit in accordance with such variance shall cease after six
(6) months from this date. Mr. Morris seconded the motion
which carried unanimously.

for a special exception to construct addition to existing docks,

Tom Harris, contractor, stated the catwalks will extend
30 feet and the new slips will have lifts of a type used in
residential areas.
No one spoke in objection.
Upon consideration of the appeal of Isle of Sand Key
Condominium Association, Inc. from the decision of the Build-
ing Official concerning a special exception to allow construc-"
tion of an addition to existing docks, Type A, and catwalks 'on
Isle of Sand Key Condo #1 which property is located at 1621
Gulf Boulevard and i.s zoned RM-28 (high density mUlti-family),
it appearing, after this duly constituted public hearing, that
the proposed use is consistent with the general zoning plan
and with the public interest, Mr. Gans moved that said appeal
be granted in accordance with the application submitted there-
witfi, with the provision that the right to obtain a building
permit in accordance with said special exception shall cease
after six (6) months from this date. Mr. Morris seconded the
motion which carried unanimously.
MINUTES - The thairman presented the minutes of the meet-
ing of July 27, 1978, for consideration. Hearing no objection,
he declared the minutes approved in accordance with copies '
submitted to each board member in writing.
The Chairman announced the next meeting will convene at
3 p.m.
There being no further business, the meeting was adjourned
at 5:15 p.m.
