ITEM 02 - The request of U.S. Home Corporation Clear-
water East Division. for a setback variance.
The Planning Official reported the existing location of
the home was established by the builder and it is on an ir-
regular corner lot.

Fred Markert, representative. reported U.S. Home Corpora-
tion built the home for speculation and the prospective buy-
ers requested addition of a swimming pool, which will not ob-
struct the view.

Upon consideration of the appeal of U.S. Home Corporation.
Clearwater East Division, from the decision of the Building
Official concerning the request for a variance to allow a 14-
foot setback from Countryside Boulevard to erect a pool and
enclosure on Lot 138. Clubhouse Estates of Countryside Unit
3 located at 2654 Augusta Drive North and is zoned RS-75
(single family residential), it appearing. after this duly
constituted public hearing, that there are practical diffi-
culties or unnecessary hardships in the way of carrying out
the strict letter of the provisions of the zoning ordinance
as it affects such property and that the same can be varied
in harmony with the general purposes and intent of the zoning
ordinance. Mr. Gans moved that such appeal be granted in ac-
cordance with the application submitted therewith, with the
provision that the right to obtain a building permit in ac-
cordance with such variance shall cease after six (b) months
from this date. Mr. Donnell seconded the motion. Upon the
vote being taken, Messrs. House, Donnell and Gans voted' UAy'e";,
Messrs, Morris and Nichols voted UNay.u Motion carr1.ed.
ITEM #3 - The request of George Catanzaro for a special
exception to expand an existing auto repair business.

The Planning Official reported the present existing es-
tablishment is not entirely enclosed 8S required. and he dis-
cussed the requirements of Section 35.U9. subparagraph 7. as
they apply to this special exception. He also reported the
request is not consistent with the downtown plan for that
area.

George Catanzaro stated he would have a garage door open-
ing on Cleveland Street and he wanted to utilize all of the
property he owns.

Five citizens spoke in opposition and a letter of opposi-
"tion from the Clearwater> Down town Development Board was read
into the record.
Mr. Ca~anzaro reported the front entrance on Cleveland
Street would not be used as a general practice but only fo~
extra large vehicles.

Upon consideration of the appeal of George Catanzaro
from the decision of the Building Official concerning a

(general business). it appearing, after this duly constituted
public hearing. that the proposed use ia not consistent with

the motion which carried unanimously.

ITEM #4 - The request of J. Scott Kennedy for a fence
variance.
The Planning Official reported the applicant is request-
ing a 42-inch height variance and recommended the Board
consider the need for a 6-foot fence.
H. R. Baskin. Jr.. Attorney. reported the City had re-
moved a fence that had been in place for a number of years.
After removal of this fence Mr. Kennedy had no privacy and
wants to replace what has been removed. Juniper Street is
not a through street but is a 60-foot public right-of-way to
the beach from Eldorado Avenue.
J. Scott Kennedy stated he needed a 6-foot

frontage lot and rend into the record. Supplementary Re-
gulations. Section 30.02, Setback Regulation, Subparagraph
(3). If this lot had been subject to such deed or plat re-
strictions. the only requirement would be six (6) feet from
the rear lot line in an RM-12 zone.
Everett McDowell stated he needed the variance to con-
struct a regulation-size pool.
