"::",\_~>.,... ," "',:. ft." .. ~ V Upon consideration of the appeal of Carl Fields' from the decision of the Building Official concerning his request for a variance to allow an 8-foot setback from the South lot line of Lot 12, Block A, Fair View Addition, which property is located at 25 North Evergraen Avenue and is zoned. RM-28 (high density, multi-family). it appearing, after this duly constituted public hearing, that there are not such practical difficulties or unnecessary hardships in the way of carrying out the strict letter of the provisions of the zoning ordinance as it affects such property as would justify a variance ~f such provisions and that the same cannot be varied in harmony with the general purpose and intent of the zoning ordinance. Mr. nouse moved that such appeal be denied. Mr. Donnell scconed the motion which carried unanimously. The applicant was advised of his right of appeal to the City Commission within ten (10) days. ITEM n 2 - The request of Antonios Tsouvelekakis and Frank Pappas to eliminate one loading area and four existing parking spaces to construct a storage addition in a CG (business)zone. @,~. {".'J "\'t," Antonios Tsouvelekakis stated two of his tenants require additional storage area. He cannot build a second story as the roof is not strong enough and proposes to put the additions on the rear. The parking area in the rear of this shopping center is not used extensively and there will be 20 feet between the addition and the property line which will allow traffic to pro- ceed. This is not a large shopping center and though it does not meet the requirements for number of parking spaces, there is sufficient parking in front. Dan Lehan, owner of the carpet store, spoke in support .of the request and stated he needed more storage area. No one spoke in opposition. Valery, Jr., for a for a 3-story dwelling in an RS-75 (single zone. r:J0. '0 The Board was advised Mr. Valery had appealed the decision of the Board of Adjustment and Appeal on Zoning to the City Commission but yaa denied at tbe May 4, 1978, meeting. Albert Valery stated he had revised his application and reduced the height and overhang. The overhang now complies with the zoning requirement and the height variance requested is 2 ft. 4 in. and to allow a 3-story building in lieu of the 2~-story permitted. Discussion ensued on the flood regulations Bnd the overall height of the house. Mr. Valery stated the other municipalities have adjusted their height restrictions since the flood regulations became law. He prefers a home with 2 floors of living area but cannot meet the 25-ft. height restriction. There will be no living area on the ground level. He presented three petitions with 41 signatures in support of his request. @.... .....t'. ".:....' Eight citizens spoke in opposition to the request and seven letters of opposition were presented by the Clerk. The Building Official confirmed that the side setbacks meet the requirements. In rebuttal, Mr. Valery stated there are a number of other 2-story homes on Island Estates and reported the Planning Depart- ment did not oppose the variance. e, Upon consideration of the appeal of Albert L. Valery, Jr. from the decision of the Building Official concerning the request for a 27-ft. 4~in. height in lieu of 25 ft. permitted to construct a 3-story dwelling on Lot 64, Island Estates Unit 7C which property is located at 824 Harbor Island and is zoned, RS-75 (Single family residential), it appearing, after this duly constituted public hearing, that there are not such practical difficulties or un- necessary hardships in the way of carrying out the strict letter of the provisions of the zoning ordinance as it affects such property as would justify a variance of such provisions and that the same cannot be varied in harmony with the general purpose and intent of the zoning ordinance, Mr. Donnell moved that such appeal be denied. Mr. Gans seconded the motion. Upon the vote being taken, Messrs, House, Donnell and Gans voted "Aye"; Messrs, Morris and Nichols voted "Nay." Motioned carried.
