Mr. Morris seconded the motion. Upon the vote being taken, Messrs. House, Donnell, Morris and Nichols voted "Aye": Mr. Youngstrom abstained from voting as he arrived after discussion of the item. ITEM #2 - The request of William R. Corum to erect a S-foot fence in an RS-SO (single family residential) zone that allows a 30-inch fence. The Chairman requested the Board consider a motion to hear this application aL 2 prior requests for a 6-foot fence had been denied by the Board of Adjustment and Appeal on Zoning and the City Commission. Discussion ensued and Mr. Donnell moved that the request for as-foot fence be heard. Mr. Youngstrom seconded the motion. Mr. Youngstrom moved to amend the motion to limit discussion to the 5-foot height and/or a change of location of the fence. Mr. Donnell accepted the amendment and the amended motion carried unanimously. william Corum stated a 30-inch fence would not accomplish his purpose. A fence is needed for privacy of the backyard and pool area and to screen a motor home and a boat from the neighborhood. There were 22 supporters of Mr. Corum's request. Nine letters of approval were received and petitions with 219 signa- tures, also supporting the request, were presented to the Clerk. Nine citizens spoke in support. Nine citizens spoke in opposition. The Chairman advised the citizens that Mr. Corum could move his fence back, retain the 6-foot height and be in compliance with the zoning ordinance or he could"remove it and the motor home and bpat would be exposed to the neighborhood if the re- quest is denied. Upon consideration of the appeal of Harry H. Hoffman from the decision of the Building Official concerning the request for a variance to allo\>l a 4-foot fence in the build- ing setabck area on the north side of Lot 15, Hallmark Subdi- vision, 1st Addition, which property is located on the northeast corner of Amble Lane and Long Street and is zoned RPD (residential planned development), it appearing, after this duly constituted public hearing, that there are practical difficulties or unnec- essary hardships in the way of carrying out the strict letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied in harmony with the general purposes and intent of the zoning ordinance, Mr. House moved that such appeal be granted in accordance with the appli- cation submitted therewith, with the provision that the right to obtain a building and fence permit in accordance with such variance shall cease after six (6) months from this date. Mr. Donnell seconded the motion which carried unanimously. ITEM #4 - The request of Daniel M. Macre for 33% lot coverage in an RS-50 (single family residential) zone that permits 25% lot coverage. The Building Official reported a variance had been granted in May, 1977, for 29.55% lot coverage. The Planning Official questioned whether there would be additional ground cover or impermeable surface coverage in addition to the building cover- age. Fred Melby, Architect, in response to the Planning Offi- cialls questions, reported, in addition to the house there is a deck on the Gulf side, a 20-foot driveway that extends under the house itself on the ground, a stairway and pilings. He presented a letter from the State of Florida Department of Natural Resources accepting revised preliminary plans. All setbacks will be maintained except the front yard setback which was approved at 10 feet at the time of the prior request. Two letters of opposition were read into the record.
