of carrying out the strict letter of the provisions of the
zoning ordinance as it affects such property and that the same
can be varied in harmony with the general purposes and intent
of the zoning ordinance, Mr. Youngstrom moved that such appeal
be granted in accordance with the application submitted there-
witli, with the provision that the proper City Officials resolve
the issue of the fence being in the street right-of-way, and
with the further provision that the right to obtain a building
permit in accordance with such variance shall cease after six
(6) months from this date, and with the further provision that
the fence be stained in harmony with the project. Mr. House
seconded the motion. Upon the vote being taken, Messrs. House,
Youngstrom and Nichols voted "Aye"; Messrs. Batstone and
Donnell voted "Nay.1I Motion carried.

ITEM #3 - The request of Philton Enterprises, Inc., .to
erect a pool cage enclosure with 7 foot setback from Eastland
Boulevard an Lot 18 and to erect a 6 foot fence adjacent to
lot line along Landmark Drive and Eastland Boulevard on Lots
17 and 18, Block F, Northwood Estates Tract C. Properties
front on Brandywine Drive with rear lines on Landmark Drive
and Eastland Boulevard and are zoned RS-60 (single family).
The applicant was not present and the Board took no
action.
New Business
The Acting Chairman suggested amending the special excep-
tion motion as the provision that the right to:obtain a
building permit is not always applicable, and the option "use
permit" be inserted.

Mr. Batstone moved to amend the form of motion for a spe-
cial exception to read, "with the provision that the right to
obtain a (building) (use) permit in accordance with said spe-
cial exception shall cease after six months from this date."
Mr. Youngstrom seconded the motion which carried unanimously.
The Board discussed unanimous votes, particularly cases of
denial where the Chairman does not agree with the other members
of the Board but fails to vote as the issue is decided. Mr.
Batstone suggested, in the case of denials, the Board be polled
for the vote. By unanimous consent, the Board agreed that any
member might request a roll call vote on an item.
MINUTES - The Chairman presented the minutes of the meeting
of January 12, 1978, for consideration. David Healey, Chief
Planner, requested two changes to the wording of the minutes in
Items 7 and 11 for the purpose of clarification of his state-
ments.
