after this duly constituted public heari~g, that there' are
practical difficulties or unnecessary hardships in the way of
carrying out the strict letter of the provisions o~ the zoning
ordinance as it affects such pr.operty and that the same can be
varied in harmony with the general purposes and intent of ..the
zoning ordinance, Mr. Nichols moved that such appeal be granted
in accordance with the application submitted therewith, with
the provision that the right to obtain a building permit in ac-
cordance with such variance shall cease 'after six (6) months
from this date. Mr. Youngstrom seconded the motion which car-
ried unanimously. '
ITEM #4 - The request of Clifford Love for a variance
to erect a carport.
David Healey, Planning Official, stated the application
is for a variance of a s!destreet setback established in a
residential planned development district. Major plan changes
require action by the City Commission but this is not considered
a major plan change.
In response to the Chair.man's questions, Syd Snair,
Building Official, stated the plan was approved overall but not
to individual homes. Most of the homes in the area do have
carports.

John Sessa, representative, stated the applicant had no
protection for his automobile. This duplex is on a corner lot
and discussion ensued on which street to have ingress and
egress.

Upon consideration of the appeal of Clifford Love frOm
the decision of the Building Official concerning the request
for a variance to allow a carport 10 feet from the property
line on Amble Lane on Lot 9, Sherwood Gardens, which property
is located at 1757 Sherwood street and is zoned RPD (residential
planned development), it appearing, after this duly constituted
public hearing, that there are practical difficulties or unneces-
sary hardships in the way of carrying out the strict letter of
the provisions of the zoning ordinance as it affects such proper-
ty and that the same can be varied in harmony with the general
purposes and intent of the zoning ordinance, Mr. Youngstrom
moved that such appeal be granted in accordance with the appli-
cation submitted therewith, with the provision that the right
to obtain a building permit in accordance with such variance

ITEM #5 - The request of Les Schmidt to operate a motor-
cycle repair shop.
David Healey, Planning Official, suggested the Board in-
clude a provision in the motion relating to the hours of opera-
tion as they pertain to the noise factor which will be generated
by such an establishment.
Tom Falicon, representative, stated most of his work con-
sists of machine boring, etc., but some would require the run-
ning of motors. His proposed hours of operation are from 8:30
a.m. to 9 p.m., Monday through Friday; 8:30 a.m. to 6 p.m.,
Saturday; and closed on Sunday.
Les Schmidt, owner of the property, stated when he pur-
chased the property it was a mini-shopping center composed of
seven stores, and one of those was a motorcycle repair shop.
He stated there would be a provision in the lease limiting
the hours of operation as they relate to the noise factor.

Eight letters of approval were presented and read into
the record.

Edna Dowda spoke in opposition to the noise late at
night on Bellevue Boulevard.
Upon consideration of the appeal of Les Schmidt from
the decision of the Building Official concerning a special
exception to operate a motorcycle repair shop on Lot 3, Block
A, Salls Second Addition, which is located at 1433 South Mis-
souri Avenue and is zoned CG (general business), it appearing,
after this duly constituted public hearing, that the proposed
use is consistent with the general zoning plan and with the
public interest, Mr. Nichols moved that said appeal be granted
in accordance with the application submitted therewith, with
the provision that the right to obtain a building permit in
accordance with said special exception shall cease after six
months from this date, with the further provision that the
hours of operation be from 8:30 a.m. to 9 p.m., Monday through
FridaY1 and 8:30 a.m. to 6 p.m., Saturday; and there be no
motorcycle noise after 6:30 p.m. Mr. Youngstrom seconded the
motion and requested an amendment to include that work be done
in enclosed premises. Mr. Nichols accepted the amendment.
,Upon the vote being taken, motion carried unanimously.

enrollment of possibly thirty pupils. There is sufficient
parking, the Fire Marshal has approved the plan and the City
Traffic Engineer has prepared a traffic plan. She presented a
Sketch showing entrance to the property on Greenwood Avenue
and exit from the property onto pine Street. Dropoff would
be in the rear behind the house.

Upon consideration of the appeal of the Sally B. Harris
Estate from the decision of the Building Official concerning
a special exception to operate a private school on Lots 1 to
5 inclusive, Block B-1, Maryland Subdivision, which property
is located at 611 South Greenwood Avenue and is zoned RM-28
(high-density, multi-family), it appearing, after this duly
constituted public hearing, that the proposed use is consis-
tent with the general zoning plan and with the public interest,
Mr. House moved that said appeal be granted in accordance with
the application submitted therewith, with the provision that
the right to obtain a building permit in accordance with said
special exception shall cease after six months from this date.
Mr. Nichols seconded the motion. Mr. Youngstrom suggested the
traffic plan be incorporated in the motion. Mr. House and Mr.
Nichols accepted the amendment. Mrs. Moore stated a hedge
would be planted along Greenwood Avenue. Upon the vote being
taken, motion carried unanimously.
ITEM #7 - The request of Joseph Carbonaro for a special
exception to build storage warehouses.
David Healey, Planning Official, reported the proposed
use is consistent with the CG zoning of the area at the present
time and is entitled to be heard on its merits under the present
classification. However, the character of the neighborhood is
residential and a study determined that it should be rezoned
RM-8, which would not permit the proposed warehouse units now
under consideration.
The City's Housing and Community Development Program ,has
targeted money and manpower for this neighborhood in the in-
, terest of residential preservation and improvement. Street,
sanitary sewer and drainage projects are scheduled to be
started in the area within 90 days.
The Board noted there are commercial businesses established
in the area.

Joseph Carbonaro, applicant, stated the area would be im-
proved by the storage warehouses. He has built others in the
Ci~y and they have created no noise problem. He presented
photos of the other warehouses to the Board and stated he would
, erect 'a fence and beautify the area to meet any requirements.
The buildings will be concrete. '
