Upon consideration of the appeal of Sunstyle Homes Corp. from the decision of the Building Official concerning the request for a variance to allow a 23 ft. setback from Radcliffe Dr. N. and Radcliffe Dr. E. and allow a 6 ft. wooden fence on lot lines along Montclair Rd. and N. Hercules Ave. on Lots 51 to 73 incl., Willow Ridge Replat, which property is located south of liontclair Rd. between Hastings Dr. and N. Hercules Ave. and is zoned RS-60 (single family), it appearing, after this duly constituted public hearing, that there are practical diffi- culties or unnecessary hardships in the way of carrying out the strict letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied in harmony with the general purposes and intent of the zoning ordinance, Mr. Donnell moved that such appeal be ~anted in accordance with the application submitted therewith, WJ.th the pI"ovision that the right to obtain a building permit in accordance with such vaI"iance shall cease after six (6) months from this date. MI". Youngstrom seconded the motion for purposes of discussion. Mr. House was not in favor of the fencing. Mr. Batstone suggested that a living fence be placed on the lot line with a regular wood or chain link fence on the inside of the-shrubbery or trees. Upon the vote being taken Messrs. Donnell and Youngstrom voted "Aye"; Messrs. House and Batstone voted "Nayll. Motion did not carry. After considerable discussion and the determination that they could consider each item separately, MI". Youngstrom moved to reconsideI" the motion on the matter. Mr. Donnell seconded the motion whieh carried unanimously. The applicant requested that if peI"missible that the two requests be considered and acted upon separately. ITEM #1 - Request for special exception for administrative office for Clearwater Garden Nursing Home. Mr. William Ward, Realtor, was present representing the applicant. He stated that Dr. John Barrett, Jr. was purchasing the property as there was not sufficient room in the nursing home for the offices and storage of records. Therefore he was also purchasing two 1 bedroom duplex units to the West of the nursing home in which he would use one for the administrative office and the other for the storage of records. There were no objections. Upon consideration of the appeal of John P. Barrett, Jr. from the decision of the Building Official concerning a special exception to allow adminis.trative offices in an existing duplex on the East 1/2 of Lots 1 and 2, Block A, Westover Sub., which property is located at 437-439 Pinellas St. and is zoned RM-28 (high density multi-family), it appearing, after this duly constituted public hearing, that the proposed use is consistent with the general zoning plan and with the public interest, Mr. House moved that said appeal be granted in accordance with the application submitted therewith, with the provision that the right to obtain a building permit in accordance with said special exception shall cease after six months from this date. Mr. Youngstrom seconded the motion which carried unanimoualy. The Chairman questioned whether all members present had received a letter relating to conflict of interest from the attorney's office.
