Nichols, Vice-Chairman Francis Donnell Uarold J. House Kurt E. Youngstrom Also present: Edwin Blanton, Building Director Jack,Wo1le, Planning Official MarybethLavallee, Assistant City Attorney The meeting was called.to order by the Chairman at 4 p.m. in the Commission meeting room in City Hall. The Chairman outlined the procedures to be followed and announced the re- quest of Howard C. Peterson for a variance. The BUilding Director reported the zonjng ordinance al- lows a 6 ft. fence but the applicant has requested a lO-ft. high fence on the perimeter of the tennis court which is near the seawall. ' Willinm Albrecht, representing the owner, stated n lO-ft. fence is necessary for a tennis court and the applicant will provide a landscape barrier between the property line and the proposed funce. There were no objections. e 'Upon consideration of the appeal of Howard C. Peterson, et a1, as Trustees for Fidelco Growth Investors, from the decision of the Building Official concerning the request for a variance to erect a fence with a minimum height of 10 feet around the tennis court at Island Point Condominium No.4, which property is located at 660 Island Way and is zoned CTF (commercial tourist facilities), it appearing after this duly constituted public hearing, that there are practical diffi- culties or unnecessary hardships in the way of carrying out the strict 1etter.of the provisions of the zoning ordinance as it affects such property and that the same can be varied in harmony with the general purposes and intent of the zoning 'ordinance, Mr. Nichols moved that such appeal be granted in accordance with the application submitted therewith, with the provision that the right to obtain a building permit in ~ J . . j'~ : . , " , ~$~;ii;r~,~si';;~,D!~i!i.:',~". ;;" .. .' There were no objections. Upon consideration of the appeal of John Stronski from the decision of the Building Official concerning the request for a variance to erect a residence exceeding maximum allowed lot coverage by 335 sq. ft. above the 1,875 sq. ft. permitted on Lot 14, Del Oro Heights, which property is located on the south side,of Arlie Avenue about 300 feet west of Bayshore Boulevard and is zoned RS-50 (single family), it appearing, after this duly conatituted public hearing, that there ore practical difficulties or unnessarY hardships in the way of carrying out the strict. letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied in harmony with the general purposes and intent of the zoning ordinance. Hr. Youngstrom moved that such appeal be ~ranted in accordance with the applicBtion submitted there- with, with the provision that the right to obtain a building permit in accordance with such variance shall cease after six (6) months from this date. Nickelson for a special exception. The Building Director reported construction of an addi- tion to a single family residence in an RM-28 zone is pe~mit- ted only as a apecial exception. This is an older section of Clearwater and most of the homes are single family residences. William Nickelson stated the addition will be within the required setback and will provide needed space for his family. He presented two letters of approval which were read into the record. There were no objectiono. e Upon consideration of the appeal of William A. Nickelson from the decision of the Building Official concerning a spe- c"ial exception to permit an addition to the residence on Lot 20 and the South 19 feet of Lot 19, Block A, Lakeview Heights Subdivision, which property Is located at 1330 Tioga Avenue and is zoned RM-28 (high density multi-family), it appearing, afcer this duly constituted public hearing~ that the proposed use Is consistent with the general zoning plan and with the public interest, Mr. Youngstrom moved that said appeal be granted in accordance with the application submitted therewith~ with the provision that the right to obtain a building permit ~:ly,\~'y(";:',;;.':.:~"',:!>,'!"',, " ,3.
