6 inch Isetback from property line to erect an ad-

The Building Official stated PS (professional services)
zoning requires a 10 foot setback. The addition proposed is to
be a storage building Bnd will be in line with the existing
building.
Frank Morris, architect representing Clearwater Profes-
sional Association, Inc., stated the building was to be
strictly for dead storage. There were no objections.
Upon consideration of the appeal of the Clearwater Profes-
sional Association, Inc., from the deciaion of the Building
Official concerning the request for a var~ance to allow a 6
inch setback frOB the property line to erect an addition in
line with present building on the following described property:
Begin 1704 ft. East and 33 ft. South of the Norchwest corner,
Section 23-29-15, run East 330.5 ft., South 209.38 ft., West
33 ft., South 12.69 ft., West 297.37 ft., North 220 ft. to
P.O.B., less drainage easement, which property is located on
the North side of Barry Road about 550 ft. east of South
Highland Avenue and is zoned PS (professional services), it
appearing after this duly constituted public hearing. that
there are practical difficulties or unnessary hardships in
the way of carrying out the strict letter of the provisions
of the zoning ordinance as it affects such property and that
the same can be varied in harmony with the general purposes
and intent of the zoning ordinance, Mr. Homer moved that such
appeal be granted in accordance with the application submit-
ted therewith, with the provision that the right to obtain
a building permit in accordance with such variance shall
cease after six months from this data. Mr. Youngstrom sec-
onded the motion~ Upon the vote being taken, Messr.s. Homer,
Youngstrom, Batstone and House voted "Aye"; Mr. Nichols voted
"Nay." Motion carried.
ITEM 14 ~ Request of Trinity Presbyterian Church for a
12 foot setback to erect an addition to the Church.

The Building Official stated the Church proposed to put
an addition between the sanctuary and the existing education
building, with a small court between. The Zoning Ordinance,
because of the height of the addition, dictates that the set-
back be 21 ft. 6 in.

shall cease after six months from this date. Mr. Homer sec-
onded the motion which carried unanimously.
MINUTES - The Chairman presented the minutes of the meet-
ing of December 15, 1976, for approval. Hearing no objftctionl,
he declared the minutes approved in accordance with copies
submittod to each Board member in writing.
The Chairman announced that the Board of Adjustment and
Appeal on Zoning viII hear appeals from applicants vho have
been denied tree removal permits under Ordinance ~l623. Sec-
tion 23.5-8 states:
"The Board shall adopt rules for the conduct of such hearing8
which rules shall uniformly apply to all such appeal~. Its
decision shall be reduced to writing and shall contain the
findings of facts based upon evidence produced at the hearing."
The Assistant City Attorney, Marybeth Lavallee, advi8ed
that these appeals do not have to be advertised.
Mr. Nichols moved that four (4) affirmative votes would
be necessary to override the decision of the City Manager and
the City Forester. Mr. Homer seconded the motion. Motion
carried unanimously.
Tbe Board requested the Clerk notify the Environmental
Planner, Mike Kenton, and City Forester, Patrick Tracy, to
be in attendance at the January 27, 1977, meeting when the
first such appeal will be heard.
Mr. Homer's term expires February 28, 1977, and he stated
he would not be desirous of running again as his real estate
business created too many conflicts of interest.
Mr. Wolle reported the Planning Department was working
aD an amendment to the Zoning Ordinance which would require
that any appeal from a Board of Adjustment and Appeals deci-
sion go directly to the courts instead of to the City Commi.-
sion and asked for a ,response from the Board as to whether or
not they favor such a procedure. The Board agreed to give an
opinion at the next meeting.

board, I make the following statement in regard to the above item:
Homer Realty, my company ,was the listing Realtor for
part of the 'property which Mr. Rogero of PAR Land Co. purchased
and I received the listing commission on this sale to the applicant

The only reason that I did not disqualify myself and
refrain from voting on'this item was the wri~en instructions
recently given board'members by the attorney on conflict of interest.
