The meeting was called to order by the Chairman at 4:00
p.m., in the Commission Meeting Room, City Hall.' The Chair-
man outlined the procedures to be followed and announced re-'
ceipt of a letter from Albert N. Justice for a continuance
of Item ~ the request of Jersey Jim Towers TV and Air Condi-
tioning, Inc., to ThurSday, October 14, 1976, at 4:00 p.m.
The Chairman read the letter into the record.
The first request was that of Matthew J. Stegner to
erect a 6 ft. high concrete block fence.
Building Official Edwin Blanton stated the applicant's
request is for a privacy fence for a swimming pool in his
rear yard, which would be in line with an adjoining property
owner's legal nonconforming fence.
Matthew Stegner was present and stated he planned a 3
or 4 ft. solid wall with decorative bricks in the top rows.
William Johnson and R. E. Caldwell stated they had no
objection. A letter of approval from John F. Dennis was
read into the record.

Upon consideration of the appeal of Matthew J. Stegner
from the decision of the Building Official concerning the
request for a variance to allow a 6 ft. high concrete block
fence 8 ft. from, the East property line on Lot 41, Grovewood
Subdivision, which property is located at 2310 Minneola Road,
and is zoned R8-75 (single family), it appearinB, after this
duly constituted public hearing, that there are practical
difficulties or unnecessary' hardships in the way of carrying

out the strict letter of the provisions of the zoning ordi-
nance as it affects such property and that the same can be
varied in harmony with the general purposes and intent of
the zoning ordinance, Mr. House moved that such appeal be
granted in accordance with the application submitted there-
with, with the provision that the right to obtain a building
permit in accordance with such varinnce shall cease after
six (6) months from this date. Mr. Youngstrom seconded the
motion. Mr. Nichols stated he felt a 6 ft. fence was too
high and swimming pools can b~ screened. Upon the vote being
taken, Messrs. Homer, House, Youngstrom and Batatone voted
"Aye"; Mr. Nichols voted "Nay." Motion carried.
ITEM 03 - Request of Bill Athanasiou for variance of
setbacks to build second-stury living quartere above exist-
ing motel.
The Building Official stated the zoning ~rdinRnce re-
quires a 15 ft. setback on the north property line and a 20
ft. setback on the south property line in an RM-28 ~one.
Charles Goldsmith, architect, representing the owner.
stated the owner now lives in a small portion of the exist-
ing motel, but with small children needs more room and hence
a second floor apartment unit is planned. He stated the
setbacks have changed since the original building was con-
structed, but the proposed addition will not exceed the
the existing setbacks.
Melvin Spence spoke in favor of the request.

Upon consideration of the appeal of Bill Athanasiou
from the decision of the Building Official concerning the
request for a variance to allow a 5 ft. setback on the ~orth
property line and a 9.8 ft. setback on the South property
line to build second story living quarters above existing
motel on the South 90 ft. of Lots 1 and 2, Replat of Lot 3.
Block B, Columbia Subdivision, which property is located at
229 Coronado Drive, and is zoned RM-28 (high density multi-
family), it appearing after this duly constituted p"h~ic
hearing, that there ~re practical difficulties or unnecessary
hardships in the way of carrying out the strict letter of the
provisions of the zoning ordinance as it affects such proper-
ty and that the same can be varied in harmony with the general
purposes and intent of the zoning ordinance, Mr. Homer moved
that such appeal be granted in accordance with the applica-
tion submitted therewith, with toe provision that the right
to obtain a building permit in accordance with auch variance
shall cease after six (6) months from this dote. Mr. Nichols
seconded the motion which carried unanimously.
