The meeting was called to order by the Vice-Chairman at
4:00 p.m. in the Commission Meeting Room, City lIall. He out-
lined the procedure and announced the request of Walter A.
Sheldon. etal.
Edwin Blanton. Building Director, stated the property
has been zoned RM-16 and the applicant has requested three
variances: 1. a three-story building instead of two, or
twenty-five feet in height as the ordinance proyidea; 2. eight
units in a row. instead of six; and 3. 43% efficiency apart-
ments instead of 25%. The Planning Department concurs in the
recommendation to approve this request.
Edmund Henderson, Henderson Investments Corporation, who
are the contractors and developers of this project of low~income
housing for the elderly, stated their plan had been approved by
HUD for a three-story bUilding and they had complied with the
many rules and regulations. There were no objections.

Upon consideration of the appeal of Walter A. Sheldon, etal
from the decision of the Building Official concerning the request
for n variance to erect a three-story building, in lieu of two-
story; eight units in a row in lieu of six; and about forty-three
percent efficiency units in lieu of twenty-five percent on the
following properti; NW corner of the NW 1/4 of the SW 1/4 of
Section 18-29-16, thence E 250 ft. more or less, S A46, ft. more
or less, W. 250 ft. more or less, N 446 ft. to P.O.ll. Property
is located about 300-ft. North of Druid Road and about 5~0
ft. East of ' DeIcher Road and is zoned RM-16 (medium density
multi-family) it appearing, after this duly constituted public
hearing, that there are practical difficulties or unnecessary

hardships in the way of carrying out the strict letter of the
provisions of the zoning ordinance as it affects such property
and that the same can be varied in harmony with the general
purpose~ and intent of the zonin8 ordinance, Mr. Hornor moved
that such appeal he Rranted in accordance with the application
submitted therewith, with the provisions that the right to ob-
tain a building permit in accordance with such variance shall
cease after six (6) months from this date, and with the further
provision that the three-story building not exceed 30 feet in
height, and with the further provision to include a mansard
roof as Was presented to the Board. Hr. Nichols seconded the
motion which carried unanimously.
ITEM '2 - The request of RUBBell Reith for a Variance.
C. N. Rice, Jr., of Rutenberg Van Horn Corporation, build-
ers of Van Horn Homes, represented the owner, and asked to
amend his application as they had reversed the plan for the
house and would only necd a 22 foot setback for the structure
on '~axwood Court. The application was amended to read: "Rc-
quest variance to allow 22 ft. setback to home wall from side
street". The owners are still up north but had requested the
garage be reversed to the other side of the house.
There were no objections.
Upon consideration of nppcal of RUBsell Reith from the
decision of the nuilding Officia1 concerning the request for
a variance to allow a 22 ft. setback from Waxwood Court to
erect a residence on Lot 5, Block n, Tract C, Northwood Estates.
Property is located on the SW corner o~ Cascade Drive and Uax-
wood Court and is zoned RS-60 (sinnIe family) it appearing,
after this duly constituted public hearing, that there are
practical difficulties or unnecessary hardships in the wny of
carrying out the strict letter of the provisions of the ~oning
ordinance as it affects such property and that the same can be
varied in harmony with the general purposes and intent of the
zoning ordinance, Mr. House moved that such appeal be granted
in accordance with the application, 8S amended, submitted there-
with, with the provision that th~ right to obtain a building
permit in accordance with such variance shall cease after six
(6) months from this date. Mr. llomer seconded the motion which
carried unanimously.

ITEM #3 - Request of Allan K. Wyllie for a special excep-
tion to allow Automotive repair ohop at 1337 N. Highland Avenue.
The Vice-Chairman announced that there had been an emer-
gency in the Wyllie family and they were unable to he present.
Mr. Homer moved to continue this item to August 12, 1976, at
4:00 p.m. without cost or additional fee to the applicant. Mr.
Nichols seconded the motion which carried unanimously.
