inclusive, Block 6, Revised Plat of Brookwood Terrace, which
property is located on the southeast corner of Cleveland Street
and Lady Mary ~ive and is zoned CG (general business), it
appearing, after this duly constituted public hearing, that
the proposed use is consistent with the general zoning plan
and with the public interest, Mr. Homer moved that said
appeal be granted sublect to the fOllowing provisions:
1. Right to obtain a building permit shall cease
6 months from this date. ,
2. All work is to be conducted entirely within an
enclosed building.
3. There is to be no automotive body repair work
conducted on the premises.
... All processes and storage except storage of vehi-
cles shall be in a completely enclosed building.
S. '1'he owner-applicants shall, at their expense,
install, provide and maintain appropriate fencing
at a minimum height of 6 feet along the West 'and
South boundaries of the subject property with
said fencing to be interspersed with shrubs and
trees.
6. That the applicant-owners to have prepared and
execute in recordable form SUbject to the approval
of the City of Clearwater Legal Department, a
written document providing that in the event
that the present owners or their succussors or
assigns do not within two years from the date
of issuance of the certificate of occupancy
for said building permit obtain and continue
to operate a new car franchise automotive deal-
ership on said premises that the right to con-
duct an automotive repair facility on said
premises as an approved special exception and
any City of Clearwater occupational
license to do so shall immediately cease and
terminate. The agreement to further provide
that it shall be binding on the present owners,
their successo~s and assigns, and all parties
deriving any title to the premises or the right
to the use and occupancy thereof by, through
or under them, and that the owner-applicants
will indemnify, protect and save the City harm-
less from all claims by anyone including
reasonable attorney's fees in connection with
said matter. Said agreement to be recorded in
the pUblic records of Pine11as County, Florida
prior to issuance of the building permit.
Mr. Carter seconded the motion, which carried unanimously.
ITEM '3 - Request of Argie McElmurry, architect, for 6 month
extension of waiver of waterfront vista setback on Lots 1, 10,
, South 80 ft. Lot 9, Hiller's Replat, vacated portion of Ambler
Street and begin Sou~heast corner of Tract A as shown on a
Resub of Blocks 10, 11 and Lots 2 to 15 incl., Block 9, of
