ITEM #2 - Request of Paul Cousins for 5 rt. setback from South
lot line of Lot 35, Island Estatos of Clearwater, Unit 5-A, to
erect replacement structure.
The BU11ding Director explained that this request had been
denied because the zoning ordinance requires a side setback of
20% of lot width on narrow parcela of waterfront property in CTF
(commercial~tourist facilities) zones. Mr. Paul Cousins, appli-
cant, explained the need for the new building, stated that con-
struction would require removal of an existing carport at this
location, and thab the new building would conform to the pres-
ent setback of the existing apartment on the south lot line.
There were no objections. Upon consideration of the appeal of
Paul Couains from the decision of the Building Official con-
cerning the request for a variance to allow a 5 ft. setback from
the south lot line of Lot 35, Island Estates of Olearwater~
Un1t; 5-A, which property is located at 201 Skirf Point and is
ZOned OTF (conuneI'cial-tourist facilities), it appearing" after
this duly constituted public hearing, that there are practical
difficulties or unnecessary hardShips in the way of carrying
out the strict letter of the provisions of the zoning ordinance
as it affects such property and that the same can be varied in
harmony ~dth the general purposes and intent of the zoning or-
dinance, r~. Nichols moved that such appeal be granted in ac-
cordance with the application submitted therewith, with the
proVision that the right to obtain a building permit in accord-
ance with such variance shall cease after six (6) months from
this date. Motion was seconded by Mr. Batstone and carried
unanimously.
ITEM #3 - Request of Vincent Kostreba for 5 'ft. 4 in. setback
from,East lot line~ 5 ft. 11 in. setback from West lot 1ine~
14 ~t. 11 in. setback rrom North lot line to outside of stairs
and waive off-street parking requirements to erect second floor
addition to existing building.
The Building Director described the building setback and
parking requirements for this property under RM-54A (high density
multi-family) zoning. Previous (April 12, 1973) Board action on
the Kostreba request was reviewed. Mr. Donald McFarland, appli-
cantls attorney" indicated acceptance of the setback restrictions
previously authorized and stated that parking limitation was now
the basic reason for the new application. Mr. Batstone summar-
ized the previous position that the Board had no authority to
