Tack & Warren Sub., which property is located at 805 Park Street
and zoned CG (business), it appearing, after this duly constituted
public hearing, that the proposed use is consistent with the
general zonin~ plan and with the public interest, Mr. Batstone
moved that sa1d appeal be granted in accordance with the
application submitted therewith, with the provision that tho
right to obtain a building permit in accordance with said
special exception shall cease after six months from this date.
Motion was seconded by Mr. Homer and carried unanimously.
ITEM #3 - Request of L. R. Weyand, Jr. The Building Director
reported that this was another special exception. Mr. Weyand
spoke of being in business for 15 years at the present location,
but purchase of this property forces a relocation of their
business. There were no objections. Upon consideration of the
appeal of L. R. Weyand, Jr. from the decision of the Building
Official concerning a special exception to allow operation of
wholesale produce business on West G ft. of Lot 5, all of Lots
6, 7, 8, 9, Block 8, E. H. Coachman Sub., located on North side
of Drew Street and South side of Jones Street about 250 ft.
West of North Myrtle Ave. adjacent to railroad right of way
and zoned CG (business), it appearing. after this duly consti-
tuted public hearing, that the proposed use, is consistent with
the gen~al zoning plan and with the public interest. Mr. Nichols
moved that said appeal be granted in accordance with the
application submitted therewith, with the provision that the
right to obtain a building permit in accordance with said special
exception shall cease after six months from this date. Motion
was seconded by Mr. Carter and carried unanimously.
ITEM #4 - Request of Vincent Kostreba. The Building Director
stated that this building was built some years ago meeting the
requirements for setback at that time. However, setbacks now
would require a 2St waterfront setback and 22.5 ft. on each side.
Mr. Kostreba and his architect, 11r. James F. Gleason, provided
additional details on the nature of the request. Discussion
followed. The Asst. City Attorney noted that the application
was silent on the matter of off-street parking and ruled that
the Board had no authority to grant parking on the public right-
of-way and also that the Board must restrict its immediate
consideration to the setback variances requested and stated
that approval of setbacks would not entitle the owner to proceed
with a building permit 'until the question of possible parking
variance had been resolved. Area residents, Randolph Hitchcock,
J. J. Flasco, and C. W. Musgrove spoke in objection and the
Clerk read a letter of similar intent addressed to the Board.
Upon consideration of the appeal of Vincent Kostreba from the
decision of the Building Official concerning the request for a
variance to allow 14 ft. 11 in~ setback from North Lot line,
and 5 ft. 4 in. and 5 ft. 11 in. setbacks from the East and West
