The application of' Kane Corporation of Florida was presented for
the construction of a limited service hospital or nursing home
with a five root setback from property line facing Jeffords
Street on the North go reet and the West 130 feet of the South
90 feet, Lot 30 Bluff View Subdivision. Mr. Wm. MacKenzie,
Attorney, representing the applicant, explained the proposed
building would be operated under a franchise from Medicenters
of America, Inc., an affiliate of Holiday Inns" Inc.; that the
Medicenter would be a limited service hospital with no surgical,
delivery or emergency rooms but would have a medical staff with
admission only by attending physicians. He also explained that
a requirement of Medicenters was that they be located within
three blocks of a general hospital and that the facility would
be inspected at least four times a year by the parent organiza-
tion and also would request accreditation the same as a regular
hospital. He reported the average room rate was about $30.00 a
day at Morton Plant Hos~ital whereas the Med1center would charge
in the neighborhood of ~12.00 to $14.00 per day. He presented
a tentative revised parking plan showing the number o~ spaces
met the zoning ordinance requirements of the City. He also
presented photos of the area and the buildings therein. In
conclusion }1e maintained that the facility should be classified
as a hospital and therefore not required to have the approval
of the Board.
In answer to questions~ Mr. Jack Wolle, City Planning Director,
stated he believed the proposed facility as described by Mr.
NacKen~ie would fall 1n the class of' a hospital and Mr. Guy
Kennedy~ Jr., Assistant City Attorney, concurred in this opinion.
Mr. Robert Tench, Attorney, representing Mr. Lee Reid and Dr.
Henry Smoak object~d to the modification of' the application
and also to the opinions that the racil1ty constituted a
hospital. He also criticized the ingress and egress from the
parking lot as creating a traffic problem. Mr. Leslie Railton
requested that a letter sent by the Harbor Oaks Association be
read and also spoke of' the traffic problem. The City Clerk
read the letter of objection from the Harbor Oaks Association.
Upon consideration of the appeal of Kane Corporation of Florida
from the decision of the BUilding Inspector concerning the
erection of a limited service hospital or nursing home with a
five foot setback f'rom property line facing Jeffords Street on
, the North 90 feet and West 130 feet of South 90 feet of Lot 30,
Bluff View Subdivision, zoned R-4 (multiple dwelling), it
appearing a~ter this duly constituted pUblic hearing that there
are practical d1f'ficulties and unnecessary hardships in carrying
out the strict letter of the provisions of the zoning ordinance
as it affecta such property and that the same can be varied
~ within the intent of the zoning ordinance, Mr. Brodeur moved
'i' that such appeal be granted for the erection of a hospital
installation With a five foot setback from Jeffords Street with
the provision that the right to obtain a building permit in
aocordance'with such variance shall, cease after six (6) months
