Motion was seconded by Mr. Meek. Barber and r~eek voted "Aye". Shepard, Marquardt and Garcia voted "No". Motion did not carry. . The request of Peace Memorial Homes, Inc., was presented at which time Mr. Shepard vacated the Chair due to the fact that he is a member of ,the Board of Directors of the corporation. Mr. ~~rquardt assumed the Chair. Mr. .Ralph Richards, attorney, representing the corporation as its president, stated that the infirmary was built in 1959 prior to the change in setback requirements in the R-M zone and he was requesting that the proposed new building be allowed the same setback from Osceola Avenue. He stated that the corporation had discussed further the second request of no setback from the north property line for porches or balconies and had decided to withdraw that portion of the application. There were no objections. Upon consideration of the appeal of Peace Memorial Homes, Inc., from the decision of the Building Inspector concerning a twelve foot nine inch setback from Osceola Avenue on north 44.67 feet of Lot 2, Rev. Map of C. S. Imyden Estate Subdivision, (zoned R-M) to construct addition to present retirement home, it appearing after this duly constituted public hearing that there are practical difrj.culties and unnecessary hardships in carrying out the strict letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied wi thin the intent of the zoning ordinance, Mr. Garcia moved that such appeal be gr~~~ed in accordance with the amended application submitted therewith with the provision that the right to obtain a building permit in accordance with such special exception shall cease after six months from this date. Motion was seconded by Mr. Barber. Garcia, Barber, Meek and Marquardt voted "Ayell. Mr. Shepard abstained from voting. Motion carried. Mr. Marquardt relinquished the Chair to Mr. Shepard. Mr. Frank Ebert of T & E Builders, Inc., was present and stated that it was impossible to put the proposed house on the designated lot without a fifteen foot setback from Lake Drive and also stated the house on the northwest corner of Lake.,Drive and Magnolia had a. fifteen foot setback~' Mr. John Mahoney, owner of' Lot 17, objected as such a setback wo~ld block his home to the south.
