The Board considered the request of Mr. Tom Hammond who gave further explanation'of his application. The Chairman asked if there were any objections and there were none. Upon consideration of the appeal of Tom Hammond from the decision or the Building Inspector concerning request to waive setback from west lot line of Lot 12, Bayside Subdivision, to install driveway, (property presently zoned R-lE) it appearing after this duly constituted public hearing that there are practical difficulties and unnecessary hardsh1~s in carrying out 'the strict letter ot the provisions of the zoning ordinance as it atfects such property and that the same can be varied within the intent of the zoning ordinance, Mr. Barber moved that such appeal be gr~ted in accordance with the application submitted therewith with the proviSion that the right to obtain a building permit in accordance with such special exception shall cease after six months trom this date. Motion was seconded by Mr. Meek. Meek, Garcia, Barber, Marquardt and Shepard voted IIAyell. Motion carried. The Board discussed the request of Mr. Ronald E. Brunkhart who stated he knew nothing df the new ordinance restricting model homes at the time of purchase of the lot. Mr. Al Rogers~ seller of the property, requested approval. Mr. Kennedy, Assistant City Attorney, expressed the opinion that althuugh the application did not meet the requirement at Ordinance #952 that model homes be located in plats not more than five years old, the Board could grant the request under the hardship provision of the zoning ordinance if so desired. The Chairman asked if there were any objections and there were none. Upon consideration of the appeal of Ronald E. Brunkhart trom the decision of the Building Inspector concerning the request to erect a model home on Lot 39, Sunset Highlands #2~ (property presently zoned R-lE) it appearing after this duly constituted public hearing that there are practical difficulties and unnecessary hardships in carrying out the strict letter ot the proviSions of the zoning ordinance as it affects such property and that the Bame can be varied within the intent of the zoning ordinance, Mr. Meek moved that such appeal be granted in accordance with the application Submitted therewith with the provision that the right to obtain a bu1ldingpermit in accordance with such special exception shall cease atter six months from this date and w1th the further provision that as mentioned the other requirements of Ordinance No. 952 be carried out. Motion was seconded by Mr. Barber., Meek, Garcia, BA.rber, Marquardt and Shepard voted "Ayell. Motion carried. Mr. Al Rogers on behalf of Mr. R. E. Brunkhart requested a waiver of the ten day appeal period so he could start" constxu ction of the model home on Lot 39~ Sunset Highlands #2 inunediately. The Chairman asked if there were any objections and there were none. Upon consideration ot the appeal of Knight & Hoskinson from the decision of the Building Inspector concerning the request for the following setbacks: a. 20 feet from Pierce Street for Lot 4, Block Wj b. 20 feet from Pierce Street and lO feet from Waverly Way for Lot 5, Block Wj c. 20 feet from Pierce Street for Lot 5, Block Xj d. 19 feet from Pierce Street and lO feet from Frederica Drive for Lot 6, Block Xj all in Hibiscus Gardens Subdivision, property presently zoned R-2, it appearing after this duly constituted public hearing that there are practical difficulties and unnecessary hardships in carrying out the strict letter of the provisions of the zoning ordinance as it affects such property and that the same can be varied within the intent of the zoning ordinance, Mr. Garcia moved that the appeal be granted in accordance with the ~pplication submitted th~rew1th with the provision that the right to obtain a building permit in accordance with such special exception shall cease after (6) six months from this date. Motion was seconded by Mr. Marquardt. Meek, Garcia, Barber, Marquardt and Shepard voted "Aye". Motion carried. The Board conSidered the request of Mr. Richard D. Slautterback. Mr. Roy W.' Powell of AAA Fence Company representing the applicant explained that the six foot fence was already bui~t and stated he did not know about the height restrictions. The Chairman asked if there were objections and there were none. Upon consideration of the appeal of Richard D. Slautterback from the decision of the Building Inspector concerning erection of a six foot fence on portion ot rear and both side lines of Lots 43 and 44, Block C, Highland Grove Subdivision, it appearing after this duly constituted public hearing that there are practical ditficulties and unnecessary hardships in carrying out the strict letter of the provisions ot the zoning ordinance as it affects such property and the same can be varied within the intent of the zoning ordinance, Mr. Meek moved that such appeal be granted in accordance wlth the application submitted therewith with the provision that the right to obtain a building permit in accordance with such apeclal excep- tion shall cease after six months from this date. Motion was seconded by Mr. Marquardt. Meek, Barber and Marquardt voted II Aye". Shepard, Garcia voted lINolI Motion carried.
