zoning ordinance as would justify a variance of such provision
and that the same cannot be made within the intent of the zoning
ordinance Mr. Hougen moved that such appeal be denied. Motion
was seconded by Mr. Stoutamire. Marquardt, Hougen, Stoutamire
and Levison voted "Ayell. Shepard absent. Hotion carried.
Mr. Levison presented the request of James P. Burns, Jr. Mr.
Fred Wilder, Attorney, represented Dr. Burns and ~resented the
plans for expansion of existing medical office bu~lding and the
architect's rendering of the exterior. He stated the' framework
of the old building'would be used, although there will be no
visual evidence of it. There were no verbal or written objections.
Upon consideration of the appeal of James P. Burns, Jr. from the
decision of the Building Inspector concerning a ten foot 'setback
from Bay Avenue and to' use Lots 4 and 5, C.' Perry Snell's Bluff
View Court Subdivision for doctor's office (to expand existing
medical building), property is zoned R-4, it appearing after' this,
duly constituted public hearing that there are practical diffi-
culties and unnecessary hardships in the way of carrying out
the strict letter of the provisions of the zoning ordinance
as it affects this property and that the same can be varied
within T.he intent of the zoning ordinance, Mr. Hougen moved
that such appeal be granted in accordance with the application
submitted therewith~ with the provision that the right to ob-
tain a building permit in accordance with such variance shall
cease after six (6) months from this date. Motion was seconded
by Mr. Marquardt.
Marquardt, Hougen, Stoutamire and Levison voted "Aye". Shepard
absent. Motion carried.
Chairman Levison recommended Mr. Shepard be awarded a citation
and the Clearwater medal. Mr. Marquardt moved that Mr. Kennedy
prepare a resolution from the Board recommending that Mr. Shepard
be 'awarded a citation and the Clearwater medal', that such a res-
olution be adopted by this Board and that copies be sent to the
necessary City officials. Motion was seconded by Mr. Hougen.
Marquardt, Hougen, Stoutamire and Levison voted IIAyen. Shepard
absent. Motion carried.
There being no further business, the meeti~g adjourned at
8:35 P.M.
