The meeting was called to order by Chairman Levison. Mr.
Shepard moved that the minutes of the meeting of January 25,
1962 be approved in accordance with copies submitted to each
Board member in writing. Motion was secDned by Mr. Marquardt
and carried unanimously.
The request of George J. Thomas ~o1as presented for consideration.
Mr. Thomas was present and spoke on his own behalf stating that
when plans had been made for building his apartments he was
within the law. There were no objections on this application.
Upon consideration of the appeal of George J. Thomas from the
decision of the Building Inspector concerning a six-foot set-
back from rear property line of Lot 1, Block 1, Starr & Savery's
Addition, for apartment building to include fire escape within
six feet (property zoned R-4 and located at 609 Oak Avenue), it
appearing after this duly constituted public hearing that there
are 'practical difficulties and unnecessary hardships in carrying
out the stI'ict letter of the provisions of the zoning ordinance
as it affects such property and that the same can be varied within
,the intent of the zoning ordinance, Mr. Shepard moved that such
appeal be granted in accordance with the application submitted
ther'ewi th', with the provision that the right to obtain a building
permit in accordance with such variance shall cease after six '
(6) months from this date. Motion was seconded by Mr. Marquardt.
Levison, Marquardt, Hougen, Shepard and Stoutamire voted "Aye.tI
Motion carried unanimOUSly.

Mr. Levison presented the application of Jimmy Lee Smith for con-
sideration. Mr. Vincent Assini, ,representing the builders,
Advance Homes, Inc.. was present. After discussion, the Board
determined that there was insufficient information available on
thls application at this time. Mr. Shepard moved to continue
this hearing on this application at the next Board meeting on
,..Thursday" f'ebruary a" 1962. Mr. Hougen secDnded 'the motion.
