t4r. Levison stated that he was an officer ot the Church of the
Ascension and thnrefore was withdrawing from the discussion ot
the Board, and requested that Vice Chairman Marquardt assume the
Chair. Mr. Fred MCJllanus, Attorney, represented the Church and
submitted wri~ten letters of consent from a number of adjoining
property owners. The Reverend Robert Lambert said that in con-
structing the present parking lot they, had left the trees and it
had the appearance of a park. He submitted pictures to substantiate
this stntement aOO said that the proposed parking lot would alao
baTe the trees left on it, similar to the present one. Mr. William
F. Houston objected by stating that this item had been voted down
in the referendum and suggested that every resident in the area
should be polled. Mr. Russell Bollen objected by taking issue wit.b
the present zoning laws. Atter a review at the application oE the
Church of the Ascension and a hearing thereon of the Board ot Ad-
justment and Appeals on Zoning finds as a tact that the propo..d
use of Lo't '+, Block 2, Starr &. Savery Addition is consistent with
the public interest as a non-commercial parking lot in connection
with the activities of the Church, Mr. Sh.p.r.d moved that such
appeal be granted in accordance w~th the applicatio~ submitted
therewith, with the provision that t.he right to obtain a permit
in accordance with such variances shall coase af"ter six (6) months
from this date. Motion was seconded by Mr. Stoutamire.
Marquardt, Hougen, Shepard, Stoutam1ra voted "Aye".
Motion carried. (Mr. Lev160n did not vote.),
Mr. Loyd C. Mosley represented Apostol G. Gelep, the applicant, and
stated that setbacks in the area varied ~rom six feet to t.welve
feet. Mr. Gonzalo Garcia objected and stated that he WQS the agent
for owners of nu.'1\bers 724, 730 and 734 Eldorado Avenue, which had
setbacks of twelve teet, and they would bo willing for the same
setback on this property. The Board took a short recess for the
Clerk to investigate the setbacks approved for Lots 7 and 81 Block
2, ~mndalay Subdivision in 1955, and he reported that the C ty
Commission at that time bad approved ten foot setbacks for both oE
these lots. Mr. Mosley after conferring with his client, agreed
to amend their application to a request for a ten foot setback.
Upon consideration o~ the appeal of Apostol G. Gelep, trom the
decision of the Building Inspector for a six foot setback from
. Eldorado A'fenue for Lot 6, Block 21 Mandalay Subdivision to con-
struct dwelling thereon (property oeated on west side of Eldorado
Avenue north ot Acacia Street and zoned R-l), it appearing after
this duly constituted public hearing that thex'a are practical
d1f'ficulties and unnecessary hardships in carrying out the strict
letter of the provisions of the zoning ordinance as it affects such
property,' 'and that the same can be varied within the intent of the
loning ordinance, l-'Ir. Hougen moved that such appeal, as amended to
request a ten toot building line setback from the front ot the
property line t be grant ed in accordance with the application Bub-
mitted tberew1th as amended, with the provision that the right to
obtain a bUildinf permit in accordance with such variances Bhall
,cease after six 6) months i"rom this date. Motion was aeconded
by Mr. Marquardt.
Levison. Marquardt, Hougen, Shepard, Stoutamire' voted "Aye".
