The Planning Official reported the request is for a 14 ft.
setback variance on Oak Neck Road and a 2 ft. variance in fence
height. No encroachments currently exist in this aren and he
questions whether there is practical difficulty or unncessary
hardship concerning the fence height.
Leonard Klinck stated they wanted the pool for the benefit
of their children and the fence to afford them maximum privacy
and noise abatement from traffic on Oak Neck Road, which is a
main thoroughfare. The proposed location of the pool is the
only area available on their lot. No one spoke in opposition.
Having held a duly constituted public hearing and since,
based on the material submitted by the applicant, there are
practical difficulties or unnecessary hardships in complying
with the zoning code, ~Ir. Gans moved to grant the requests
l~ith the provision that the building perm1t be obtained within
six (6) months of this date. The motion was duly seconded
and carried unanimously.
Item #3 - SE American Development Corp. for a special
exception to construct a Type A Marina (14 slips) on
a portion of M&B 17-1, Sec. 30-29-15 (Sand Key Yacht
& Tennis Club) located at 1621-1651 Gulf Blvd. and
zoned RM 28 (high density mUlti-family).
The Planning Official reported the request is for a board-
walk 185 ft. long with an additional slip on either end and
the slips would extend 42 ft. from the seawall. The water
here is approximately 375 ft. wide. The Planning and Zoning
Board reviewed the application on March 17, 1981, and recommended
approval subject to the dock being for the exclusive use of the
residents and that they be constructed ill conjunction with upland
development. The Harbormaster also reviewed the request and
stated it poses no hazard to navigation.
The Board questioned whether the proximity of this property
to Be1leair Beach poses a problem. Robert Phiel, AAA Marine
Company, representing the applicant, stated he had investigated
this matter and that the seawall is the property line of the
site. Be1leair Beach reported there was no problem in their
view since access to the docks from Belleair Beach is impossible.
The reason for this additional request is that demand for slips '
has exceeded the developer's expectations. The slips are intended
for the use of owners only. No one spoke in opposition.

obtained for planned upland construction, that their use be
