5. Sand Key Development, Ino., agrees that approval of this
applioation does not give them the right to extend or main-
tain ohannels to open water nor do they ever intend to apply
for that right. Natural tidal aotion in oonjunotion with
the boat traffio moving in and out is expeoted to keep the
ohannel open.
The P & Z Board added one additional oondition: slips will be used
exolusively by oondominium residents and shall not be for sale to the
general publio.
Karen Wilson, the City's water quality speoialist, has two additional
oonoerns: 1) plaoement of silt ourtains and 2) plaoement of spoil. If the
request is granted she asks that approval be given subjeot to the applioant
working with her to satisfy these oonoerns.
The Harbormaster has reviewed the applioation and stated it poses no
l~zard to navigation.
Ray Peaoook, attorney representing the applioant, stated the dredging
permit does not allow for dredging more than 40 ft. from the seawall and,
thereforo, they will not be dredging in the grass flats. They will be
happy to work with any City staff to meet the oonaerns expressed. They
reaffirm their oommitment to the five stipulations outlined in their letter
of August 12, and the slips are intended only for residents. Prospeotive
purohasers would be informed oonoerning any restriotions on boat size and
draft. The do oks would be oonsidered a part of limited common elements and
would be oontrolled as suoh.
Robert Pfeil, AAA Marine, representing the applioant, identified a
olump of mangroves in one oorner and stated the faoility would stop approx-
imately 14 ft. north of that point. The dredge permit allows them to
dredge to B depth of 5 ft. maximum. The design of this faoility will be
the same as the one existing on the south side of the property. No one
spoke in oppoaition.
Having held a duly oonstituted publio hearing and sinoe, based on the
material submitted by the applioant, the proposed use is oonsistent with
the zoning oode, Dlt. Caftontizis moved that said appeal be INJIt.ed with
the proVision the oonditions stipulated in the letter from tha applioant to
John RiOhter, Planning Department, be met, and oonstruotion be done in
consultation with Karen Wilson, water quality speoialist, and with the
prOVision that the ~Be/building permit be obtained within six (6) months of
this data. The motion was duly seoonded. Hr. Oans moved to amend the
motion to include that the do oks be tor the exolusive use of oondominium
owners and guests or lesseo3 and guests. The motion was duly seoonded and
the amendment oarried unanimously. The amended motion oarried unanimously.
