Hearings, by its duly designated Hearing Officer, K. N. Ayers,
held a public hearing in the above-styled case on April 21,
19B3, at Clearwater, Florida.

By letter dated March ll, 1983, Terrance Clements,
Petitioner, appeals the decision of the Board of Adjustment
and Appeal on Zoning denying Petitioner's request for a variance
to construct a screened pool enclosure one foot from his rear
property line. The Board granted a request for variance to

c~nstruct a swimmdng pool three feet from Petitioner's rear
property line.
At the hearing petitioner testified in his own
behalf, one wi.tness was called by Respondent, and two exhibits
were admitted into evidence.

,FINDINGS OF FACT
1. Petitioner occupies a single family residence
Ayenue, Clearwater, Florida. The property is

zoned RS-SO, which is single family. The use of the property
and use proposed with the variance requested is consistent
with this zoning. RS-50 zoning contemplates houses'on small
lots with a maximum density of 8.7 dwe llings 'per acre...
2. There is a six-foot wood fence along the majority
of the west side of Petitioner's property located on the
property line. The pool enclosure (screen room) proposed would
be partly behind this fence but extend above the fence and extend
slightly to the north of the northernmost end of this fence.
The setback on the west side of Petitioner's property is five

feet. petitioner proposes to erect the screen room one foot
from the west property line for which a four-foot variance is
required.

3. Petitioner desires to screen the pool he has
a permit to construct so as to facilitate maintenance by
keeping falling leaves out of the pool and to increase venti-
lation in his house by leaving French doors leading to the
pool from' his house open.
4. Two other screened pools exist in the immedi-
ate neighborhood similar to the enclosure proposed" by Pe,f.i-
tioner. One is located four houses west of Petitioner and
the other ,is six blocks away. None of Petitioner's neigh-
bors object to the granting of the variance requested.
No evidence was submitted that a variance was requested or
granted for thOse two other pool enclosures in the neigh-
borhood" e
5. The Board's reason for granting the variance
and setback for the pool was the pool was in-ground and

would' not obstruct a view. The re~son for denying the

and therefore in view.

6. The size pool intended to be installed by peti-
.tioner is 14 feet by 30 feet, which, with concrete apron,
will ocoupy most of Petitioner's lot between the house and
the west property line.
CONCLUSIONS OF LAW
The Division of Administrative Hearings has juris-
diction over the parties to, and the subject matter of, these
proceedings. ,
variances are governed by Section 13l.0l6(e), city
of Clearwater BUilding and Zoning Regulations, which provides:

Variances. The board shall have power
in specific cases, after due notice,
investigation, and hearings on the afore-
said, where there are practical diffi-
culties or unnecessary hardships'in the
way of carrying out the strict letter
of the provisions of this chapter, to
determine and vary any such provisions
in harmony with the general purposes
and intent of this chapter so that the
public health" safety and general wel-
fare may be secure and substantial
.' justice done. A variance from the terms
of this chapter shall not be granted
by the board unless and until:
(1) A written application for a variance
is submitted stating substantially that
certain of the following exist:
a. That special conditions and circum-
stances exist which are peculiar to the
land, structure or building involved and
which are not applicable to other lands,
buildings' or structures in the same dis-
trict.

b. That literal interpretation of the ,
provisions of this chapter would deprive
the applicant of rights commonly enjoyed
by other properties in the same district
under the terms of this chapter.

that the pool should be enclosed in any event to protect .mall
ohildren from inadvertently fallinq into the pool, and that
a screened enclosure is more.aesthetio than is a ohain link
fence and will enhance property values in the district.
It is
ORDERED that Terrance Clements be granted a four-
foot variance in rear setback line to allow the construction
of a screen room one foot from the western lot line of his
lot located at 1048 Carlos Avenue, Clearwater, Florida.
