It' " ' " .,.,- CONCLUSIONS OF LAW The oivi.ion of Administrative Hearings has juris- diction over the parties to, and the subject matter of, these proceedings. Section l3l.0l6(e), city of Clearwater Building and Zoning Regulations, provides that a variance from the terms of these regulations shall not be granted unless the following exists: '. a. That special conditions and cir- cumstances exist which are peculiarc to the landl structure, or building involved and which are not applicable to other lands, buildings or structures in the same district. ' b. That literal interpretation of the provisions of this chapter would deprivG,the applicant of rights commonly enjoyed by other properties in 'the same district under the terms .of this chapter. c. That the special conditions and cir- cumstances referred to in subsection a. above do not result from the actions of the applicant. d. That granting the variance requested will not confer on the applicant any special privilege that is denied by this chapter to other lands, structures or dwellings in the same district. ,I Petitioner has failed to show that the variances requested meet the requirements above-quoted.
