variance". Having considered the evidence presented and having
reviewed the proposed findings and conclusions submitted by
,the parties, I make the following:
FINDINGS OF FACT
-
1. Eugene Elliott owns Lot 10, Block 16, Milton Park
Subdivision, which property is located at 710 Tuskawi1la Street,
Clearwater, Florida, and is zoned ML (light manufacturing). The
southwest portion of' this lot contains a garage used by Elliott
as an auto repair shop. The entire lot is paved and Elliott seeks
to fence the area north of the gara.ge wi.th a six-foot wood fence.
This area is presently used to park cars from which Elliott sal-
vages parts. ~hese salvaged parts are not sold to the general
public as over-the-counter merchandise but are used by Elliott
to repair cars brought to him. Some of these cars from which
parts are salvaged remain on the lot for several months before
they are stripped and hauled away for final disposition. The
salvage operation is secondary to Elliottts principal business

2. To the north of Lot 10 the property is used for

light manufacturing, the lot to the east is occupied by a
single-family residence, to the south (across Tuskawilla street)
there is a cemetery, and 'to the west the adjoining lot is used
by a moving and storage company.
3. The only objection from any property owner in
Block 16 to the special exception comes from appellant Thompson,
who owns Lots 6 and 7 in Block 16. ~hose lots (6 and 7) are
currently used as, an unpaved parking lot, but the owner expects
to build storage and'parking facilities on these lots at a

zoning regulations generally require"a threEl~ to four-foot
setback from the property line for the erection of a fence
and landscaping' between the property line and the fence.
Elliott seeks variances from these code provisions.
s. Appellants contend that they have no objection
to the use of Lot 10 as an auto repair ShOP1 however, they are
attempting to upgrade the neighborhood and to allow a salvage
business to be conducted on the property, even if authorized
by the zoning code, would, in their opinion, inhibit such
Upgrading.
CONCLUSIONS OF LAW

The Division of Administrative Hearings has juris-
diction over the parties to, and the subject matter of, these
proceedings.
Section 131.167, Clearwater Building and Zoning
RegUlations, provides that in an ML district all uses and
str~ctures are permitte~ that are permitted a CG district and
a CS di~trict except residential use~~
section 131.169 contains prohibited uses in an ML

district and includes ,II [J]unk yards including automobile
wrecking and salvage yards."

Section 131.142 provides that storage yards, when
shielded from view from any public way may be authorized as
a special, exception in CG districts. Section 131.158 similarly
provides storage yards are permitted in CS districts when
shielded from view from any public way.

a speoial exoeption to operate an automobile storage and
salvage business secondary to his auto repair shop. It is

from the setback requirements and landscaping requirements
and be authorized to erect a six-foot wood fence along the
property line on the west, north, and east sides of Lot 10,
