Based upon the information furnished by the applioant, whioh
olearly shows that the requirements ot Seotion 137.012, City Code,
have been met and that the striot applioation of the Development Code
would result in an unneoessary hardship upon the applioant as the

Willie Brewton submitted photos to the Board. The ohuroh wishes
to enlarge their sanotuary and add additional olassrooms. The
addition will not infringe further into the setbaok than what 1s now
existing. He stated they are able to us., unother ohurohts parking
faoilities if their lot is full.

Pastor Campbell stated most ,:,f the ohuroh members live in the
area and, theretore, they do not need the number ot parking spaoes
required by the Code.

The Planning Offioial stated the Traffio Engineer is not in favor
of the proposed drlveKsy off Coaohman Road beoause of its proxilDity
to the intersection.
Carlos Yepes stated they wish to ereot a oanopy over the gas
islands for proteotion at their oustomers. The oode allows gas
islands to be within 15 ft at the property line. ThA height of the
oanopy will be 111 ft. They plan to redo the parking a:oea but have
more parking spaoes than are required. They feel they oLmnot build
a oanopy without the varianoe and still insure the safet:! of their
oustomers.
Reverend Steve Kimball spoke in oppOSition stating the ohuroh
he represents is due west of the subjeot prop6rty and they teel this
operation will pose a safety problem for both the ohuroh and the
sohool. They are oonoerned about the flammable gas as the buildings
are only 20 ft apart. The ohange from a low profile business to a
high profile business will 1norease the traffio problems and they
feel it is inappropriate to put this type of business within 200 ft
of three ohurohes.
In response, Mr. Yepes stated this type ot business is permitted
in this zoning olassifioation and the request deals only with a
request to ereot a oanopy.

Beoause the applioant has failed to demonstrate a neoessity for
the varianoe as requested, beoause a hardship has not been
established, Hr. Gans moved that suoh appeal be denied. The motion
was duly seoonded and upon the vote being taken, Messrs. Pliska, Gans,
Merriam, and Dallmann voted "Aye;" Mrs. Dobbs voted "Nay." Motion
oarried. Request dea1ed.
ITEM 16 - Katherine Caffentzis Howe for a '!arianoe of 2
ft to permit a 6 tt high fenoe within struotural setbaok
area from street ROW, at 5114 Plumose Ave, Nursery Park, Lot
4, zoned RM-8 (multiple family residential).
The Planning Offioial pointed out the fenoe has already been
ereoted.
Greg Howe stated he knew a varianoe was reqUired but when he
went to apply for the building permit, there Kas some question as
to whether his address was on Turner or Plumosa, so he was sent to
both the Planning and Engineering Departments. In the interests of
his dog's ,health, he felt it was neoessary to ereot the fenoe and
apply for the varianoe and permits atter the taot. He submitted a
letter trom his veterinarian stating the dog has a medioal problem
and it was not in her best interest to keep her on a ohain any longer
than necessary as it might oreate further damage. The tenoe is set
baok 4 tt trom the property line and has been landsoaped. In addition

The Building Otnaial stated it is poor judgement tor anyone
to go ahead with a projeot prior to going through the proper ohannels
under the assumption that if the projeot is oompleted, the varianoes
will automatioally be granted.
Three oitizens spoke in support stating the fenoe is an
improvement and it was ereoted prior to obtaining the permit beoause
of oonoern for the dog's health. It was pointed out that ,,--:ten the

it was important that this problem be eliminated as soon as possible.

Wanda Fife, representing the owner, stated they oontraoted to
purohase the property in August. The sign they wish to put up was
indioated on the site plan whioh has been approved. The Code ohanged
after olosing on the property and they now have 8 leases. Some of
the tenants may oanoel their leases if they oannot have suffioient
sign8ge. She pointed out there are sever-al nonoonforming signs in
the araa and she does not feel their sign will be out of plaoe. No
one in the area has objeotions and the Traffio Bngineer has stated
the sign would not be a hazard to traffio. There are 2~ units in
the building and they propose a sign that would matoh the general
appearanoe at the building. It would have the name of the oenter
at the top and list the tenants below.
