Kiehnel RObertaon,. attorney representing the applicant, stated
a varianoe was granted last month to add a seoond story to a port1on
ot the building abutting Keystone. In 1919, a permit was obtained
to construct a two story building and, at that time, no setbaok was
required. One story was oonstructed and plumbing faoilities were
plaoed on the roof' with the intention of adding a seoond story in
the future. They wish t~ have two motel units and a linen room on
the second floor. The plumbing facilities are located on the western
portion or the root and they wish to U3e those. the hardship was
oreated by a ohange in tho Code whioh increased the setbaoks and not
by the applicant.
Based. upon' the information furnished by the applioant, whioh
"olearly shows that the requirements of Sootion 131.012, City Code,
have been met and. that the striot applioation ot the Development Code
would result in an unneoessary hardship upon the appl10ant as the
result ot unique oonditions not caused by the applioant, beoause the
bUilding and plumbing exist and it 115 a hardship to oonforM to current
setbaoks, Mr. Merrialll moved to araat the varianoe as requested
sUbjeot to the conditions that the oonstruotion shall be 11mi ted to
a struoture 31 ft long at the rear of t~e site as shown in the site
plan and that the building. permit be obtained within six (6) months
of this date. The motion was duly seoonded and oarried unanimously~

The Planning Ottio1al stated the Publio Works Department is in
tavor of looating the tenae on the property line because of a drainage
pipe but they are opposed to the ell~1natlon of the aooess gates.

were oontaoted by the City because the City was ooncerned the vall
sight tall on anyone who might be exoavating the pipe tor repair or
replaoement. The County has agreed to allow them to put the
landso8plns in a 2 rt portion or the right-or-way and an additional
