and advised that anyone adversely affected by any decision of the
.Development Code Adjustment Board may appeal the decision to an Appeal
Hearing Officer within two (2) weeks. He noted that Florida law
:requires any applicant appealing a decision of this Board to have
a verbatim record of the proceedings to support the appeal.

fronts on Eldorado and the variance is for a stairway only. The flood
lione requires the structure be 11 ft above grade and they desire the
second stairway for safety reasons.
The Building Official had some question as to whether the
drawings were complete because the site plan and the other drawing
attached to the application were not the same regarding access to
the second floor.

to,construct a single family dwelling with a 20 ft setback rather
than the 25 ft required.
Ralph. Shackelford stated he wishes to construct a single family
dwelling on this parcel which he recently purchased from the City.
Discussion ensued as to whether the right-of-way easement
indicated on the rough sketch submitted with the application was the
line from which the setback should be measured. The Board felt that
without a survey, they could not be certain whether the variance
requested would be sufficient for Mr. Shackelford to construct the
home.
One citizen spoke in objection stating she felt the iot was too
small to construct a home on and concern that the City had moved her
property line back 5 ft and she was apprehensive the same thing might
be done with the property that is the subject of this request.

Harry Cline, attorney representing the applicant, stated there
are many such overhangs in the downtown area and the building on this
property is within i ft of the property line. The awning would track
underneath the existing canopy and would have a sign on it. The Code
does not allow them to put a sign on the roof and the Traffics Engineer
has stated the canopy will not create a traffic problem.
There was some question as to whether the Board had jurisdiction
to allow an individual to encroach on City property. The City
Attorney stated he would do some quick research to see if he could
find the answer. The Chairman called for a break to allow the City
Attorney a few moments to do the research. Upon his return, the City
Attorney stated Section 136.006 of the Code prohibits an awning from
extending over the right-of-way and if the Board chose to grant-the
request, they would be granting a variance for a prohibitive use.
Discussion ensued as to what options the applicant might have in view
of.the City Attorney's findings.
Mr. Cline stated he felt the awning had been grandfathered in
and, due to the location of the building on the property, the
applicant had a hardship with regard to identifying his business.
Because the applicant has failed to demonstrate a necessity for
the variance as requested, Mr. Gans moved that such appeal be
denied. The motion was duly seconded and upon the vote being taken,
Messrs. Gans and Merriam voted "Aye;" Mrs. Dobbs and Mr. Dallmann

with regard to the matter. He stated that based on purpose #1 on
page 135-2 of the Code which states that a business or residence must
be able to identify their location, he feels the denial might preolude

The Planning Official stated this request had been rescheduled
from a previous meeting. The request is to park a 24 ft boat in the
front setback of a home which is in an area that is partially in the
County and partially in the City and, therefore, the same restrictions
do not apply to all, lots.
Henry Rogers stated he has a 24 ft cabin cruiser. He has been
unable to work for 5 years and uses the boat to catch fish and
supplement what little income his family has. The realtor, at the
time he purchased the home, informed him there would be no'problem
with him parking the boat on the property. He stated several
neighbors also have large boats.
One letter of support was submitted for the record.
One citizen spoke in objection stating she feels the boat is
a traffic hazard in that she has several small children and is
concerned a car coming down the road would be unable to see them with
the boat parked in the front setback. She also complained of the
smell from the bait used and submitted 3 photos showing how the boat
obstructed the view. One phone call in objection was received.
Based upon the information furnished by the applicant, which
clearly shows that the requirements of Section 137.012, City Code,
have been met and that the strict application of the Development Code
would result in an unnecessary hardship upon the applicant as the
result of unique conditions not caused by the applicant, because he
lives in an area of mixed County and City property with different
codes applying to his next door neighbors and to other persons in
the area and to deny him would deny him privileges available to the
others, Mrs. Dobbs moved to grant the variance as requested. The
motion was duly seconded and upon the vote being taken, Mrs. Dobbs
and Mr. Plisko voted "Aye;" Messrs. Gans, Merriam, and Dalimann voted
"Nay." Request denied.

The Planning Official stated the request is for variances to
expand a nonconforming structure but to his knowledge no additional
units were being added to the motel.
Roxana Nowioki stated she wishes to add a second story to her
motel to increase her total units to 18. She feels this would make
her operation more competitive and with the current 10 units this
is difficult.
Discussion ensued as to the possibility of a parking, variance
being needed because of the additional units.

The Planning Official stated this is a request to reconstruct
a stairway which currently does not meet the setback requirements.
Henry Wester stated it is necessary that he reconstruct the "
acoess to the upstairs as the existing stairs are deteriorating
because of termites. It is also necessary that the new stairs be

Ashland Ter, See 16-28-16, M&B 33.01 (Ashland Heights
(proposed), Lot 12), zoned RS-6 (single family residential
Bill Rambaum, attorney representing the applicant, stated a
mistake was made by the mason when the footer was laid causing the
house to encroach into the setback. The walls were already up and
the City had inspected the property 3 times before the mistake was
discovered. A portion of the wall serves as a planter, but there
are some roof trusses which bear weight on the wall.
The Building Official stated these problems occur when the
builder does not obtain a foundation plan before the construction
.progressea.too far for the mistake to be corrected easily.
Because the applicant has failed to demonstrate a necessity for
the. variance' as requested because the error was created by the

will be situated on an oversized lot consisting of more than one aore
with approximately 47 ft side setbacks on either side and a front
setback of some 47 ft to 65 ft. The neighbors on either side are
in favor of the request. If the variance is not granted, the possible
alternative would be to move the garage to the side of the home which

Hurricane Elena destroyed the metal storage shed which had been.used
to store newspapers and other items. In looking over their needs,
the church has decided to build a shed of masonry construction which
would be a logical extension of the church property. There is a
genuine need for the shed and' there is no other suitable location
available.
Based upon the information furnished by the applicant, which
clearly .shows that the requirements of Section 137.012, City Code,

The Planning Official stated this is a request to have a second
identification sign and a variance to allow more square footage than
is allowed by Code.
Ed Armstrong, attorney representing the owner, stated the tenant
is not a major tenant at this time but has agreed to rent the
additional amount of space to become a major tenant if the variances
are approved. The additional square footage is to be divided between
2 identification signs and is equal to what they would be allowed
if they were a major tenant. They are currently leasing a portion
of the mall in the building located in the northwest portion of the
property and facing west. They feel the U.S. 19 overpass limits
visibility of all the businesses on the west side of the building
and the other tenants have no problem with the additional
identification sign. Previously, the Board of Adjustment and Appeal
on Signs had considered a similar variance as they felt the overpass
created a hardship. The type of sign proposed is a plastic sign with
lights behind it.
The manager of the mail submitted several photos indicating what
types of signs are on the building now and where the proposed sign
would to be placed.
Scott Kiser, representing the tenant, stated they intend to put
on a large advertising campaign and will employ 25 to 30 people.
Beoause the applicant has failed to demonstrate a necessity for
the variance as requested Mr. Plisko moved that such appeal be
denied. The motion was duly seconded and carried unanimously.
