listed below. Attachments #1. #2. #3 and #4 are a part of this item.
Sandy Glatthorn moved to approve the final site plan based upon a finding of this Committee
that the plan conforms with the design guide I ines for site plan review subject to the
following:
1. Additional hydrants shall be provided as required by the Fir'e Marshall and shown
on the site plan prior to certification
2. A 10 foot utility/pedestrian easement should be provided along the north property
line and shown as such on the site plan prior to certification
3. Prior to certification the engineer shall meet with City Environmental to discuss
the aspects of water quality on the site
4. The developer shall meet with the Traffic Engineer to discuss the vehicular
layout/flow prior to certification of the site plan
5. Existing access points on the other side of Gulf Boulevard should be shown on
the site plan for Traffic Engineering review and reconvnended changes and proposed access
points for this site prior to certification. The access points will be subject to permit
approval by Pinellas County
6. Required open space/reacreation fees must be paid prior to certification
7. ' The proposed water distribution system must be revised as required by Utilities
prior to certification
8. A Pinellas County Health Unit Permit, Pinellas County Utility Permit and a 10
Afoot utility easement over water mains are required prior to the issuance of a building
Wpermit
9. The dumpster requirement data form must be completed and returned priot' to site
plan certification

10. Prior to certification the site plan shall clearly indicate that no structure 12
inches or greater in height wi 11 be located seaward of the coastal construction control
~ line and that minimum setbacks will be provided for all structures, including the minimum
V required 20 foot waterfront setback.
11. All site data calculations must be placed on the site plan prior to certification
12. Prior to certification the entire parcel must be drawn on the site nlan and site
calculations must be reflective of the entire parcel unless a subdivision plat Is submitted
for review
13. Signs and fencing/walls are subject to separate review and permitting process.

that the plan conforms with the design guidelines for site plan review subject to the
following:
1. The development must meet the City of Clearwater storm drainage criteria
2. Dumpsters must be in visually screened enclosures, a minimum 12 foot clear
opening must be provided to the front for access by sanitation trucks
3. A Unity of Title shall be recorded by the owner for all lots which are a part of
this site plan review. A copy of the recorded Unity of Title shall be submitted to the
Planning and Development Department prior to the certification of the site plan
4. All site calculations as required by Section 137.010 including existing, propose
and minimum/maximum percentages and figures. along with parking calculations referencing
the applicable formulas shall be provided on the site plan prior to certification. Calcula-
tions must also include the provisions for front yard open space.
5. The required sidewalk along Howard Court must be shown on the site plan prior to
certi fication
6. Signs and fencing/walls shall be subject to separate review and permitting

COMMENTS:
1. Prior to certification the site plan is to show an existing inlet at the west
end of Howard Court and the 15" R.C.P. that extends to the west property
line of lots 3 and 5. If in the estimation of the City Engineer that the
storm drain is in poor condition or too small based on the ability to
adequately carry storm water in a 10 year storm event the developer will be
required to upgrade the storm line. The existing inlet in question may be in
the driveway and have to be relocated or modified by the developer.
2.\ Retention area #2 cannot encroach into the existing 20 ft. sewer and
utility easement.
3. Retention area #2 must be connected by an equalizer pipe to Retention area
#1 and Retention area D1 is to have a control structure that discharges into
the drainage ditch along the north property line.'
4. The floor slab elevation is to be one foot above the crown of the road or
be set at an elevation above the 25 year storm event to be determined by
the professional engineer for the project.

Dear Mr. Powell:
Thank you for your letter of November 30, 1988, expressing your concern relative to
drainage improvements at your proposed development in Clearwater.
Please be aware that the City of Clearwater's development philosophy, as well as
development code, assumes that the appropriate time for the building or upgrading of
the City's infrastructure to a modern level of service is, indeed, at the
development stage. We consider this point our best opportunity to influence the
various aspects of-the City's character which '~ouldt of course, include structural
features.
As the City is being built by both private and public development requirements, it
is concurrently being improved by its existing citizens by virtue of capital
~ improvement projects which occur concurrent with structural features obtained
~ through development. It does not, in my opinion, seem appropriate that because the
City of Clearwater intends three years from now to make improvements to Stevenson1s
Creek via a capital improvement project, that you should be excused from providing
these features yourselves at this immediate time of development. While it is true
that if you waited three years before instigating your project, the City would in
fact make those improvements at no cost to you, we consider that a circumstance
which works out of its own accord and which we do not attempt to manage or ~ke
judgements as to relative equities.
Your request that you he excused from providing any drainage improvements whatsoever
and that we operate for three years without the sorely needed improvements which we
would have otherwise enjoyed, is not in my opinion one which this office can
support. .

However, because of the extreme difficulties we believe you will have in acquiring
per.mits from regulatory agencies to accomplish any improvements there, and because
we do have a plan to eventually construct of our own accord, we are amenable to your
providing the 68 ft. wide easement required, and a $50)000 payment in lieu of
providing the facilities. We can subsequently use the payment as a representation
of at least a share of the cost of the work through your p~operty.

As I believe you are aware, we have been working on the development
of our elderly housing complex to be located on Franklin and Pierce
street for the past twelve months. We have recently learrled from
Mr. Bob Horran of your Engineering Department that we will be
required to install 500 lineal feet of concrete fiber reinforced
ditch to meet city requirements set forth for Stevens Creek.
preliminary cost estimates indicate it will cost an additional
$100,000 to $120,000 for installation.
Mr. Morran further indicated that the Stevens Creek project was
being funded by the city OVer a three year period with
appro~imately $1,000,000 per year being spent on the installation
of the concrete ditch. He stated that the work is anticipated to
start at the outflow of Stevens Creek and that it would take
approximately two years to reach our Franklin and pierce property.
Unfortunately, this' creates a problem for the sponsor and the
Department of Housing and Urban Development, our funding
instrument. This project is scheduled to begin construction within
the next six months and cannot wait until the city completes the
work on the drainage. Mr. Morran further stated that if work on
our site commenced prior to the city completing the Stevens Creek
work, the developer would be responsible for its payment.
Unfortunately, this cost was not anticipated and funds are not
available through the HUD loan; nor does Volunteers of America,
being a non-profit organization, have funds available for these
costs.

We are requesting that we be granted a waiver on the construction
of the Stevens Creek improvements, and further request that the
improvements be completed along with the other city paid
improvements in approximately 24 months. We will'be glad to
dedicate a right-of-way to the City of Clearwater to ensure that
access will be provided as needed by the city.
