A 10' utility easement must be shown on the plat between lots 15 and 16 and between lots 21 and 22 prior to its certification. 2. The water distribution system shown is adequate. 3. A Pinellas County Health Department Permit is required prior to the installation of the water system. Parks and Recreation - Art Kader provided Mr. Appenzeller with written comments. 1. This residential project will be required to satisfY the City's open space/recreation requirements. The City has been working with the developer about a portion of the property being purchased by the City; however, the project itself would be required to pay and meet the City's open space/recreation assessment ordinances. Lf:~ e 2. The open space and recreation facility land fees are payable prior to approval of final plat. Recreation facility fees are payable at building permit phase. Planning - Grace Loyd stated the following: 1. Paula Harvey does note that the variance concerning cul-de-sac length could be approved by the D.R.C. 2. There needs to be a note that construction of walls shall ~equire separate permitting and approval. 3. Documentation is required from Florida Power expressly authorizing the location of the retention within their easement prior to the certification of the plat. 4. The plat shall not be certified prior to June 18t 1987. because that 1s the second read1~g of the annexation ordinance before the City Commission. 5. The plat needs to be recorded within six (6) months from the date of the certification of the permit. Fire'- Nick Lewis had no comment. MOTI ON Cecil Henderson moved to continue this item until the two things that need to be resolved have been resolved. The motion was seconded by Bob Maran. Crawford advised that he had no problem with the cul-de- s~c length if the people who administer the Code believe that the Committee has the authority to approve the length even though it is excessive. - Bob Maran explained the concerns with the retention pond as shown and the fact that it must meet the City requirement which.is 50 feet of water surface area. Bob Maran asked if there was a way to approve the plat with conditions and was advised by Cecil Henderson that if Bob Maran thought the subdivision plat would not be changed then there would be no reason to not approve and especially if Planning said the Committee has the authority to approve a variance to the cul-de-sac length requirement. This was confirmed by Grace Loyd (through Paula Harvey who had checked the Code) and the O.R.C. Committee does have this authority. - Bob Maran advised that he had discussed with Keith Appenzeller the possibility of moving the pond farther to the north. Mr. Appenzeller stated that the developer, Bill Stevens, was going to contact Ream Wilson to work out an agreement where the City buys the parkland. If this can be worked out, the pond could be pushed into the park area. This may come out of the agreement. - Keith Crawford discussed setbacks (Lots 16 and 21) which would limit the type of house to be built on those lots. - Keith Appenzeller asked if there was any problem with the City maintaining the back of the pond. After discussion, Art Kader stated that this would be setting a precedent concerning big retention ponds and would be a problem. However, if the item were continued, discussion can take place concerning whether or not the City would be willing to take over the maintenance. - Keith Appenzeller stated that he has no problem with continuing this item but would like to get action on the cul-de-sac length. Cecil Henderson asked the Committee members if there were any objections to this variance. There were no objections and this was conveyed to Mr. Appenzeller. Nick Lewis called for a vote on the original motion. The motion carried unanimously. 2. LtHERMITAGE, located on the west side of Gulf Boulevard, south of the Crescent Beach Club at 1310 Gulf Boulevard (Previous D.R.C. review - March 26, 1987) FINAL SITE PLAN APPROVED WITH CONDITIONS Public Works - Bob Maran stated that previous comments apply. B. Maran asked if they had a permit from the County to put the entrance road in front of the , neighbors. property and was told that they did have permission but did not have the actual permit because it 'did not go through construction but the concept was agreed to by Traffic. Mr. Wahl stated that if the City wanted less he could change it. This is a State standard now and the County usually follows the State standard. K. Crawford is concerned about the dimensions not being on the plan .- everything relies on getting out a scale. At this stage, K. Crawford will go along with this but when construction plans come in. column dimensions. etc. must be visible. Utilities - Cecil Henderson provided Mr. Wohl with written comments. (See attachment 12.) He also advised that in the future there might be a different rate charged for roll-out containers because there is more work and more cost involved in handling this type of container. This fee has been calculated and discussed with the developer. The fee is due prior to the certification of the final site plan. For the storm water detention area to be designed as a pond in non-storm conditionst the minimum width at water level is 50 ft. If the detention area is designed as a .dry depression it must drain dry in 24 hrs. and have mowable bottom'~nd side slopes. Subdrains must be directed to the outfall control struc~ure, not to drain continuously through the IIdryt' detention area. 3. The note on the plans for improvement to Union Street is to .be removed prior to plan being certified. If the R.O.W. for Union Str~el is not dedicated . to the Oity of Olearwater then an alternative road design will have to be considered.
