Henderson also stated that a fence was shown on the plan and advised that the Commission's consensus is they want the dumpsters enclosed so they cannot be seen and they are looking for a visual enclosure. Mr. Butler stated that it is usually a cedar fence used on 'these sites and on the final plan it will be more detailed and wl11 be a cedar fence. Paula Harvey - Written comments (Attachment "B") from Environmental regarding landscaping. Building Inspection - No comment. ' Ream Wilson - The project is exempt from open space fees. It is less than one acre. MOTION e. . Cecil Henderson moved to approve the final site plan for the Seven-Eleven Store, . located NB corner Belcher and Cleveland based on a finding of this Committee that the plan conforms with the design guidelines for 5ite plan review subject to the requisite initial building permits being issued within six months from the date of certification and all requisite certificates of occupancy being issued within.,:~wo years fran the date of issuance of the initial building permit. ..,: The~motion was seconded by Paula Harvey. The motion carried unanimously. NOTE: Chairman Haeseker advised that Items 2 and 3 would be discussed jointly but separate motions would be made. 2. Florida Convalescent Centers Subdivision, located south of Curlew Road between MCMullen-Booth Road and Landmark Drive (National Health Corp.) PRELIMINARY SUBDIVISION PLAT ~ APPROVED WITH CONDITIONS MOTION .~aula Harvey moved to approve the preliminary plat for Florida Convalescent Centers Subdivision based upon a finding of this Committee that the plat conforms wi~h the design guidelines for plat approval subject to the following conditions: .1. That the final plat be recorded within six months of certification of the preliminary plat. The motion was seconded by Cecil Henderson. Discussion: P. MUscarella questioned whether the motion in any way would subject the owners to dedicate the right-of-way should the deal fall through. P. Harvey explained that it would not since it is subject to recording the final plat. The motion carried unanimously. 3. Clearwater Health Care Center, located at the SW corner of McMullen-Booth Road and Curlew Road (National Health Corp.) FINAL SITE PLAN - APPROVED WITH CONDITIONS Nick Lewis - No comment. e Bob Maran' - No comment on the plat. B. Maran noted that the storm line was shown going underneath the building but was advised this had been changed. 'A general information sheet was given to the representative. B. Maran stated that the City is requesting the right-of-way before the issuance of a building permit. P. Muscarella stated the pl~t probably would not be signed before they wanted to pull the permit. After discussion, it was determined that an agreement would be prepared by P. Muscarella - in recordable form - to be brought in for review by the Public Works Department - which would be to the effect that they agree to give the right-of-way as shown on the attached plat (which would be attached to the proposed agreement) within six months. This would solve Public Work's concern and set a condition where the developer had to give the right-of-way. Chairman Haeseker stated that the following condition should be added to the agreement: "If this right-of-way has not been deeded appropriately within that period of time there will be no more inspections made on this project." Chab:man Haeseker advised that the City wants to make certai.n that the owners understand the seriousness of the right-of-way. It was explained to P. Muscarella that this condition would not hur~ them if they have not started building. Keith Crawford - The one-way drive cuts the parking lot into two parts. Coming from McMUllen-Booth Road, you can reach only half of the parking lot. Although it would be better if the parking lots were connected, K. Crawford will accept it as drawn. Henderson stated that on the final plat we require something saying we can handle the City utility-type functions on the property. Chairman Haeseker preferred the easement to read "for City vehicles." . . ~ Paula Harvey - Require that the minimum setback from the south property line be 2S feet in accordance with the Code and also noted that, as provided by the City Commission, heavy landscaping must be provided on the south property line so that a person standing on the ground at Oak Creek cannot see the building of the nursing home. Written comments (Attachment "E") attached from'the Porestry Inspector identifying adjustments which need to be made on the tree survey. The plan would actually have to have amended language. Building Inspection - Provided written comments on permitting procedure (Attacfiiiient "F"). , Ream Wilson - There will be an open space fee payable on the project due prior to certification of the site plan rather than the plat. If the developer has any questions, he may contact R. Wilson. Require copy of the most recent purchase contract and require a copy of the just value or assessed value from the County courthouse (Attachment "G"). General Discussion 1. K. Crawford mentioned special classification of Curlew Road and special setbacks -- if you are going from the existing right-of-way there is already a 50' setback. P. Harvey advised this is not a requirement of our Code. It was a suggestion by the Pinellas Planning Council and on some projects we have been able to accomplish this. K. Crawford felt it had been covered but did not want to let it'pass without acknowledgin,g,that ,it has come up before. 2. R. Wilson advised that the open space fee is based on the net and dedica- tion of the right-of-way will make a difference in payment. They cannot take out the roadway or easements but can take out the dedicated right-of-way. 3. P. Harvey noted that for the purpose of calculating density the internal roadway can also be deleted. It does not affect the number of units that can be built on the property. MOTION Paula Harvey moved to approve the final site plan for the Clearwater Health Care Centor based upon a finding of this Committee that the plan conforms with tho design guidelines for site plan review subject to: a. ~e following changes being made on the site plan prior to certification: 1. That landscaping must be provided along the south property line (Oak Creek Subdivision) in such an intensity that a person standing on the ground will not be able to see the nursing home building. 2. That required open space fees will be paid prior to certification of the final site plan. .,1 3. That the right~of-way from McMullen-Booth, Landmark Drive and Curlew Road shall be dedicated to the City and an agreement shall be prepared which guarantees the dedication of right-of-way within six months of certification of the final site plan and preliminary plat subject to all building inspections ceasing if right-of-way has not been dedicated. . 4. That the requisite initial building permits be issued within six months from the date of certification and all requisite certificates of occupancy be issued within two years from the date of issuance of the initial building permit. The motion was seconded by Ream Wilson. Discussion: 1. C. Henderson questioned the terminology about the building inspection ceasing and whether this actually shut down the building construc- tion since they could continue to build without inspection. He was advised that should building continue, the City has other ways to handle the situation. 2. P. Muscarella stated that this motion appeared to create a problem if you have a final site plan that shows the dedication and the plan does not go forward~ On the right-of-way dedication language, sha felt this did say that the owners are going to dedicate whether they end up with the property or it is another project. P. Harvey explained that the penalty is that building inspections would cease which means building will not go on. If the.developer has not pulled the building permit, there is no penalty. 3. The lands,caping plan was submitted and P. Harvey stated that if there were any problems with it this would have been noted on the inspec- tor's sheet. The motion carried unanimously.
