minutes of the September 15, 1987 meeting as written. Motion carried
unanimously (7 to 0).

Due to noncompletion of minutes approval of minutes of September 29,
1987 will be delayed until the Planning and Zoning Meeting scheduled
for November 3, 1987.

Chairman Jo~nson outlined the procedures for conditional uses and advised that
anyone adversely affected by a decision of the Planning and Zoning Board, with
regard to conditional uses, has two weeks from this date in which to file an
appeal through the City Clerk's Office. Florida Law requires any party
appealing a decision of this Board to have a record of the proceedings to
support the appeal.

Ms. Harvey advised as follows: This is a request for marina facilities,
specifically dry storage of boats, in the Resort Commercial zoning districtj
the governing sections of the Land Development Code are Sections 136 .025(b)
and (c)(17), which identifies that the granting of this conditional use
requires specific authorization by this Board for dry storage purposes; the
Traffic Engineer had no objection and the Code Administrator pointed out that
dry storage of boats may only be authorized in the CR-24 zoning district and
not in the Neighborhood Commercial zoned portion of the propertyj a rezoning
was presented to the Board last year with the intent to allow this type of use
on the property and it was determined during the public hearing that the type
of rezoning reque~ted was unnecessary to accommodate the proposed uses; and,
the CR-24 zoning was extended and provides for conditional use approval by
this Board for dry storage of boats. Ms. Harvey advised staff had no objection
to the above request but the following should be addressed: 1) Though it is
unclear if the subject site would be required to undergo formal site plan
review, any parking plan would be subject to the approval of the Traffic

Engineer specifically regarding ingress/egress to the site; and 2) Buffering
should be clarified specifically in relation to the North Ward Elementary
School north of the site.
Atty. Eadl C. Marquardt, representative of applicants, stated the boat parking
will be in the back half of the property which is zoned CR-24 and Neighborhood
Commercial will remain on the front of the property. He also stated applicants
have upgraded recently acquired property and applicants propose to have shops
along the front of the property geared to marine uses and boat parking in the
back half of the property. He further stated boats would be on trailers and
not stacked on top of other boats. He advised access will be to the Clearwater
Bay Marine property across from the area of the boat parking. He also advised
the buffering will be landscaping along the north side of the property and on
the east side of the property will be the buildings. Mr. Marquardt felt this
project will significantly upgrade the area.
After questioning by Mr. Schwob, Mr. Marquardt advised there will be no sail
boats and boat length would be limited to 25 feet. After questioning by Mr.
Hogan, Mr. Marquardt advised that boats were moved to the subject property due
to the threat of a hurricane and are scheduled to be returned to original
location. He further advised the Neighborhood Commercial portion of the
property will not be affected by the dry storage of boats.
After questioning by Mr. Hogan, Ms. Barbara Werder, applicant, advised the
entire area will be secured with fencing. She advised that for insurance
purposes the entire perimeter must be secured. She stated she would have no
objection to opaque fencing.

Motion was made by Mr. Schwab, seconded by Ms. Nash, to approve the above
request subject to the following: 1) That the parking plan be approved by the
Traffic Engineer; and 2) That opaque fencing and landscaping be installed

alcoholic beverages in the Beach Commercial zoning district for an existing
establishment located on Clearwater Beach; the establishment is currently
operating under a 4-COP-SRX license; the applicant is specifically requesting
the Board to reconsider the prior condition of approval in granting the
initial conditional use that limited the hours of operation to a midnight
closing, which condition was placed by this Board on November 18, 1986; the
Traffic Engineer had no comments; the Police Department saw no reason to deny
license to the applicant and the Police Department does have a file on the
former Dock of the Bay, though this is a different operation and a different

Hr. Adriano !attaglin.i, applicant, stated he had completely changed the
operation. He stated since he is not located in a main traffic area he does
not get enough customers to support the expense. He also stated that being
required to close at midnight does not allow employees from area businesses
who work until 11:30 PM or midnight to come to his establishment for a late
meal.
Ms. Harvey advised two letters of objection were received regarding the above
request.
The following persons appeared in opposition to the above request to give
their connnents:
Hr. Pau1 Schalz, 80D Sou~h Gml~view Boulevard, submitted an advertisement that
states dancing nightly from 9:00 PM to 2:00 AM (see attached). He felt
applicant was already in violation of the midnight closing res triction. He
stated he has no objection to a restaurant. lie stated since the midnight
closing time had been in effect there have been no problems but he felt if the
closing time 1.8 changed to 2:00 AM people will be going into the restaurant to
drink. Mr. Scholz also submitted a petition in opposition to the above request
(see attached).

Mr. Herbert Leonhardt, 706 Bayway Eoulevard, stated he is opposed to the way
some applications are drafted. He stated the hearing notice does not always
indicate who is the actual applicant. He also stated Tallahassee records
indicate only a registered agent for Dock of the Bay, Inc. and he felt the
Police Department could not tnake an accurate investigation. Mr. Leonhardt
stated the applicant did not meet the Board's condition of procuring a use
permit within 6 months since an Occupation License was not obtained until last
week. He stated a City license was first obtained for Maam Nina's on September
18, 1987 and applicant did not operate with a valid license from November,
1986 until that time. Mr. Leonhardt submitted copies of Pinellas County Code
sections regarding occupational licenses, Florida Statutes section regarding
fictitious nanes, and copies of general index to public records from Pinel1as
County (see attached). After questioning by Mr. Schwab, Mr. Leonhardt stated
the 12 midnight closing restriction has been satisfactory. He stated the
applicant is a good person and has done a good job but he felt a restaurant
cannot be operated as a bar. Mr. Leonhardt felt the illegal use of restaurant
licenses must be addressed in the City.
Hr. Donald J. GundersoD., 606 BalWay Boulevard, felt the previous 2:00 AM
closing caused dangerous traffic. He stated extra police service was needed to
patrol and to enforce laws. lie stated he has no objection to a legitimate
restaurant operation at the subject location if the restaurant closes at a
reasonable hour.

few months of quiet but felt Dock of the Bay and Mama Nina's is the same
place. She felt the previous decision should remain in effect.

Ms. Harvey advised as follows: This is a request for placement of a temporary
building in the Limited Office zoning district to be used as a real estate
sales office; the governing section of the Land Development Code is
Section 136.017(d) which gives the Board the authority to review a request as
a conditional use and the request is to be reviewed under the standards of
Section 136.025(b); the Traffic Engineer had no objection as long as parking
is provided for the temporary building in accordance with Code and that there
is no back out parking onto Enterprise Road; the site plan at tached as an
exhibit to the application is not a plan that has been submitted to the City
for formal review; and, any action by this Board does not constitute approval
of any permanent building on the site. Ms. Harvey stated staff recommended
approval of the request for the temporary building subject to the following:
1) That the use of the property for the temporary building occur within 6
months from the action of this Board; and 2) That the approval be granted for
a period of one year.

Mr. Barry Vogel, representative of applicants, stated a temporary real estate
and leasing and sales office is proposed. He also stated a site plan will be
submitted to the City for approval to construct office buildings on the site
but a temporary office is requested to start leasing space and possibly
selling condominiums on the site.

After questioning by Mr. Hogan, Mr. Vogel stated a site plan was submitted to
give the Board an idea what is planned but the plan has not been submitted to
the City. Ms. Harvey clarified that any review of the permanent structure and
permanent parking is not what is being looked at today. After questioning by
Mr. Hogan, Mr. Vogel stated the temporary building will be placed to the front
of the property on Enterprise Road with parking in front of the building. He
further stated the temporary building will be placed where parking for the
permanent building will be. After questioning by Mr. Johnson, Mr. Vogel
stated the temporary building will be just west of the new bank. After
questioning by Ms. Nixon, Mr. Vogel stated the temporary building will be a
single-wide mobile home.
Motion was made by Mr. Schwob, seconded by Mr. Green, to approve the request
for the temporary building subject to the following: 1) That the use of the
property for the temporary building occur within 6 months from the action of
this Board; and 2) That the approval be granted for a period of one year.
Motion carried unanimously (7 to 0).
After questioning by Mr. Schwob, Ms. Harvey advised the City of Clearwater has
the right-of-way for Landmark Drive and the right-of way is indicated on the

Ms. Harvey advised as follows: This is a request for on premise consumption of
alcoholic beverages in the Commercial Center zoning district j the specific
request is for a 4-COP licensej the governing sections of the Land Development
Code are Sections l36.025(b) and (c)(l); the applicant has an existing
operation known as Biarritzj applicant is proposing to expand into three other
tenant spaces in the shopping center, specifically areas located immediately
north of the existing space across an open plaza; the Traffic Engineer had no
commentj the Police Department saw no reason to deny license to applicant in
the additional space; and, the requested expansion area is within 500 feet of
a residentially zoned area. Ms. Harvey stated she would like clarification
from the applicant regarding the use of the open plaza area existing between
the existing area and the expansion area. Ms. Harvey stated staff recommended
approval of the request subject to the following: 1) That the use permit for
the expanded area be obtained within six months; 2) That approval is granted
subject to approval of a variance to the 500-foot separation distance by the
City Commission; and 3) That there be no outside activity from the
establishment in the plaza area located between the existing operation and the
proposed expansion area.
Hr. Wf.llf.am Buck., representative of applicant, stated applicant requests to
expand the existing nightclub to include an additional 4,000 square feet to be
used primarily as a restaurant. He stated applicant proposes to bridge the
existing 9>>000 square feet to the new area with a lO-foot wide surface bridge.
After questioning by Mr. Schwob, Mr. Buck stated applicant has proposed a
patio area to "'dress up" the area between the two areas and to be used for
lunch. He advised the patio decks are currently used for lunch but there would
be no live entertainment in the patio area. After questioning by Mr. Hogan,
Mr. Buck stated the loudspeaker system currently in place has caused no
complaints and it is not played loud enough to effect the residential areas.
After questioning by Mr. Schwob, Mr. Buck stated there is currently no patio
area and plans include a "water wallo" He, further stated there have previously
been overcrowding problems in the facility and applicant has worked ~ith the
Fire Department holding classes, exits have been changed, and furniture has
been rearranged. He also stated the Fire Marshal liked the idea of the patio
area because it would help alleviate overcrowding inside by having an outside
controlled area.
After questioning by Mr. Johnson, Mr. Buck stated the expanded area was
formerly a photolab.

Ms. Harvey advised the operation is within a shopping center and there are no
parking problems at the subject location. She expressed concern regarding
individuals, with alcoholic beverages. being on the patio area where there are
outdoor speakers. She added this nightclub situation immediately adjacent to
the parking lot at the front of the shopping center will be visible from u.s.
Hwy. 19. She also added the City Commission has expressed concerns regarding
this type of situation. After questioning by Mr. Schwob, Ms. Harvey stated the
lunch trade is a different situation and she clarified her concerns are with
the nightclub situation.
Ms. Nixon felt the orientation towards u.S. Hwy. 19 and away from residential
areas might lessen noise.
Mr. Buck stated the patio area is contained within a 42 inch high wall and
visibility to the area will be limited. After questioning by Ms. Harvey. Mr.
Buck stated the 42 inch high wall is to be added with the renovations. He
further stated the water wall faces u.s. Hwy. 19 and the patio area will not
be visible from u.S. lIwy. 19.
Ms. Harvey suggested that the Board continue its review of the subject request
in order for the applicant to submit site plans to indicate what is actually
proposed. She felt it would not be fair for the Board to make a judgement on
the request without seeing site plans.

request to the Planning and Zoning meeting scheduled for November 3, 1987.

approved for on premise consumption by this Board on June 30, 1987 at the
above location; the governing sections of the Land Development Code are
Sections 136.025(b) and (c)(2); the Traffic Engineer had no comment; the
Police Department saw no reason to deny license to applicant; and, the subject
location Is within 500 feet of residential uses and would be subject to review
by the City Commdssion if this Board approves the package sales use.

After ques tioning by Mr. Hogan, Mr. Bennison stated applicant was under
pressure by seller to close the sale of the above. He further stated that the
Planning Department advised applicant it would be better to request on premise
consumption only because a license for alcoholic beverage sales had previously
been in use at the subject location. lIe also stated the Planning Department
suggested applicant come before the Board after on premise consumption was
approved for the above location to request package sales.
After questioning by Mr. Schwob, Mr. Henry Cruise, applicant, stated the area
currently does a good business and he felt a package store would not add much
traffic. He felt package sales would be a service to the area since there are
no other package stores in the immediate area. He stated he would prefer
package sales and cut down on premise consumption. After questioning by Mr.
Schwob, Mr. Cruise stated he felt most sales would take place during the day
with some business at night.

Ms. Harvey advised that four letters of objection were received, two of which
specified opposition to package sales and two of which opposed alcoholic
beverage sales at the subject location.
The following persons appeared in opposition to the above request to give
their comments:

Mr. Alan Stowell, adjoining property owner to the east, stated he formerly
owned the subject property. He expressed concern about what is happening to
the area and felt the area is becoming ,a "bar strip." He stat ed he only
recently has made himself aware of the different license designations in order
that he know what is happening to his neighborhood. He also stated the
neighborhood recently formed a group to oppose the Board's approval of two
proposed establishments intending to sell alcoholic beverages. Mr. Stowell
stated the applicant currently owns the Beach Bar on Clearwater Beach, which
has a notorious reputation. He also stated the applicant has also owned the
Judge's Chambers lounge in downtown Clearwater. Mr. Stowell stated he learned
from applicant's manager that applicant plans to ~ore than double the business
with the package sales. Mr. Stowell stated he also learned from applicant's
manager that there will not be a separate entrance from outside and the only
entrance to the package store will be through the lounge. Mr. Stowell
sub1J1i tted a flier advertising applicant IS es tablishment (see at tached). Mr.
Stowell stated he was advised by the Traffic Engineer that new parking
req~irements will be proposed for lounge parking. ~r. Stowell felt approval of
the above request will be a detriment to Clearwater's health and welfare.

~. Roger Domyard, 2221 Curtis Drive North. Clearwater, stated two letters of
objection the Board received were from Mark and Deborah Ciechaigli and from
Micnael and Wilma Sarris. He advised he was asked to speak on their behalf in
opposition and are part of a group named "To Save Sparkling Clearwater." He
felt since there was no other package store nearby anyone who want~d to buy
pac~age sales would b,~ required to go to the subject location which would
cause more traffic problems. Mr. Douyard submit: ted photographs of nearby
establishll1ents that indicate lack of available parking (see attached). He
stated there have been 13 major accidents in the area in the past five months.

Mr. Douyard referred to recent decisions where requests for package sales were
denied by a hearing officer, both of which were denied in part due to the
locations being within 500 feet of residential areas. He stated there is no
available parking at night except on two residential streets. Mr. Douyard
stated it is the group's goal to fight the approval of any new or expanded bar
or establishment on Gulf to Bay Boulevard.
!Ir. Frank Pascoe, President, Horton Plant Life Services, Inc., stated he
represents the 300 residents from Bayview Gardens Retirement Community which
is now owned by Morton Plant Life Services, Inc. He advised the residents
object to the 4-COp license which is being enhanced by the package store and
which requires no food sales. He stated the package sales will be of no
benefit to the residents and expressed concern regarding the residents'
safety, security, and general health and welfare. He felt the Gulf to Bay

Ms. Harvey clarified that the request before the Board today is for the
expansion of services to include package sales. She stated whatever action is
taken by this Board will not affect the lounge currently approved.

After questioning by Mr. Schwob, Ms. Harvey stated she did not provide a
recommendation because this particular application has been involved in the
confusion of the new SOO-foot rule and complaints that were brought up before.
She stated she personally felt the Planning Department would feel the backlash
of any recommendation made, whether the recommendation was for approval or
denial, and she stated the decision lies with the Board.
After questioning by Mr. Green, Mr. Stowell stated he was not aware that the
4-COP request had been before the Board and he would have opposed the request.
He stated that any change of ownership requires approval by the Board. He also
stated he was advised by applicant's manager the business is expected to
double with the addition of package sales. Mr. Stowell advised he understands
he can only oppose the package sales request and felt the package sales would
be a detriment to the neighborhood.
In rebuttal, Atty. Bennison stated he objects to the reference to Mr. Cruise's
"notorious reputation on Clearwater Beach" and the reference to the Judge's
Chambers. He stated this request is to consider package sales at Mr. Cruise's
establishment on S.R. 60. He also stated he felt the Board should disregard
hearsay statements regarding parking and doubling of sales and that persons
making such statements should be brought before the Board personally. Atty.
Bennison felt the hearsay statements were improper. He stated parking for
package sales is short term.

In final rebuttal, applicant Henry Cruise stated a beer sold for $.25 and a
bottle of alcohol sold for $9.00 will cause sales to double. He stated he is
trying to sell more package sales than on premise sales. He also stated he is
not required to sell food. He further stated he could run advertisements and
have music but this is not his intention. He stated he particularly wants a
package store. He advised there is plenty of parking at his establishment and
his parking lot has not been full since he has been at the subject location.
Mr. Cruise stated one of the gentlemen speaking in opposition had gone into
his establishment the previous day and requested to buy a 6-pack of beer. Mr.
Cruise stated the customer was advised the a 6-pack could not be sold until
package sales was approved by the Board.

the expiration of the license year. She also advised that procuring an
Occupational License does not require special review. She further advised that
various City offices that issue permits or licenses notify applicants they are
required to go before this Board for alcoholic beverage zoning. Ms. Harvey
advised if the Board members or anyone discovers someone in violation of these
requirements that person should notify the Code Administrator's Office in the
Planning and Urban Development Department.

Ms. Harvey- disagreed. She stated the City is not in legal trouble by not
enforcing deed rest rictions. She advised the City is not a party to deed
~ restrictions and unless the City is a party we cannot enforce deed
~ restrictions. Mr. Hogan said the City is party to a taxable body. Ms. Harvey
stated the City is not a party unless it is made a party. She also stated in
some cases the City is a party because the property owner has included with
the deed restrictions that the deed restrictions cannot be amended without the
approval of the City of Clearwater. She advised this is mostly done without
the City's knowledge and at such time a property would go before the City
Commission for action the City Commission always requests the City's name be
removed from the deed restriction. She further advised the City has no
obligation to enforce anyone's private deed restrictions because they are done
by the private property owners without the consent of the City of C1ea~ater.
Ms. Harvey used as an example tha.t a property owner could write a deed
restriction allowing buildings to be built up to a roadway and the City could
not be expected to enforce such a deed restriction if it is in violation of
City Code to so do. Mr. Hogan stated it should not be the City's position to
enforce deed restrictions but he felt the City is ignoring the deed
restrictions on taxable property. He felt this should be looked into.

In regards to a recent hearing officer decision wherein the Board was
overturned, Mr. Hogan stated Mr. Galbraith has chosen not to back up in any
way the decision of this Board. Ms. Harvey advised that both she and Mr.
Galbraith attended the hearing officer appeal and defended the decision of
this Board. Mr. Hogan stated Mr. Galbraith said he does not recommend the City
seek judicial review. Ms. Harvey requested Mr. Hogan be very careful in his
selection of words. She stated both she and Mr. Galbraith attended the hearing
and defended the decision of this Board. Mr. Hogan stated he did not say what
Ms. Harvey did at the hearing but stated Mr. Galbraith does not recommend the
City use the legal process to back up the decision of the Board. Ms. Harvey
advised it is the City Commission's decision whether to seek judicial review
and the authority to go to court is not a decision Mr. Galbraith makes but
must be obtained from the City Commission. She also advised Mr. Galbraith
suggested the City Commission not seek judicial review but the Commission
could have decided the case should be taken to court. Ms. Harvey clarified the
decision is on the part of the City Commission not the City Attorney.
Mr. Schwob expressed concern that deed restrictions are more or less ignored.
He also expressed concern that the hearing officer overturned a unanimous
decision of the Board.
Ms. Harvey stated she hopes the Board does flot feel staff is completely
ignoring deed restrictions, because staff does not ignore deed restrictions
and they are taken into consideration to the extent that the City can obligate
itself to enforce deed restrictions. Ms. Harvey advised if the Board felt this
is a subject the City Commission should address it can, but she also advised
she is not sure, legally, whether the City Commission has the authority to do
this anyway. She stated the Board would need to suggest to the City Commdssion
that it take into consideration deed restrictions but advised that, in the
past, the Commission has gotten out of deed restrictions whenever possible.
She also stated the City Commission knows the difficulty in enforcing deed
restrictions and it is not their desire to so do.

Mr. Hogan stated the City probably cannot enforce deed restrictions but they
are enforceable in the County. Ms. Harvey stated the County cannot enforce
deed restrictions but deed restrictions must be settled between property

Sec. 2.19-106. Occupational license required.
No person shall engage in or manage any business, pro-
fession or occupation within the limits of this county for
which at;. occupational license tax is required by this ordinance
[article] unless a county license shall have been procured from
the tax collector of this county. Such license shall be issued to
each person upon receipt of the amount hereinafter provided,
or as may be otherwise provided by law. Furthermore, fees or
licenses paid to any board, commission or officer for permits,
registration, examination or inspection shall be deemed to be
regulatory and in addition to and not in lieu of any occupa-
tionallicense required by this ordinance [article] unless other-

Sec. 2-19-108. Definitions.
For the purposes of this ordinance [article]:
