Ms. Harvey advised this request is for three different conditional uses,
specifically for: noncommercial parking in the RM-8 (Multi-Family Residential
"Eight") zoning district; and, outdoor retail sales, displays and/or storage
and vehicle service in the CG (General Commercial) zoning district. She
further advised the governing sections of the Land Development Code are
Sections 136.025(b), (c)(19), (c)(22), and (c)(27). She also advised the
Traffic Engineer had no comment. Ms. Harvey stated the preliminary site plan
shows two primary features, one being the building for the service and the
other being the specific classifications proposed to be used for parking for
the remainder of the property
Ma. Harvey stated that part of the subject property was recently rezoned to
RM-B, at which time the RM-8 zoned property was intended to be used as
noncommercial parking. She further stated that following the rezoning it was
detexmined that noncommercial parking is parking required of the use,
primarily for users of the facility, such as customers, employees, etc.
Me. Harvey advised that the City Commission felt this type of noncommercial
parking would cause more movement and more disturbance to adjacent residential

also advised that the city Commission requested it be made clear to the
applicant that no retail sales activities take place in the RM-8 zoned area
and the area is not intended for long-term storage of vehicles.

Ms. Harvey advised that in regard to noncommercial parking this Board has con-
sistently required buffering from adjacent residential areas and requested the
Board require buffering not only adjacent areas zoned residential but also
areas used residentially. She also advised the site plan indicates that
entrances to the building are oriented away from residential areas. She
further advised that the Board should specifically identify allowable service
uses as required in Section 136.025(c)(27) of the Land Development Code after
questioning the applicant regarding such service uses, Ms. Harvey advised the
Planning Department recommended approval of the three requested conditional
uses subject to the following conditions: 1) That the building permit be
procured within six months of certification of the final site plan; 2) That
there be buffering of all the uses from adjacent residentially used areas; and
:;?,?. 3) That the service uses authorized be specified by the Board.
Mr. William J. Kimpton, representative of applicant, stated Che applicant is
willing to give up major repairs, is agreeable to buffering and is agreeable
to the specific limitations for vehicles parked in the RM-8 zoning.
After questioning by Mr. Hogan, Mr, Kimpton advised the "Rehab Center" is
intended as the area where new and used vehicles are received, parked on the
lot, and prepared for sale. He also advised that no body work is intended to
be done in the service building.
After questioning by Mr. Ferrell, Mr, Kimpton advised the work intended to be
done in the service building is washing, waxing, changing oil, detailing work,
etc. He further advised that any major work will be done at another location.
Mr. Schwob suggested that no major repairs, such as engine or transmission
dismantling, painting, body, fender, muffler, top and upholstery work, be
allowed.
After questioning by Ma. Nixon, Ms. Harvey advised that the Board has consis-
tently required opaque fencing for buffering, Mr. Kimpton advised the
applicant would prefer opaque fencing to help protect the vehicles.
After questioning by Mr. Johnson, Mr. Hank St, Jean (representative of
applicant) advised the green apace noted on the site plan is required by the
Code and nothing will be parked in the green space.

operating as Frenchy's is owned by Michael Preston and the property to be part
of the Unity of Title is under contract Eor purchase, which contract is con-
tingent upon approval by the necessary government entities of the City of
