Ferrell, Green, Hogan, and Schwob (A) On motion by Ms. Nixon, February 3, 1987 meeting unanimously (7 to 0). seconded by Ms. Nash, the were approved as written. mi nutes Motion of the carried Chairman Johnson outlined the procedures for conditional uses and advised that anyone adversely affected by a decision of the Planning and Zoning Board, with regard to conditional uses, has two weeks from this date in which to file an appeal through the City Clerk's Office. Florida Law requires any party appealing a decision of this Board to have a record of the proceedings to support the appeal. (8) Conditional Uses: 1. Lot 1 and Part Lot 2, Blk. 8 Country Club Addition (1100 Jackson Road) Alice Long ClJ 87-10 e Request - Level I Group Care Zoned RS-8 (Single-Family Residential "Eight") Ms. Alice Long, applicant, appeared requesting approval of this conditional use. Ms. Long advised she has cared for seven (7) elderly persons for two or three years and she is now requesting approval to care for ten (10) elderly people. She further advised she has a long wait ing list for new residents. Ms. Long stated she felt her home is more beneficial to elderly persons than is a nursing home. No persons appeared in support of or in opposition to the above request. Ms. Harvey advised this request for conditional use is for a Level 1 Group Care Facility in the RS-8 zoning district. She also advised that twelve (12) persons are proposed to be housed in the subject facility. Ms. Harvey advised the Board the governing sections of the Land Development Code are Sections 136.025(b) and (c)(14) and Section 136.020. Ms. Harvey stated the Traffic Engineer had no objections provided suitable parking is available. She also stated that Section 136.020 requires: three (3) parking spaces and applicant is providing three (3) parking spaces; 15,000 square feet in lot size and applicant is providing 16,800 square feet; and 2,800 square feet in living space and applicant is providing 2,943 square feet. . 1\ :.; j~..." "'. <' .c.; .,' ~J: '," > : '~". \ . ~ :;~~t~;_Of the Planning and Zoning Board - February 17, 1987 Ms. Harvey stated that on April 15, 1986, the Planning and Zoning Board approved a Level I Group Care Facility with a limitation of ten (10) persons. Ms. Harvey advised the Planning Department recommended approval with the following conditions: 1) That there be a maximum of twelve (12) persons living in the home; and 2) That the use permit be procured within siK months of the approval of the conditional use. After questioning by Mr. Green, Ms. Harvey advised the zoning directly across Greenwood Avenue from the applicant is Medium Density Residential on the Land Use Plan and would be classified as either RM-12 or RM-16. After questioning by Mr. Schwob, Ms. supervisor and the other supervisors oldest resident is 97 years old. Long advised she is the only resident are nonresidents. She also advised her Motion "Was made by Mr. Schwob, seconded by Mr. Hogan, to approve the above request with the following conditions: 1) That there be a maKimum of twelve (12) persons living in the home; and 2) That the use permit be procured within six months of the approval of the conditional use. Motion carried unanimously (7 to 0). 2. Lots 6 through 10, Blk. A Hibiscus Gardens Sub. (1285 Cleveland Street) E.M. Dunn & Jean F. Dunn (Suncoast Oil Co. of FL - Fina)/Steven M. Dunn CU 87-11 e Request 2-APS (Package Sale of Alcoholic Beverages) UC(E) [Urban Center District (East)] Zoned Mr. Steven M. Dunn, representative of applicant, appeared requesting approval of this conditional use. Mr. Dunn advised that applicants currently are conducting package sales of beer and now wish to upgrade their license to include package sales of wine and wine coolers. After ques tioning by Mr. Schwob, ~r. Dunn advised approximately a 20% increase in sales is anticipated with the addition of wine and wine cooler sales. No persons appeared in support of or in opposition to the above request. e Ms. Harvey advised this request for conditional use is for package sales of alcoholic beverages in the Urban Center District (Eastern Corridor) zoning district on property fronting on Cleveland Street. She stated the applicants desire to upgrade their license from 1-APS to 2-APS. Ms. Harvey advised the Board the governing sections of the Land Development Code are Sections 136.025(b) and (c)(2). Ms. Harvey stated the Traffic Engineer had no comment and the Police Department saw no reason to deny license to applicants. Ms. Harvey advised the Planning Department recommended approval with the condition that the use permit be procured within six months of the approval of the conditional use. > '~'!
