Chairman Johnson outlined the procedures for conditional uses and advised that
anyone adversely affected by a d~ci5ion at the Planning and Zoning Board,
wi~h regard to conditional uses, has two weeks from this date in which to
file an appeal through the City Clerk's office. Florida Law requires any party
appealing a decision of this Board to have a record of the proceedings to

Mr, Russell Latimer. applicant, appeared requesting approval of this
conditional use. Mr. Latimer advised he has been operating a restaurant at
this location for iive years and has had no problems with police, the Health
Department, overcrowding, or the Fire Department. He advised he has five
restaurants in the Bay area. Mr. Latimer 5~ated the Hillcrest center is on
Highwa.y 19 between Countryside and Clearwater Malls. He also stated the other
tenants in the center have no abJection to package sales of alcoholic
beverages. Mr. Latimer advised the restaurant occupies four uni~s in the
center and the package sales addition would occupy a fifth unit. He advised
the addition would bQ attached to the restaurant but would not be an access to

record is good enough to allow package sales. After further questioning by Nr.
Hogan. Mr. Latimer stated the addition of package sales would get rid of one
empty storefront in the shopping center. Mr. Latimer also stated that the
large volume of patrons and the distance to tho nearest package store warrants

(c)(i) and (21. Ms. Haf've~ stated 'che Traffic Engineer had no objection and
the Police Department verball~ advised it saw no reason to deny the licellse to
the applicant. Ms. Harvey further stated the applicant's location is within
the Hillcrest Shopping Center, which is the current location of Melon's. Ms.
Harvey also stated the Planning Department had difficulty in determining if
there is sufficient reason to accommodate the addi~ional package sales in
this location. Ms. Har'vey advised the shopping center' is adjacent to a
residential use. Ms Harvey also advised that the restaurant appears to
operate with little conflict; huwever, the Planning Department finds no
Justification for expansion of the use to accommodate package sales and for
that reason the Planning Department recommends denial of this conditional use.

residential condominiums directly adjacent to the Hillcrest Shopping Center,
He advised the parking lot is very conjested and the fire department has on
at least one occasion cited the applicant for overcrowding in the restaurant.
Mr, Roman submitted copies of 18 police reports concerning alcoholic beverage
problems at Melon's and another alcoholic beverage establishment located in
the shopping center (copy of reports attached), Mr. Roman submitted a petition
containing signatures of 144 unit owners or occupants. Mr. Roman advised there
is an ongoing problem due to poor design of the shopping center as there is
only one commercial delivery area, Mr. Roman advised there is an
ingress/egress easement between the properties owned by the condominium
association and the commercial owner of the shopping center that has still not
been resolved. Mr. Roman stated patrons of the establishments trespass on the
condominium property, there is vandalism on the condominium property, and
urinating on the condominium property by the patrons. Mr. Ro~an recommended,
on behalf of the condominium association, that the application be denied,

After questioning by Hr, Schwab, Mr. Roman advised there has recently

After Ms. Nixon stated that some of the police reports were generated as a
result of complaints by applicant and most of the reports appeared to be ~ore
related to the other alcoholic beverages establishment in the shopping center,

possibility of morc problems with a package store.

has he had problems with overcrowding, he has no games or liquor promotions on
premises. Mr. Latimer stated he has refused to take deliveries behind the
restauran~ to alleviate problems with condominium residents. Mr, Latimer
submitt.ed pictures Ot the back of the building showing ~he fence that was
recently inst.alled (pictures attachedl. Mr. Latimer advised the center was not
built for offices as the front Ot the storerooms are glass. Mr. Lati~er
further st.ated he has a lease with Florida Powel' Corporation to use their
access on the north side of the C(Hlt.er'r. property for parking for LIP to 500
cars. He also stated that there would be onl~ two or ~hree customers at one
time in the package store, and allowing package sales would not change any
cOQplaints. Mr. Latimer sLat.ed he checks heavily for ~inors and does not serve

Ms, Harve~ advised this is a request for conditional use in a Highway
Commercial zoning district specifically for outdoor retail sales and storage
and vehicle service. Ms. Harvey advised the Board the governing sections of
the Land Development Code are Sections 136.025(b) and (c)(22) and (27). The
Traffic Engineer expressed concern that there not be any parking in the public
right-of-way. Ms, Harvey pointed out to the Board that this projected
expansion will be subject to a formal site plan review, at which time the
appropriate departments will make comments concerning the subjects of parking,
right-of-way, etc, Hs, Harvey also pointed out that the formal site plan
review will give the Cit~ more room for enforcement. Ms. Harvey advised the
Planning Department felt this use is similar to other uses along U.S. 19 and
the adjacent developments should not be adversely affected by this use, Ms.
Harvey further advised that for these reasons the Planning Department is
recommending approval of the above conditional use.

Captain James Ardes, representative of applicant, appeared requesting approval
of this conditional llse application. Captain Ardes stated one of the reasons
the Harbormaster is recom~ending denial of this application is that, under the
law, this request is considered a Marina because there are more than six slips
proposed; however, the owner bought the apartment building with the idea in
mind that apartment residents would have the boat docks at their disposal.
Captain Ardes fUl'ther stated the original dock was designed far slips but
currently applicant can allow only three or four boats to dock at one time. He
also stated there were several designs proposed but the current design is the
design that would necessitate the least amount of variance, Captain Ardes also
advised the applicant would prefer to place the dock parallel to the seawall
if it were not far residents being in opposition to sa~e. After questioning
b~ Hr. ~ohnsan, Cap~ain Ardes advised there are 12 apartments with a proposal

building has been upgraded. Mr. Owens further advised he intended to purchase

what most persons living at the beach want, He stated the cleats are in place
on the 5eaw~11 and are of no value as is the current boat dock due to ~he

stated the water basin from wall to wall is approximately 300 feet wide and
his dock currently extends approximately 16 feet into ~he basin. He fur~her
advised his secondary plan was to extend the dock into the basin but would

by HI', Hogan, Mr. Owens stated most of the basin is silted in similar to his
property and i~ is his understanding that if more boats were used in the basin
it may possibly be a contributing factor in keeping the basin from becoming
more silted in. Mr. Owens further stated he is to the point that he may need
to consider selling the property though he would like to be a longtime
resident of the area.

permitted to use the docks. After questioning by Mr, Schwob, Ms, Anderson
stated her dock extends less than 20 fee~ into the basin and at low tide the
boats at her dock are aground.

there were oil slicks around his dock. He further stated he feels dredging is
necessary. He also stated that several years ago this area was designated and
rezoned by the City as residential and it was indicated in the rezoning that
the apartm8n~s could not be expanded.
Ms. Harvey pointed out to the Board and persons present at the hearing that
this Board does not review variance requests and the actual length of the dock
is outside the purview of this Board. Ms. Harvey expressed concern that the
actual drawing with the application is the drawing that the Harbormast~r
reviewed and recommended denial and is not the design being described by the
applicant today. Ms. Harvey suggested that if the Board feels that the use of
the marina facilities is worthy of consideration, the item should be continued
until a proper site plan is reviewed by the Harbormaster and he is able ~o

recommend approval to the Board on any conditional use for marina facilities
when the Harbor~aster feels there will be a problem with navigation and this

questioning by Mr, Johnson, Ms. Harvey advised a continued hearing could be

Mr. Dominic Framalin, applicant, appeared requesting approval of this
conditional use request. He stated he presently owns a restaurant called
Britts on Clearwater Beach. He also stated that, after acquiring an additional
storeroom adjacent to the existing restaurant, he proposes to use the
~dditional storeronrn to sell sandwiches, soda, candy, etc. and requests
approval for sales of package beer and wine.
No persons appeared in support of or in opposition to the above request,
Ms, Harvey advised this is a request for conditional use for package sales in
the CR-28 zoning district located in Clearwater Beach. She further advised the
Board the governing sections of the Land Development Code are Sections
186.025Ib) and (cJ(2) Ms. Harvey stated the Traffic Engineer had no comment
and the Police Department verbally advised it saw no reason to deny license to
applicant. Ms. Harvey stated the Board previously granted package sales to the
applicant, but since the package sales is in a new area, the Planning
Department has considered this an expansion of use. Ms. Harvey advised the
Planning Department recommended approval with the condition that the use
permit be procured within six months of approval of the conditional use.
After discussion by the Board, it was determined that the Board previously set
a lilrdtation on hours of package sales to end at. 7: 00 PM. Mr. Framalin
clari Ued for l.he Board that the 7:00 PM cessation of package sales was for
his premises and had no objection to it so continuing,
Motion was made by Ms. Nixon, seconded by Mr. Hogan, to approve the above
request with the following conditions: 1) That package sales be discontinued
at 7:00 PMi and 2) That the use permit be procured within six months of the
approval of the conditional lIse. Motion carried unanimously 17 to 0>.

Ms. Harvey stated she recently received notice concerning the appeal of Harry
Hasty and Pick Kwik conditional use. She further stated this was a conditional
usa for package sales which the Board denied and was later overturned by the
Hearing Otficer, She advised the Hearing Officer stated his reasons for
overturning the Board were it appeared the biggest concern was the hours of
operation and applicant was able to provide evidence that it met the governing
sections of the Land Development Code. Ms. Nixon stated this conditional use
was the use where the Board considered placing a closing time of 10:00 PM on
the applicant rather than denying the application, and she felt if the
limita~ion was placed on the applicant the Hearing Officer would not have
overturned the Boa~d's decision.
