September 30, 1986 meeting were approved as written. Motion

Chairman Johnson outlined the procedures for conditional uses and
advised that anyone adversely affected by a decision of the
Planning and Zoning Board, with regard to conditional uses, has
two weeks from this date in which to file an appeal through the
City Clerk's office. Florida Law requires any party appealing a
decision of this Board to have a record of the proceedings to
support the appeal.

Mr. Ken Hamilton, applicant, appeared requesting approval of this
conditional use application. He indicated applicantts specific
request is to change from I-COP license to 2-COP license in order
to serve wine in addition to beer. He further indicated that wine
coolers would be the primary wine item for sale and wine coolers
have only half the alcohOl content as beer. All wine and wine
coolers will be served in cups and there will be no bottles used.
Mr. Hamilton stated that under Planning regulations the Palm Pavilion
qualifies as to seating accommodations and provides 33 or 34 parking
slots. Mr. Hamilton made special note that sales will be strictly
for on premise consumption and there is no intent to sell for
off premise consumption.

". . . Any activity (e.g., servicing, fueling, pumping-out,
chartering, living-aboard, launching or dry storage) shall require
specific authorization by the planning and zoning board in order
to be permitted." Ms. Harvey then ~adviscd " this particular appli-
cant is asking for fueling, pump-out, overnight stay aboard, bait
sales, food and beverage. sales including alcoholic beverages. She
also indicated the alcoholic beverage sales would have to be approved
at a later time, since this application does not contain this specific
request.
Ms. Harvey also advised that the" preliminary site plan has been
submitted to the City Commission and will go back to City Commission
for final approval. Also, there has been some question by staff
regarding parking availability on the site. The applicant stated
in his application that, since no monthly rental of boat slips is
anticipated, he doesn't feel he should have to comply with commercial
parking requirements in the Code, which specifically states that
~ parking:.space per dock slip be provided. The Planning Department
feels this parking should be required. Ms. Harvey advised that
staff recommended approval conditioned upon sufficient parking being
provided or parking variance obtained. Ms. Harvey also advised that,
if conditional use application is approved, the Board specify uses
approved as governed by Section 136.025 (c) (17) above quoted.
After questioning by Ms. Nixon, Ms. Harvey stated 8 additional parking
spaces would be required.
Ms. Nixon indicated she would not be opposed to boat slips, but would
be opposed to fueling and bait shop if opened to the public.
Mr. Schwab agreed with Ms. Nixon and expressed, further concern about
what impact increased boat traffic would have on nonflushing canal.
He felt if marina is for overnight stay, the traffic impact would be
minimal, but fueling faciliti~s may cause a lot of traffic and addi-
tional danger of spills.
Mr.' Johnson felt the:,residents' main concern is the commercialization
of marina and traffic, but felt there was little opposition to hotel
and boat slips.
Mr. Green felt in.regard.to.commercia1ization that applicant has not
asked for any variances and the request for boat slips seemed very
reasonable. He further indicated if fueling is for hotel guests only
there may not be a problem.
Ms. Nash questioned Mr. Seaton if he felt he could still go ahead with
the project without a bait house, liquor sales, and fuel sales.
Mr. Seaton answered he feels he needs~l amenities to have a
full-facility resort.

Ms. Harvey indicated this is a request for a conditional use for
consumption on premises of alcoholic beverages. The application
is for an establishment known as 'Cafe Montego~' formerly known
as Dock of the Bay. She further indicated that a similar appli-
cation was submitted to the Board several months ago, that
being a request for consumption on premises and package sales of
alcoholic beverages. She stated what is prompting this request
is a change in state designation of the license from a 4-COP-SRX
to a 4-COP which will eliminate the requirement of 51\ food sales.
She stated the Traffic Engineer had no comment. She also stated
a memorandum from Chief of Police Sid Klein, which has already
been submitted to the Board, basically restates information pro-
vided by Planning. Ms. Harvey indicated that Chief Klein is also
present and will address the Board on the specific request. She
further indicated Planning has received several telephone calls,
one from Mrs. Carra Best, immediately adjacent to the subject
establishment. Ms. Harvey indicated she has also received a
petition from residents and property owners from the southern~end
of Clearwater Beach which petitions the Board for denial of the
requested use.
In support of the above request, the followi~g persons appeared
to give their comments:
Mr. William P. Mertle, 825 South Gulfview Boulevard~ stated he
aoes not know the owners of Dock oE the Bay, but was prompted to
attend hearing when he was asked to sign a petition asking that
the owners not be given a license. He further stated he didn't
notice anyone, in his opinion, on the petition who had a right to
object to the license and yet they signed the petition. He also
stated he stopped in at Dock of the Bay a number of times for food
and he has not encountered anything objectionable inside the
premises except some noise, which he felt young people will make.
He said the people were friendly and the food was good. Mr. Mertle
stated he watched the premises one night at 2:00 AM and noted two
policemen on duty. and that there some some noise but no trouble.
He feels Dock of the Bay should not be shut down because of a
handful of rowdies. He feels this applicant is doing something
right; applicant should be given the opportunity to continue;
and, the City should help in any way it can.
Mr. James Cameronl 1525 South Jefferson Avenue, feels the applicant
is making every etfort possible to see that the neighborhood is
taken care of.
Ms. Janice McGowan, 510 Grand Central Street, feels pa~t of the com-
plaints of rowdiness are exaggerated and that the publicity has
gotten out of hand. She further stated she has no fear of bringing
her 10-year~01d daughter into Dock of the Bay to eat.

that, as demonstrated by recent court decisions, it is doubtful
that Clearwater could be' more restrictive in this particular
area than the state licerise in preventing package sales if this
is what applicant wishes to do. Chief Klein further stated that,
in actuality, this is substantially the same request made in June,
which was denied by this Board and which should be denied at this
time for the same reasons. Chief Klein further indicated that
he has personally spoken to the Director of the Division of Alco-
holic Beverages and Tobacco and this situation has been scheduled
for formal hearing, which could result in revocation of Dock of
the Bayts license for failure to maintain 51% food sales. He
also indicated that Dock of the Bay is being allowed to operate
under the name of Cafe Montego until a formal hearing has been
held. Chief Klein recommended to the Board that it would be
inappropriate at this time to approve a change in the license.
He felt, in all fairness.to the applicant, if the state does
rule in his favor, it would then be appropriate to bring this
matter back to this Board. .

Mr. Robert J. Furr, 501 Bayway Boulevard, stated he is only
mildly in opposition to Dock of the Bay. He further stated that
since the applicant wishes to continue serving food, that should

the 51% food requirement. Mr. Furr feels any establishment
serving liquor should also serve food. Dock of the Bay has been
the center of controversy on the beach and the license is within
a commercial district, but it is completely surrounded by resi-
dential hotels, motels and condominiums. Mr. Furr would like
to see some way to compromise and still allow residential people
some way to get some sleep before 2:00 AM. He would also like to
see Dock of the Bay stay in business and continue to serve food
and provide a place for young people to go. He stated all the
residents are asking is that Dock of the Bay hold down the noise
to stay in business.
Mr. Paul Scholz, 800 South Gulfview Boulevard, submitted a petition
w~th "about 50 signatures." He.'stated he could not get more sig-
natures because building occupancy is at its low point now until
out-of-town residents return. He further stated Dock of the Bay
has been better in the last couple of months, but it is the noise
that he objects to.
Mr. W. A. Shodack, submitted a petition and also a letter from
the Clearwater Islands Association. Mr. Shodack felt there is
not much to be done at this point and the Board should wait
until the State makes its decision.

came up with about 4 hours against his establishment. ~lr. DuQuesnay
also stated that a 4-COP-SRX license requires 51% food sales and v~
if you cannot meet the requirement, like several other restaurants
cannot do, you buy a 4-COP license which costs about $125,000 and
has no food sales restrictions. He further stated the law does
impose restrictions on hours of operation for a 4-COP license.
Mr. DuQuesnay indicated that ~he state will revoke his SRX license
because he cannot do 51% in food business. He further indicated
that he wants to be legal and that is why he is applying for a
4~COP license. He feels the only holdup now is Zoning' and he
doesn't feel it is fair. He stated that if his license is denied,
he feels his only alternative is to stop selling alcoholic
beverages and turn his place into a teen disco, and.,he doesn't
feel the opposition would care for that alternative.
After questioning by Ms. Nixon, Mr. DuQuesnay stated that the
percentage of food sales has increased to about 40 to 42%. He
further stated his most manageable range is 35 to 40% food sales
and that 51% food sales is impossible' to do.
Mr. Schwob asked for the Planning Director's recommendation.
Ms. Harvey stated she did not make a recommendation::'and was
not prepared to do so. Ms. Harvey pointed out to the Board
that this area is zoned commercial and that motels are not per-
mitted in residential districts. She further pointed out that
the condominiums are in a commercial area mainly because developers
specifically asked for commercial zoning to get higher density, a
greater amount of building coverage, and less setbacks. Ms. Harvey
advise the Board this application should be reviewed from the
standpoint of compability of the proposed use in relationship
to what is surrounding it, and to specifically look t02Section
136.025 (b) of the Land Development Code in making its determina-
tion, and that determination should be made based on the standards
outlined in the Code.

Ms. Nixon stated in this case, where a restaurant is next to a
condominium and the people knew they were there beforehand, she
feels residents don't have a problem with a ful1~service restau-
rant. She does have, and thinks the residents have a problem
wi tll a full-service bar in this' particular. area. She feels a res-
taurant is compatible because it was there in the beginning.
Ms. Nixon stated that what happens on one's property is one's
responsibility and is not the responsibility of the Police
Dopartment to keep patrolling the parking lot, and further, more
effort should be made to patrol one's own parking lot. She feels
a restaurant in this area is okay but the bar part is not. She
stated the 51' food sales requirement is a good requirement for
areas bounded b~motels, hotels and condominiums.
