Vaccaro CU 86-64 (. Request ~ Non-commercial parking Zoned - RM-8 (Multi~Family Residential) Mr. S. J. Vaccaro) owner of Discount Marine, appeared requesting approval of this conditional use application. His intent is to use property for off street parking. One letter of support was received from Robert J. Rice) President and Owner of Carillon Rug Company, 1107 North Ft. Harrison Avenue, who feels approval of this conditional use application will be an asset to the downtown area. e No persons appeared in support of or opposition to the above request. Ms. Harvey stated that the Traffic Engineer had no objection to the conditional use application and noted that the Code Adjustment Board granted a variance on this project subject to approval of the con- ditional use application for non-commercial off street parking. Ms. Harvey advised that staff recommended approval with the following . conditions: That a 6-foot opaque fence be provided along property line adjacent to RM-8 zoning; and) the use permit be procured within 6 months of approval of the conditional use. Mr~. Vaccaro stated he,would have no objection to installing the :6-foot. opaque fence as recommended by staff. ~ Motion was made by Mr. Hogan, seconded by Mr. Schwab) to approve the above request with staff recommendations. Motion carried unanimously (7 to 0). 3. Lots 1 - 6 incl., Blk. 2 Knollwood Replat Sinbad's (1407 Cleveland Street) George Arfaras 86-65 - Request - ZCOP (On. Premise Beer/Wine) Zoned - CG (General Commercial) Mr. Frank DeLuca, proposed new owner of above premises, appeared requesting approval of this conditional use application. Mr. DeLuca indicated proposed restaurant was the former Uncle Munchy's restaurant. Minutes of the Planning & Zoning Board - September 2, 1986 Page -3- o Mr. DeLuca stated the restaurant is not in operation at this time. Mr. DeLuca confirmed, after questioned by Mr. Hogan, that his request was for on premise sale only of beer and wine. No persons appeared in support of or opposition to the above request. Ms. Harvey stated that the Traffic Engineer had no comment and the Police Department saw no reason to deny license to applicant. Ms. Harvey advised that staff recommended approval with the following conditions: If Board .approval is granted, that the Board clearly identify that approval is for this particular establishment and not the entire shopping center; and, that the use permit be procured within 6 months of approval of the conditional use. Motion was made by Mr. Schwob, seconded by Ms. Nash, to approve the above request with staff recommendations. Motion carried unanimously (7 to 0). 4. Lots 19 & 20, BIk. A Bayside Sub #5 Sea Gull Beach Cabanas & Yacht Club Co-Op (674 Bayway Boulevard) Sea Gull Beach Cabanas & Yacht Club, Inc. CU 86-66 e - Marina Facilities to include Charter Boat/Fishing/Diving - CR-28 (Resort Commercial) Mr. Robert J. Greenough, applicant, appeared requesting approval of this conditional use application. He stated he is actually applying for dock space to keep his boat. He intends to pickup and discharge passengers from other locations. Ms. Harvey questioned what assurance Mr. Greenough could give the City that passengers would not be picked up or discharged at this location. Mr. Greenough responded that he would comply with any condition the Board would place on his appli- cation. Request Zoned Mr. S. J. Vaccaro appeared in support of applicant. He indicated he docks a boat at same location and he had no objection to approval:of application as long as passengers were not picked up or discharged from this location. Mr. Rodney Brandenburgh appeared in opposition to 'the request because of Mr. Greenoughts business practices. e Minutes of the Planning & Zoning Board - September 2, 1986 Page -7- ~ (C) Applications for Land Development Code Amendments 1. Section 137.0065, Chapter 137, Article 111, Paragraphs (1) (5) To provide a regulatory mechanism to join title to two or more properties that have been joined as a single unit for develop- ment purposes. Ms. Harvey explained the purpose of this amendment is to require a "unity of title" on lots, plots or parcels that have been joined for a development purpose. This would avoid the possibility of the joined property being split at a later time, which would make the major parcel nonconforming~ Ms. Harvey indicated the amendment was drafted jointly by the Planning Department and City Attorney on City Commission recommendation. Ms. Harvey requested the Board to approve the proposed amendment. No persons appeared in support of or opposition to the proposed amendment. CD Motion was made by Mr. the above amendment to unanimously (7 to 0). CD) Chairman's Items Schwob, seconded by Mr. Green,to approve the Land Development Code. Motion carried - Chairman Johnson stated he received two decisions by hearing officer, one being upheld and one being ,overruled. In the' case of Great Shape Canteen, the City was overruled with the conditions that there be no sales for off premises consumption and that there be no increase in business size. In the case of request for 2APS at 410-420 Belcher, similar to lAPS request Item CB) 4 heard earlier today, the hearing officer upheld the Board's decision. (E) Director~s Items Ms. Harvey explained that parking regulations pertaining to marina facilities at motel sites came into effect due to limited parking available. Motels were asking for permission to park on right of ways, easements and open space, and later" asking the City to provide parking because the motels had not provided sufficient parking for motel guests and marina users. Ms. Harvey also indicated amendment to Land Development Code con- cerning commercial vehicles is still under discussion by the City Commission as is amendment to Land Development Code concerning the establishment of quorums and clarification of voting requirements for the Planning & Zoning Board and the Development Code Adjustment Board. e Minutes of the Planning & Zoning Board - September 2, 1986 Page -8- (F). Board and Staff Comments Chairman Johnson asked tor clarification of City's recourse if and when a hearing officer overru1es.a decision of the Board. Ms. Harvey advised if the City disagrees with the hearing officer, the' City Attorney may ask the City Commission if they want to seek judicial review. If the Commission so elects, there would actually be an appeal before the same hearing officer for the City to voice their opinion again and ask for reconsideration.
